Small Cell Wireless Facility
City Gem Lake Aesthetic Requirements for Street
Light Fixtures and Poles Installed in Conjunction with
Small dell Wireless Facility Equipment
All Street Light Fixtures and Poles. installed in conjunction with small cell wireless facility equipment,
within the City of Gem Lake shall be reviewed and 'approved by the City Council after review by the
-City Engineer prior to installation. This includes approval of wireless facility equipment installed on
City -.owned street lights, as well as privately owned street lights, and street Iights. owned by Xcel
l nergy and.Gonnexus:Energy.
A small cell wireless facility permit shall be requfredfdr installations within the publicright of way,
and collocation agreements arerequireo for each small cell wireless facility proposed on City of Gem
Lake owned infrastructure.
Street lightfixtures-.and poles installed to accommodate small cell wireless.facility.equipment shall
be uniform and consistent in both color and appearance with existing City.of Gem.>_ake street light
infrastructure. When a permit applicatlon is received, the City shall work with the -applicant to
provide information on the:type-bf pole, fixture, mounting, and base desires[ for requested
Iocation(s). The applicant shall be required to furnish a replacement pole as. deemed necessary by
the City where the requiremenfis assuch shall be identified in the collocation agreement.
The City of Gem.Lake shall not allow small cell.wireless. facility equipment to be installed on City
owned and maintained decorative: treet lights.
The City of Gem Lake -reserves the right*to reject any street light fixture pt�oposed.fio lie City owned
and maintained and -installed in-corijunction.with small cell wireiessfacilityequipment basedsolely

Resolution 2019-03 2019 Scholarship Award
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve
$1000.00 scholarships to E. Marier, M, Pratt and I. Tessier. Motion passed;. scholarships approved.

Approve Oswald sale of Propertv to Luther Group and changes -to the Land Use Ordinance
A motion was made by Councilmember Linder, second by Councilmember Cacioppo to approve the sale
of the Oswald property at 3516 Highway 61, Gem Lake, to The Luther. Company, LLLP, and add the
following warding to the ordinance #131, Consolidated Land Use Ordinance, Section 9.65, "When an
approved use in an abutting community is proposed to expand into Gem Lake, that. use shall be
considered a.Conditional Use in Gem Lake. Use is limited to: automotive dealerships. Abutting

S.E.H. Report on Water Issues on Scheuneman Road in the Residential Area
City EngineerJustin Gese reported on localized flooding that occurred on Scheuneman Road in the
residential area this spring. Gave three options to address the flooding, in addition to adding culvert
Inspections as part:of the.MS4. Council discussed whom is'responsible forculverts,'an article in the
newsletter about culverts and snow removal dlsposaj. Discussed possible town }call meeting about
flooding.
Agreement for Post Issuance Debt Compliance Policy and Procedures - Ehlers SEC Requirement
A motion was made by Councilmember Cacioppo;. seconded by Co.un.cilrnernber Linder to. pass the
Agreement for Post Issuance Debt Compliance Policy and Procedure. Motion passed, agreement signed.

A motion was made by Councilmember Cacioppo; seconded by Councilmember Lindner to approve the
claims to April, 2019. Motion passes, claims approved,

4140 Scheunema.n Road.. The council discussed clarification of the wording on the invoice for 4140 Otter
Lake Road .hook up to the manhole, discussing condemnation of the property arid informing neighbors
about the failing septic. Councilmember Linder made a motion, seconded by Councilmember Kunyto
.clarify the language in the Gem Lake Invoice dated December 12, 2018: The fee. to connect to the sewer
(the connection fee) is referred to as the "sewer assessm6ht from 2004" and "road construction 2604"
collectively. The council. agreed to continue with prosecution. Council agreed to have Mayor Uipen
contact. City Attorney to clarify condemnation procedures. Motion passed.
Discussed Water Gremlin emissions, well testing, ground water testing and penalties, article in
newsletter to explain in.more detail.
Discussed MNTAP intern:. housing for Water Grernli.n project, agreed that. if no other location for housing
of the intern is available, intern can be housed at City Hall during regular business hours:

The -tax-exempt status of a debt obligation is contingent -on compliance with -all applicable sthwandlederal

includin; any rebate amount or -yield reduction payment and any interest or penalty for failureto.maketitnely

NO THIRD PARTY BENEFICIARY

CONFIDENTIALITY: DISCLOSURE OF INFORMATION
Client information All information, files, records, memoranda And,other data of the Client ("Client
lnfortnation") shall be deemed by the parties to be the property of Client: Ehlers. may disclose Client
Information to -third parties: itr connection with (lie performance by it of its duties hereunder.
Ehlers Information Client acknowledges that in connection with the performance by.Ehlers of its dudes
hereunder; Client may become aware of internal files, records*. memoranda and other data,. including without
limitation computer programs of Ehlers ("Ehlers Information"). Client acknowledges that all Ehlers
Information, except. reports prepared by Ehlers for the Client, is confidential and proprietary to Ehlers, and
agrees that Client will not; directly or indirectly;r disclose the same or any par( thereof to any person or entity.

TERM 1 TERMINATION OF CONTRACT
This Agreement shall begin on the effective date stated.above. Either party may terminate -this Agreement

ENTIRE AGREEMENT

AMENDMENT
Ehlers and Client flay mutuallyabree in writing to amend -the terms covered by this Agreement (which.
amendment.shall be reflected in an Addendum to this Agreement), including the scope and the fee
arrangement, at any time. No modification, alteration, or amendment to this Agreement shall be binding
upon any party hereto antiI such modification, alteration; or amendment is reduced to writing and duly
executed by both parties hereto.
GOVERNING LAW
This Agreement shall. be governed by and construed in accordance with the laws, of the State of Minnesota.

The: next August, as the curtain opened to a -darkened auditorium at the, Q* pening &haul
C:oniraeation for more than 900 school staff, the spotlight shone on the diminutive Enii-ly. Her
voice filled the auditorium; her poise and genuine interpr-6* i.on warmed hearts; -.and many an eye
was.. moist with tears. It was, staff told me al:terwards..a moment of inspiration, with
administrators. teachers and aupport staff :determ-ining-to beat their bost for the year.

I've known lsaac Tessier since 2017 When he was placed in my 11 th grade Language Arts class. This
year, he took my College Writing course. I've always felt that Isaac has been "one-step ahead„ of his peers in
terms of reading and writing. He's a self -motivated learner who doesn't need any hand -holding. Give him the
basic tenets of an assignment, and he's off to the races.
I know Isaac is into sports--basketbaii especially. As teamwork is important on the court, the same can
be said about academics. If given a group. task, Isaac isn't one to sit back and let others work around him.
