Resolution Stating Agreement to Extend Effect of Former Zoning Code to Flillary
Farm Subdivision
WHEREAS, Hillary Farm LLC ('-Hillary Farm'); a Minnesota limited liability
corporation, obtained -nal. approval for a.sub ivision in the City of Gem Lake and signed
a developers.' agreement in August 2004; and
WHEREAS, Hillary Farm requested an extension of the statutory 2-year period in which
zoning and comprehensive plan changes -would not apply to the lots in the* subdivision;
and
WHEREAS, tho City of Gem Lake granted this request on December 21,:2006, with the
condition tharthe`principal of Hillary Farm, James McNulty,.remain in -ownership of the
lots in the development; and
WHEREAS, Hillary Faxam has asked that tbe. condition stated on December 21, 2006 be
amended to allow the company to sell individual lots to'other owners or builders;
NOW THEREFORE, BE PT .RESOLVED, by the City Council of the City of Geni
LAKE, Mio niesota, as: follows.;
1. That the action. taken by the City Council, ion Deep%0ber 21., 2006 granting an extension
of the Minor: Stet. § 463 358 subd.1(d). exemption to.Hillaty Farm is hereby rescinded.
I Theirthe. City agrees to a period of exemption from zoning and comprehensive plan
changes granted by final. subdivision approval of the Hillary Farm subdivision. until the
date a.building permit is issued forthe final lot sold in the: subdivision.
