Call to Order Mayor Gretchen Artig-Swomley called the meeting to order at 7:00 p.m. II. Call of Roll Mayor Gretchen Artig-Swomley, Councilmembers Len Cacioppo, Ben Johnson, Jim Lindner, and Joshua Patrick were present. Also present: City Attorney Martin Norder, City Treasurer Tom Kelly, Justin Gese, City Engineer, and City Clerk Barb Suciu. III. Approve of Agenda and Minutes A. Approve the Agenda for the February 17, 2026, City Council meeting. A motion was introduced by Councilmember Lindner to accept the February 17, 2026, agenda, seconded by Councilmember Cacioppo. Motion carried 5-0. B. Approve the Minutes of January 20, 2026, City Council meeting. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to approve December 16, 2025, City Council Meeting minutes. Motion carried 5-0. IV. Special Presentations/Public Hearings A. Resolution 2026-05; Consideration of the Rental License Renewal for 3930 Scheuneman Road. Mayor Artig- Swomley asked for a motion to open the public hearing regarding 3930 Scheuneman Road. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to open the public hearing at 7:01 p.m. for the Rental License Renewal tor 3930 Scheuneman Road. Motion carried 5-0. City Attorney Norder provided an overview of the process for renewing a rental license. He presented the police calls for the property over the past three years, complaints from neighbors, and the issue with the building official obtaining access for the required inspection. The City Council expressed concern about the complaints they have received over the past year about the property. Jeff Tschetter, property owner, stated the property was issued a license in 2025 and didn’t understand why the property is being discussed at a public hearing tonight. He was unaware of any police calls in 2025 and prior to that all issues had been resolved. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to close the public hearing at 7:23 p.m. for the Rental License Renewal to 3930 Scheuneman Road. Motion carried 5-0. City of Gem Lake City Council Meeting Minutes February 17, 2026 2 City Attorney Norder stated the options before the city council tonight are to renew the license, not renew the license, or renew the license with conditions. A motion was introduced by Councilmember Patrick, seconded by Councilmember Johnson for Resolution 2026-05; Resolution Denying the Renewal of a Rental License for 3930 Scheuneman Road. Newsletter Updates/Topics/Suggestions Mayor Artig-Swomley stated the next newsletter will be going out early April and some of the topics include water rates, Phase I Water project update, Comp Plan Kick off, Watershed and clean-up day. B. Resolution No. 2026-06; Resolution Authorizing the City Clerk to Enter into a Contract with Kodiak Power Solutions for the Installation of a Generator at Heritage Hall, 4200 Otter Lake Road. Mayor Artig-Swomley stated this item is for a generator for Heritage Hall. If Council recalls, we awarded a contract last year, but the contractor has since backed out. Two bids were obtained: Kodiak Power and NAC. Councilmember Patrick stated for the Kodiak Power bid, he would add the remote monitoring option that is outlined in the quote. A motion was introduced by Councilmember Patrick, seconded by Councilmember Lindner to approve a resolution authorizing the City Clerk to Enter into a Contract with Kodiak Power Solutions for the installation of a generator with the remote monitoring at Heritage Hall, 4200 Otter Lake Road. Motion carried 4-0-1 abstain (Cacioppo) C. Phase I Water Project – Next Steps Mayor Artig-Swomley stated Gem Lake has received additional funding from the Federal Government and Mr. Gese will present the current options. Justin Gese, City Engineer stated the city has received another grant from the Federal government. With the additional funds, there are two project funding options for the city council to consider. Project funding option 1 would cover all the costs with no special City of Gem Lake City Council Meeting Minutes February 17, 2026 3 assessment for Gem Lake properties. There would be $96,108 remaining with the potential up to $218,858 if there is still an assessment to Vadnais Heights property. Project funding option 2 would add water services to Big Fox south. There would be an assessment to Gem Lake residents estimated at $4,300 per lot and the special assessment for the Vadnais Heights property. Adding the additional properties would have the project break even. He added there could be another grant forthcoming that would assist property owners with well sealing costs for approximately $275K. This grant requires a 10% match, and all properties need to connect before 2029. If the property owner doesn’t connect, the grant would be adjusted accordingly. A motion was introduced by Councilmember Cacioppo, seconded by Councilmember Lindner to continue with the Water Project Funding Option 1. Motion carried 5-0. D. Joint City Council/Planning Commission Meeting – March 9, 2026 Mayor Artig-Swomley stated on March 9, 2026, there is going to be a joint meeting of the City Council and Planning Commission to kick off the planning of the 2050 Comprehensive Plan. The vision is to establish a very broad schedule of deadlines and splitting out sections to appropriate consultants or commissions. VIII. New Business A. This study evaluates the proposed extension of the water main from the City of Vadnais Heights. Previous feasibility studies, completed in 2006 and 2022, examined the potential for a centralized water distribution system within Gem Lake to provide a safe and reliable water supply for all residents and businesses. In addition to centralized service, the earlier studies explored smaller, localized water supply projects that could be phased in to address areas with known well water quality concerns. These localized systems would connect to the nearest surrounding community’s distribution network, helping to minimize both cost and complexity. This report builds on those efforts by specifically assessing the extension of the Vadnais Heights water main at the Labore Road connection, previously identified as Priority 1, Option 1. Since Gem Lake does not plan to develop its own water source, the City must rely on neighboring communities to supply water to its distribution system. While earlier studies focused on evaluating water demand, quality, and the capacity of nearby community systems, this report is intended to advance the project through potential grant funding and by initiating the 429 process to assess the benefiting properties for the proposed water main. (see figure ES-1 below) Most residents currently rely on private wells, with limited municipal service provided through earlier connections to Vadnais Heights and White Bear Lake. This study identifies extending a 12-inch water main from Vadnais Heights along Labore Road, with connections at Little Fox Lane and Goose Lake Road and supporting 6-inch mains to local streets, as the most cost-effective and feasible option. Vadnais Heights has adequate supply capacity and delivers safe, treated water that meets all standards, while looping options to the Gem Lake Villas water main should also be considered to improve system redundancy. The improvements will provide residents with potable water, reliable pressures, and fire protection capacity, with construction anticipated to remain largely within existing rights-of-way. Project costs are proposed to be funded through special assessments to planned industrial benefiting properties, City contributions, and grant funding, with an independent appraisal confirming assessable benefit values. If approved, the City Council can proceed under Minnesota Statute 429, beginning with an Improvement Hearing in spring of 2026, with bidding in fall/winter of 2026 and construction scheduled for summer and fall 2027. The study concludes that the improvements are necessary, feasible, and cost-effective, and recommends that the Council accept the report, hold the Improvement Hearing, and move forward with design, bidding, and construction. The report was authorized by the City Council at their regular meeting on Tuesday, June 17, 2025. Short Elliott Hendrickson Inc. (SEH®) prepared a Municipal Water Supply Feasibility Study in 2006 and again in 2022 for the City of Gem Lake. That study reviewed options to provide a municipal water supply system throughout the entire city of Gem Lake. Recently the Minnesota Pollution Control Agency (MPCA) and Minnesota Department of Health (MDH) completed sampling for 1,4-dioxane, a likely known human carcinogen, in private wells in Gem Lake. Results of the sampling showed levels above the MDH health-based guidance value for 1,4-dioxane in some of the private wells in Gem lake. The proposed improvements include extending a water system from the City of Vadnais Heights along Labore Road, which was previously described as Priority 1 option 1 in the latest 2022 Feasibility Study. 2 Existing Conditions Currently, most residents and businesses in Gem Lake rely on private wells for their water supply. Exceptions include AutoNation, the White Bear Montessori School, and the Villas off County Rd E which receive water from Vadnais Heights, as well as properties served by the 2016 water main extension along Scheuneman Road, supplied by White Bear Lake. The proposed project area includes Labore Road, a rural county roadway, along with several local rural streets primarily centered within the existing right-of-way. Portions of these streets pass through wooded areas adjacent to the roadway. 3 Proposed Improvements The 2022 study recommended connecting to the City of Vadnais Heights for several reasons. Vadnais Heights is currently working with a developer to extend a 12-inch water main within the ditch along the west side of Labore Road up to Little Fox Lane, providing a convenient connection point for the proposed extension. Installing the water main within the ditch will also help minimize impacts to Labore Road, a county roadway that was resurfaced only a few years ago. Vadnais Heights has the capacity to meet Gem Lake’s projected water demands and provides a water supply that meets all applicable State, Federal, and Minnesota Department of Health FEASIBILITY STUDY GEMLK 186534 Page 2 standards. Water quality data was reviewed using the City’s Consumer Confidence Reports (CCRs), which are annual drinking water quality reports required by the U.S. Environmental Protection Agency. Vadnais Heights draws its water from three deep wells, 470–495 feet, tapping the Prairie Du Chien–Jordan and Jordan aquifers, with an additional well available for emergency use. The water is treated with chlorine for disinfection, fluoride for fluoridation, and polyphosphate to control iron and manganese, helping to maintain taste and appearance. The water is not softened and has a hardness of 12 grains per gallon, which is considered hard. 3.1 Little Fox Lane Connection The proposed Little Fox Lane connection will be installed within the western ditch of Labore Road, consisting of a 12-inch HDPE water main. (as shown in Figure 3) From there, an 8-inch main will extend across Labore Road and continue along the south side of Little Fox Lane to minimize impacts at the Little Fox Lane/Big Fox Road intersection. It will then cross Little Fox Lane, proceed north along the west side of Big Fox Road, and terminate just north of the existing cul-de-sac. The proposed watermain will be installed at a depth of 7.5’ deep and installed approximately 4’ from the edge of the bituminous pavement to minimize roadway impacts. 3.2 Goose Lake Road Connection The proposed Goose Lake Road connection will be installed within the southern ditch of Goose Lake Road, the water will extend from the Labore Road future water main extension from The City of Vadnais Heights. The Goose Lake Road extension will consist of a 10-inch HDPE water main which will extend to the east approximately 3200’ (as shown in Figure 3). Two 6” lines will serve isolated streets along the route. The first tee to 6” main will be located at the Tessier Road intersection that will run along the east side of the roadway to its terminus at the end of the cul- de-sac. The second tee will be installed at the Haven Lane intersection and will extend down the east side of haven Lane to the end of the cul-de-sac. To minimize impacts, the proposed watermain will be installed at a depth of 7.5’ deep and approximately 4’ from the edge of the existing bituminous pavement. 3.3 Connection to the Vadnais Heights System The City of Vadnais Heights has been in contact with the City of Gem Lake regarding the future connection along Labore Rd. Based on the preliminary demand projections, they have the supply and storage capacity to serve the Gem Lake water system. With the current connection at the Gem Lake Villas, the City has experience with billing and any maintenance requirements. The hydraulic analysis and computer modeling performed as part of the 2022 report indicated that connection to the Vadnais Heights water system would produce adequate pressures and flow rates in Gem Lake. The lowest household pressure seen was 35 PSI however most of the homes were in the 60 PSI to 70 PSI range. If the pressure is too low in one of the households, a booster pump can be installed when the home decides to connect to the system. This is within the acceptable range for a water distribution system. Vadnais Heights billing rates are established in the municipal ordinance related to the water system (Chapter 36, Article II, Division 3) and are shown below from the 2025 Water Fee Schedule. For larger connections, fees are noted in the ordinance to be determined by the City Engineer based on the costs for installing the service. As property owners connect to the new Gem Lake Water System, they will need to obtain a plumbing permit and cover any costs associated with disconnecting or abandoning their existing well. Funding options for well abandonment are still being evaluated. Property owners will also be responsible for connecting their home’s plumbing to the municipal service line at the right-of-way, which will be stubbed out as part of this project. In addition, residents will need to install a water meter that is compatible with the Vadnais Heights metering system. The fees listed above are set by the City of Vadnais Heights. Administrative costs will be added, and residents will be billed directly by the City of Gem Lake. FEASIBILITY STUDY GEMLK 186534 Page 4 3.4 Additional Connection Options\Looping The City’s primary goal in extending the watermain is to provide safe drinking water to residents along the project corridor. However, all proposed extensions would terminate as dead ends, so the City should evaluate opportunities to loop the system. The previous report identified potential connections to the Gem Lake Villas water main system (Vadnais Heights Service). The water main would extend south from Goose Lake Road, continuing between the parcels to connect midway at the end of the unimproved right-of-way east of Little Fox Lane. From there, the watermain would extend to the northwest corner of the Villas development, creating a looped system. A reference figure is provided below with the suggested loop shown as the pink dashed line. Additionally, the City reviewed options to connect two small, privately owned cul-de-sacs to the new water main. The first is off Big Fox Road heading west and the second is off Goose Lake Road heading south, located approximately 540’ east of Labore Road. Stubbing a connection for these cul-de-sacs would provide landlocked parcels easier access to the new watermain. These parcels are not currently included in the assessment roll and therefore, the stubbing of a larger water main pipe to service them was not considered. Instead, the City will install a corporation stop at the main as part of this project for each of the parcels to connect to when they choose to in the future. FEASIBILITY STUDY GEMLK 186534 Page 5 4 Right of Way and Easements The construction of the proposed improvements in this report are anticipated to fall within existing right of way of the project roads. If the system is extended and looped in the future to the Villas Development, the City would have to acquire easements to those connections. 5 Permits and Approvals The following permits and approvals will need to be obtained for this project. Minnesota Department of Health (water main extension). Minnesota Pollution Control Agency (turf disturbance if greater than 1 acre) – NPDES. Coordination with the City of Vadnais Heights on connection to and use of water. Coordination with Ramsey County, Vadnais Heights on use of right-of-way for water main placement. 6 Cost Recovery 6.1 Benefits and Assessments The City intends to levy special assessments to the benefiting properties in accordance with Minnesota Statute 429. This state law allows the City to assess adjacent properties for the costs associated with the project improvements. In addition to special assessments, the City will be utilizing a Grant to fund the remainder of the project. Following the 429 Statute, once the feasibility report is received by the City Council, a Public Improvement Hearing will need to be ordered and held. Within six months of the Public Improvement Hearing, a Council vote to adopt a resolution ordering the improvement will need to be taken or another hearing will need to be held. “Ordering” the improvement means authorizing the preparation of the plans and specifications and moving ahead towards bidding and construction. 6.2 Special Benefit Analysis An independent appraiser was hired to determine the benefit amount for the properties to have access to City supplied water. The report is attached and determined that the maximum accessible amount per parcel, per dwelling for single family is $14,250. For the planned industrial property along Labore Road, the benefit was determined to be 10% of the appraised property value or $122,750. Fall of 2027 FEASIBILITY STUDY GEMLK 186534 Page 7 8 Conclusions and Recommendations 8.1 Conclusion From the results of our study, we conclude that: The proposed improvements are necessary to provide the City with potable water and flows capable of fire protection for the neighborhoods. Given the City’s desire to connect to Vadnais Heights’ water system and the location of the properties requesting municipal water. The proposed improvements are feasible and cost effective compared to other options. The City should consider a second connection to the Vadnais Heights System in the near future to limit the time this portion of the City would be on a dead-end-main. The project cost of $122,750 would be assessable. 8.2 Recommendation The City Council accepts this report and schedules the improvement hearing to receive public comment on the project should the Council decide to proceed with the improvements. The improvements proceed as outlined in this report. A portion of the costs for these improvements will be recovered from benefiting properties through special assessments, City contribution, and Grant funding. Everything in the building shut down including the computers. This was somewhat odd. On Thursday, March 12, I received a call from Metro-INET indicating they were going to send someone out to look at the main server in the building. When the individual came out, we discovered that the system doesn’t have an Uninterrupted Power Supply attached to the current equipment. After looking at the system, he was suggesting a unit that would be in the equipment rack instead of sitting on the floor. The quotes will be coming from Metro-INET by Tuesday, and I will forward these one. The HP 755 Multi-Function Printer is approximately 10-12 years old. With the recent amount of scanning that is taking place, the intake roller is deteriorating as well as a few other issues. I am asking for input from the City Council regarding the direction of purchasing a new desktop copier. Would you prefer to purchase or lease desktop a copier?
