Meeting Minutes
I. Call to Order
Mayor Gretchen Artig-Swomley called the meeting to order at 7:00 p.m.
II. Call of Roll
Mayor Gretchen Artig-Swomley, Councilmembers Len Cacioppo, Jim Lindner, and Joshua Patrick
were present. Councilmember Ben Johnson was absent and excused. Also present: City Attorney
Martin Norder, City Treasurer Tom Kelly, Dustin Cesfasky, SEH Project Manager, and City Clerk Barb
Suciu.
III. Approve of Agenda and Minutes
A. Approve the Agenda for the March 17, 2026, City Council meeting.
A motion was introduced by Councilmember Lindner to accept the February 17, 2026, agenda,
seconded by Councilmember Cacioppo. Motion carried 4-0.
B. Approve the Minutes of February 17, 2026, City Council meeting.
A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo
to approve December 16, 2025, City Council Meeting minutes. Motion carried 4-0.

A. Newsletter Updates/Topics/Suggestions
Mayor Artig-Swomley stated the next newsletter will be going out early April and some of the
topics include water rates, Phase I Water project update, Comp Plan Kick off, Storm Water
Management articles, rental property, and clean-up day.
B. Resolution No. 2026-08; Resolution Accepting Feasibility Report and Calling for an
Improvement Public Hearing for the Improvement Gem Lake Water Main Extension Phase I
Mayor Artig-Swomley introduced Dustin Cesafsky for the presentation.
Dustin Cesafsky, SEH Project Manager, presented the Feasibility Report for the Improvement Gem
Lake Water Main Extension Phase I. The project is concentrated on the properties on the east side
of Gem Lake. These are the properties that have the highest concentration of Dioxin
contamination.

Rick Bosak, resident, inquired about the previous discussion of using some the grant money to for
connection fees.
A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo for
Resolution 2026-08; Resolution Accepting the Feasibility Report and Calling for an Improvement
Public Hearing for the Improvement Gem Lake Water Main Extension Phase I. Motion carried 4-0.
VIII. New Business
A. Resolution 2026-09; Resolution Authorizing the City of Gem Lake to Enter into a Joint
Recycling Event Agreement with White Bear Township
A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo for
Resolution 2026-09; Resolution Authorizing the City of Gem Lake to Enter into a Joint Recycling
Event Agreement with White Bear Township. Motion carried 4-0.
B. Review of 2050 Comprehensive Plan Kick-off meeting
Mayor Artig-Swomley provided an overview of the process for completing the 2050
Comprehensive Plan including a bid from SEH for the engineering parts, neighborhood meetings
and in-house revisions.
C. Equipment Addition\Replacement
o Uninterrupted Power Supply
A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to
purchase an Uninterrupted Power Supply. Motion carried 4-0.
o Canon copier
A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to
purchase a Canon copier and remove the HP 755. Motion carried 4-0.
D. Ordinance 83-Housing and Occupancy Code Revision
Mayor Artig-Swomley provided an overview of the revised Ordinance 83. She suggested the
Planning Commission, City Attorney, Mike Johnson and City Council to read through the language
and at the April meeting there can be a discussion with any amendments.
IX. Community Outreach to other Cities and Government Bodies
Mayor Artig-Swomley stated we are in the process of finalizing the Water Agreement with Vadnais
Heights. This will be settled when the City Engineer is back from vacation.
X. Presentation from the Public
No issues raised.
XI. Open Items for Council Members to Bring up
Mayor Artig-Swomley confirmed that Councilmember Patrick will be at the Lakes Dispensary
ribbon cutting on Saturday, March 21 at noon.
Mayor Artig-Swomley stated office hours will be changing in early May to allow the City Clerk to
participate in a golf league at Gem Lake. She felt this would be good public relations for the city.

A motion was introduced by Commissioner Pratt to approve January 6, 2026, Planning Commission
Meeting minutes, seconded by Commissioner Epelboim. Motion carried 3-0.

A. Review Amendments to Ordinance 83 and Provide Feedback for the City Council.
Barb Suciu, City Clerk provided an overview of how these amendments were brought forward.
She indicated the proposed text was from the existing ordinance with additional language from
the City of Willernie.
The consensus of the Planning Commission was favorable to the changes. Commission Pratt
stated that in the proposed ordinance there is a provision in Section 1; subsection 9 stating that
any minimum standard shall not exceed the minimum standard provided for new construction by
the Minnesota Building Code, and in the event any minimum standard herein does exceed said
Building code, the standard of the Minnesota Building Code shall govern. He added this is
important to have that guard rail within the ordinance.

MS4 Program
UPDATES
o Current permit expired on November 15, 2025.
o Two attempts to solicit feedback on the draft permit have occurred:
•Written feedback request (May 2025)
•Informal pre-public notice (February 2026)
o What’s next?
o Spring 2026: MPCA will have a 30-day formal public notice period on the new
draft permit.
o May 2026 – July 2026: MPCA will issue the new 2026 permit. The Part 2
application (“SWPPP Document”) should be initiated. This may include
calculations associated with WLAs/TMDLs.
MS4 Program
UPDATES
o Fall 2026: The Part 2 application is due.
o A completed Part 2 application will be placed on public notice for 30-days and
once complete, permit coverage will be issued.
o Updates to regulatory mechanisms, SOPs and the stormwater pollution
prevention plan (SWPPP) will be required to be completed within 12 months
of permit issuance.
o Late 2027: All program updates are completed.

MS4 Program
UPDATES
o The MPCA lists the following notable changes in the 2026 permit:
•General changes include reorganizing the location of specific permit language, defining
frequencies (e.g., education, training activities), adding and revising permit definitions, and
more to further meet the EPA remand rule and have clear, specific, and measurable
requirements.
•Associated requirements in MCM 3 and MCM 6 for the prohibition of PFAS-containing
firefighting foams and pesticides.
•A newly added Section 23 provides permittees an option to develop a water quality trading
program for purposes of making progress toward achieving an applicable WLA(s).

RESOLUTION ORDERING IMPROVEMENTS AND AUTHORIZING PREPARATION
OF PLANS AND SPECIFICATIONS FOR IMPROVEMENT PROJECT GEM LAKE
MUNICIPAL WATER PHASE I
WHEREAS, the Gem Lake City Council on March 17, 2026, accepted the feasibility report for
municipal water Phase I;
WHEREAS, said improvements are cost effective and feasible as detailed in the feasibility report;
and
WHEREAS, the City Council on March 17, 2026, adopted a resolution setting a date for public
hearing regarding the proposed improvements for the described improvement area; and
WHEREAS, ten days published notice of hearing was given, and all people desiring to be heard
will be given the opportunity to be heard thereon; and
WHEREAS, the City Council will consider all comments, testimony, evidence and reports offered
at or prior to the public hearing; and
WHEREAS, the City Engineer is prepared to develop plans and specifications for said public
improvement project.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Gem Lake,
Minnesota, that Improvement Project Gem Lake Municipal Water Phase I is hereby ordered and the City
Engineer is authorized to prepare plans and specifications for said improvement.
The motion for adoption of the foregoing Resolution was duly introduced by Councilmember
_____________and supported by Councilmember ___________, and upon vote being taken
thereon, the resolution passed with a vote of __ in favor and __ against.

RE: 2050 Comprehensive Plan Proposal

The City of Gem Lake has received a proposal from SEH, Inc. for the proposed work on the
2050 Comprehensive Plan. Staff have sent a request for proposal to TKDA for their proposed
costs associated with the 2050 Comprehensive Plan. That information will be received prior to
the May 19th City Council meeting.

RE: Ordinance 83 Revisions

At the March 17, 2026, City Council meeting, the council was presented with proposed changes
to Ordinance 83 – Housing Code. The City Council asked that the Planning Commission, City
Attorney and Building Official review the revisions.
The Planning Commission met on April 7 and discussed the revisions. They didn’t have any
concerns about the proposed changes but were happy there were guard rails in the ordinance in
case of any discrepancy with the Minnesota State Building Code.
The City Attorney responded with adding the proposed language “Any hearing for denial, refusal
to renew, revocation, or suspension of a rental dwelling license, or for the imposition of
reasonable conditions or restrictions, shall be heard by the city council. The applicant for the
rental dwelling license shall be given 30 days’ notice of the hearing before the city council.” He
also suggested adding language about an appeal period and whether the appeal would go to
district court of the court of appeals.
The Building Official has not provided any feedback as of this publication.
Staff checked with the City of Willernie about the reasoning for such a restrictive rental code and
they were experiencing many of the houses in their city becoming rentals and wanted to regulate
that trend.
This item will be brought back to the City Council at their May 19 meeting for adoption.
