18 December 2012
The regular meeting of the City Council of the City of Gem Lake was called to order by
Mayor Uzpen on Tuesday, December 18, 2012 at 7:00 pm in the Gem Lake City Hall
meeting room.
The following members were present: Mayor Robert Uzpen. Councilmembers James
Lindner, Gretchen Artig-Swomley, Thomas Rasmussen and Councilmember Richard
Bosak. Members of the public attending per the sign in sheet sent around the room.
APPROVAL OF AGENDA AND MEETING MINUTES
City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to
the agenda. Upon motion by Councilmember Rasmussen, and seconded by
Councilmember Artig-Swomley, the December 18, 2012 agenda was approved. Ayes —
5, Nays — 0.
City Council November Meeting Minutes: The November 2012 minutes were
presented and corrections were needed. Upon motion by Councilmember Artig-
Swomley, and seconded by Councilmember Bosak, the November City Council minutes
were accepted. Ayes — 5, Nays — 0.
Planning Commission October Meeting Minutes: The October Planning
Commission meeting minutes were presented and no corrections were needed. Upon
motion by Councilmember Artig-Swomley and seconded by Councilmember Bosak, the
October Planning Commission minutes were approved. Ayes — 5, Nays — 0.
Planning Commission November Meeting Minutes: The November Planning
Commission minutes were tabled.
Planning Commission Chair Report: Planning Commission Chairperson Faith Kuny
presented to the City Council the status regarding the revision of the Residential Zoning
District. The December Planning Commission was cancelled, as they did not have a
quorum. Attorney Pat Kelly was present so they had an informal meeting. Chairperson
Kuny stated the map of Gem Lake in the Comp Plan are not accurate. It was suggested
to not use abbreviations. There are a few places in the Comp Plan where the land
range is listed. Attorney Kelly stated not to use numbers. Page 18 states 5-acre lots for

single-family estates. The minimums are 1/3 acre, 3-acre and 5-acre lots. Chairperson
Kuny asked if she was to chair the January Planning Commission meeting and Mayor
Uzpen stated yes.
OLD BUSINESS
Newsletter: Councilmember Artig-Swomley stated she needs more topics for the
January newsletter. The cancellation of the January Workshop is in the issue. Some of
the topics are.:
• Property valuation going down
• Mayor Uzpen talking about accomplishments
• Feedback from Gem Lake residents
• February Workshop — Will discuss Ordinance
• December/January snowplowing — small city last to be plowed
• Status of Planning Commission Chairperson seat
• Land Ordinance to match Comp Plan

2013 Fire Contract: The City Council looked over the contract and upon motion by
Councilmember Artig-Swomley and seconded by Councilmember Lindner, 2013 Fire
Contract passes. Ayes — 5, Nays — 0.
Resolution 2012-16 - Art Pratt Planning Commission: The City Council looked over
the Resolution stating Art Pratt to stay on Planning Commission as a perm position.
Upon motion by Councilmember Artig-Swomley and seconded by Councilmember
Lindner, Resolution 2012-16 passes. Ayes — 5, Nays — 0.
Claims for December: The claims for December were discussed and authorized to
pay. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember
Rasmussen, the claims for December passes. Ayes — 5, Nays — 0.
Monthly Financial Reports: The City Council received and reviewed the report.

It is again time for the City Council to consider approving renewals of the licenses
for the Country Lounge located at 3590 Hoffman Road. The Country Lounge held
the following licenses for 2012:
On -Sale & Sunday Liquor License
Tobacco Sales
Charitable Gambling
I have received the applications for the On -Sale & Sunday Liquor Licenses and
the Tobacco Sales. All fees have been paid. I will be receiving the Certificate of
Insurance listing the City of Gem Lake as an additional insured for 2013.
I have also had the Ramsey County Sheriff's Department perform background
checks, and they are all clear.
The necessary paperwork for the 2:00 a.m. closing is also complete and
attached.

To The Mayor and Council of the City of Gem Lake:
Pursuant to the provisions of the Minnesota Intoxicating Liquor Act and
Ordinances of the City of Gem Lake, Country Lounge Inc. , with principal
offices located at 3590 Hoffman Road w , hereby applies for renewal of a
Liquor License for the period commencing first on the 1st day of January ,
2013, and ending last on the 31st day of December, 2013 , to sell intoxicating
liquors as defined by law at retail only for consumption "On The Premises" at
the -country Lounge located at 3590 Hoffman Rd. w.in the City of Gem
Lake, which the applicant controls and operates, and to that end hereby
represents and states as follows:
(1) Gem Lake is an incorporated city which has a population in excess of three (300)
hundred and which does not maintain an exclusive liquor store; and,
(2) The premises for which the applicant seeks renewal of a license is an establishment
having a resident proprietor and manager and a room with appropriate tables and
chairs for serving not less than thirty (30) guests at one time in which food is served;
and,
(3) On Sundays, intoxicating liquor will be served only between the hours of 12:00
(noon) p.m. and 12:00 (Midnight) a.m., and only in conjunction with the serving of
food; and,
(4) The applicant is a Minnesota corporation and has not been convicted of any willful
violation of any law of the United States, or of the State of Minnesota, or of any local
Ordinance, with regard to the manufacture, sale, distribution, or possession for
distribution for sale of intoxicating liquors, and no license issued to the applicant
under the provisions of the Minnesota Intoxicating Liquor Act has ever been revoked;
and,
(5) No manufacturer or wholesaler will own or control, or has any financial interest in, the
business of selling intoxicating liquors at retail on said premises, nor power to exact
or require the applicant, by contract, understanding or otherwise, to handle or sell
only the products of such manufacturer or wholesaler; and,
(6) No other retailer's license has been issued, directly or indirectly, to the applicant or
for said premises other than a cigarette license; no license of a class other than
hereby applied for has been issued to any person at said premises; and said
premises are neither owned nor controlled by any person to whom no license could
be issued; and
(7) Said premises are not within any area within which the sale of non -intoxicating
liquors is prohibited by the laws of the State of Minnesota, the provisions of any
charter, ordinance, or special law, or through zoning ordinances, proceedings, or
legal process regularly held for that purpose; and
(8) The applicant hereby agrees that any license granted pursuant hereto shall be
nontransferable without consent of the Gem Lake City Council; that said license shall

not be effective until a permit shall be issued under the laws of the United States in
case such permit is required under said laws; and that the applicant will keep said
license posted in a conspicuous place in said premises; and,

SUBJECT: GEM LAKE HILLS LIQUOR LICENSE RENEWAL
It is time again for the City Council to consider approving the renewal of On -Sale
and Sunday Intoxicating Liquor License for the Gem Lake Hills Golf Course.
The completed application, appropriate fees, and Certificate of Insurance listing
the City of Gem Lake as an additional insured have been received.
I have also received the background check from the Ramsey County Sheriff's
Department, and it is clear.
Requested Action:
Approve the renewal of the On -Sale and Sunday Intoxicating Liquor License for
Gem Lake Hills Golf Course, 4039 Scheuneman Road, for the period of January
1, 2013 through December 31, 3013, and authorize execution of the License by
the City Clerk, and further authorize staff to forward the documents to the Alcohol
and Gambling Enforcement Division of the State of Minnesota.

Pursuant to the provisions of the Minne ota Intoxicating Liquor Act and
Ordinances of the Cit of Gem Lake,i'+�l Lt LLC with principal

Liquor License for the period commencing first on the JS day of 21 ,
2013, and ending last on the 31 st day of December, 2013 , to sell in oxicatiihg
liquors as defined by law at retail only for consumption "On The Premises" at

Lake, which the applicant controls and operates, and to that end hereby
represents and states as follows:
(1) Gem Lake is an incorporated city which has a population in excess of three (300)
hundred and which does not maintain an exclusive liquor store; and,
(2) The premises for which the applicant seeks renewal of a license is an establishment
having a resident proprietor and manager and a room with appropriate tables and
chairs for serving not less than thirty (30) guests at one time in which food is served;
and,
(3) On Sundays, intoxicating liquor will be served only between the hours of 12:00
(noon) p.m. and 12:00 (Midnight) a.m., and only in conjunction with the serving of
food; and,
(4) The applicant is a Minnesota corporation and has not been convicted of any willful
violation of any law of the United States, or of the State of Minnesota, or of any local
Ordinance, with regard to the manufacture, sale, distribution, or possession for
distribution for sale of intoxicating liquors, and no license issued to the applicant
under the provisions of the Minnesota Intoxicating Liquor Act has ever been revoked;
and,
(5) No manufacturer or wholesaler will own or control, or has any financial interest in, the
business of selling intoxicating liquors at retail on said premises, nor power to exact
or require the applicant, by contract, understanding or otherwise, to handle or sell
only the products of such manufacturer or wholesaler; and,
(6) No other retailer's license has been issued, directly or indirectly, to the applicant or
for said premises other than a cigarette license; no license of a class other than
hereby applied for has been issued to any person at said premises; and said
premises are neither owned nor controlled by any person to whom no license could
be issued; and
(7) Said premises are not within any area within which the sale of non -intoxicating
liquors is prohibited by the laws of the State of Minnesota, the provisions of any
charter, ordinance, or special law, or through zoning ordinances, proceedings, or
legal process regularly held for that purpose; and
(8) The, applicant hereby agrees that any license granted pursuant hereto shall be
nontransferable without consent of the Gem Lake City Council; that said license shall

January 15, 2013
A RESOLUTION APPOINTING INDIVIDUALS AND FIRMS TO PERFORM THE
FUNCTIONS NECESSARY FOR SUPPORTING THE GOVERNING BODY OF THE
CITY OF GEM LAKE, RAMSEY COUNTY, MINNESOTA.
WHEREAS, the individuals, municipalities and or companies identified have agreed to
serve in the appointed positions identified for the period 01 January 2013 to 31 December
2013 or until replaced by another in an updated resolution.
Appointed City Officials and other appointed companies to represent the City.
Per Statue these positions/businesses are required.

The motion for the adoption of the foregoing resolution was proposed by Council
member Artig Swomley and was duly seconded by Council member Bosak
and upon vote being taken thereon, the resolution passed with a vote of 5 votes in
favor of the resolution and 0 against.
Whereupon said resolution was declared duly passed and adopted by the City Council of
the City of Gem Lake, on January 15th, 2013.
