The following members were present: Mayor Robert Uzpen. Councilmembers James Lindner, Gretchen Artig-Swomley, Richard Bosak, and Faith Kuny . Members of the public attending per the sign in sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the agenda. Upon motion by Councilmember Bosak, and seconded by Councilmember Lindner, the September 10, 2013 agenda was approved. Ayes — 5, Nays — 0. City Council August Meeting Minutes: The August 2013 minutes were presented and corrections were needed. Upon motion by Councilmember Lindner, and seconded by Councilmember Bosak, the August City Council minutes were accepted. Ayes — 5, Nays — 0. OLD BUSINESS Newsletter: Councilmember Artig-Swomley stated some of the topics are. • Report on the de -attachment proceedings • Power Line Project • Hoffman Road • Goals for 2014 • Discussion with VLAWMO — Bio Swell Project PUBLIC HEARING Ramsey Commissioner Blake Huffman Discussion about Citizen Issues: Commissioner Huffman introduced himself and spoke to the City Council and residents regarding Ramsey County and the issues of Goose Lake Road. Gem Lake City Council Meeting Page 2 of 5 Commissioner Huffman discussed the next two years there will be zero increase in county spending. The land where the Vikings were thinking of building an arena was bought from Ramsey County to clean it up and build housing, and businesses with the younger generation in mind. There will also be a 100-acre park north of that area. Councilmember Artig-Swomley explained the traffic volume and traffic speed on Goose Lake Road. She suggested putting a trail where the railroad tracks are behind Gem Lake as it forms the eastern boundary. Councilmember Lindner stated the overall issue of bikers is riding side by side taking up a good portion of the road. At this time, three bike clubs use Goose Lake Road as part of a loop they ride on. It was suggested more speed limit signs. The Sheriff has upped patrols to help the situation at this time. Commission Huffman will attend more City Council meetings throughout the year to confer with Gem Lake. Petition from DLW Properties, LLC and John Birkeland and Darlene J. Birkeland to detach Properties from the City of Vadnais Heights and Annex to the City of Gem Lake: Mayor Uzpen updated the City Council on the purpose of detachment..07 of 1 % of an acre from DLW Properties and Birkeland wants to move from Vadnais Heights to Gem Lake. Public Hearing Opened at 7:43 p.m. The business 10 Below (1/3 acre) is in Vadnais Heights. Mr. Birkeland has three houses in Gem Lake, and one house in Vadnais Heights using the same road. The road is listed as a driveway. Hoffman Road is in Gem Lake, putting all the properties in Gem Lake. Gem Lake would like to re -adjust the boundary. Public Hearing Closed at 7:47 p.m. Resolution Number 2013-06 — Approving DLW Properties LLC, John Birkeland, and Darlene J. Birkeland's Request to Detach: The City of Gem Lake City Council accepts the petition from the landowners. Upon motion from Councilmember Lindner and seconded by Councilmember Artig-Swomley to approve Resolution 2013-06. Ayes — 5, Nays — 0. Vadnais Heights plan is to expand Willow Road. They would like Gem Lake to extend Hoffman Road to meet Willow Road. Mayor Uzpen wants the City Council to think about when all properties are sold to make the land ready to connect city water. The condition would be "when" property is developed. Upon motion by Artig-Swomley and seconded by Councilmember Lindner to have Gem Lake's Attorney to negotiate with Vadnais Heights on road and water. Ayes — 5, Nays — 0. Upon motion by Councilmember Bosak and seconded by Councilmember Artig-Swomley, the claims for September 2013 passes. Ayes — 5, Nays — 0. September Monthly Financial Report: The City Council looked over the report and stated the report looks good for Gem Lake. VLAWMO Presentation: Stephanie McNamara from VLAWMO spoke to the City Council regarding TM report is done, but not approved yet. The report will be on public notice for 30 days. The City of Gem Lake has no natural outlet, so alegy stays on the lakes. There is 62.1 pounds of phosphates and need to cut it down to 47, which would make it 24%. Stephanie would like to have a Focus Group meeting to bring in people for discussion of the swells by Highway 61 or putting in some kind of a storm water system by the car dealerships. There is a variety of options to be on the list and see who is going to be responsible for making this happen. The costs and how it might be done. All this information has to be in the implication plan. The next phase will be waste load allocation. Gem Lake will need to bring property owners and businesses to discuss pollution. The financial commitments will be the next step. VLAWMO wants to start by putting swells along Highway 61. Also, study Impair Water Action Plan. Focus on getting Gem Lake clean. Gem Lake may receive a grant, but would have to match grant dollar to dollar. Will try to put this in the November workshop and invite the business owners, MN Dot and White Bear Lake. Mayor Uzpen will send out a letter inviting everyone to attend workshop meeting. PRESENTATIONS FROM THE PUBLIC Resident Paul Emeott thanked the City Council for the new road striping and signs OPEN ITEMS FROM THE CITY COUNCIL Councilmember Lindner went to the Public Hearing regarding 115 KV Line — 115 KV line and wants another line put in. Power quality has suffered. It would go from Maplewood substation to Goose Lake substation. It will run 2.8 miles. Telephone 651-747-2790 E-mail Citv(a-)gemlakeMN.org Gem Lake Planning Commission Meeting 1 October 2013 The regular meeting of the Planning Commission of Gem Lake was called to order by Councilmember James Lindner on Tuesday, October 1, 2013 at 7:00 p.m. at Gem Lake City Hall. The following members were present: Councilmember James Lindner, and Planning Commissioners Arthur Pratt, Dan Marier and Beth Herzog, and Derek Wippich. Planning Commission Agenda: Councilmember James Lindner went over the agenda and asked for any changes, deletions, or added agenda items. None was given and upon motion by Commissioner Herzog and seconded by Commissioner Pratt; the October 1, 2013 agenda was approved. Ayes — 4, Nays — 0. PUBLIC HEARING Tom Riedesel from White Bear Township spoke to the Planning Commission regarding the property on which Mr. Whitaker wants to build. Mr. Riedesel received the complete application on September 27, 2013. The property is at the southeast corner of Highway 61 and County Road E. The property is presently owned by Waldoch and is currently being used by Moldings, Doors and More. The Property is in the Gateway Zone. This proposal is for a high -end used car dealership. The site will use the existing building with upgrades and landscaping. The existing pole barn will be moved to back of the property. The remodel plan will add parking lot lighting. Some of the parking lot will be removed to allow for green space as required by the zoning ordinance. Redevelopment will occur in different phases. The first phase is the subject of tonight's public hearing and only includes repurposing the existing building and relocating the existing pole barn. There is also an existing strip center located on the property to be sold running along Hoffman Road. Any redevelopment of the existing strip mall will be part of a potential future Phase II. Mr. Whitaker also is considering a plan to reopen the driveway access to County Road E but approval for this will come from Ramsey County. Gem Lake Planning Commission Minutes Page 2 of 6 For tonight's hearing and Planning Commission meeting there are three pending requests for Conditional Use Permits (CUP). The first is for outdoor sales and display as defined by the Gateway Ordinance. The second CUP is to relocate the pole barn and is required because the structure exceeds 1,000 square feet. The final CUP request is for a chain link fence around the sales lot. Full size plans were passed out to everyone in attendance. Public Hearing Opened at 7:10 p.m. Acting Planning Commission Chair Lindner opened the public hearing at 7:10 p.m. Mr. Chuck Whitaker introduced himself to the Planning Commission and stated he has been a White Bear residence his whole life. He has entered into a purchase agreement with the Waldoch's for their Gem Lake property and if approved he would repurpose the former Waldoch showroom into a high end used automobile dealership featuring autos one to three years old in the $10,000 and up price range, including autos still under factory warranty. In the future, Mr. Whitaker would consider improvements to the strip mall, primarily demolishing it for a new structure. He would like to move the existing pole barn to the south end of the property and use it to store automobiles. The pole barn would reuse the existing timber beams but would have new siding and other improvements to make it look like new. The entire site will have less signage than what is there now. Also, plans for landscaping, lighting and green space are in the works. Acting Chair Lindner asked Mr. Whitaker if he was aware what Vadnais Heights wanted to do with the roads going onto Highway 61. Hoffman Road in its current configuration may be re-routed or otherwise modified to meet parcel needs. Mr. Whitaker is open to possible road change. Jim Segermark: Doesn't think a high end dealership should go in that site. There is the possibility that Ramsey County might buy the Vadnais Heights ice rink. If so, traffic may increase as new hockey programs could potentially use the ice. Segermark's point was that Mr. Whitaker's plans may be in conflict with what could happen should the Vadnais Sports Center be sold. Dennis Olson/Owner of Molding, Doors and More: Mr. Olson stated he has a newly extended two year lease which he entered into with Waldoch in March, 2013. Mr. Whitaker stated he has a signed purchase agreement with Waldock. The alternative is to leave the property as is. Mr. Whitaker wants the corner to look nice and believes his proposed upgrades will accomplish this. He has flipped houses and stores during his career. This is an investment of up to two million dollars. Look for us on the World Wide Web at gemlakemn.org Gem Lake Planning Commission Minutes Page 3 of 6 John Birkeland - Country Lodge/White Bear Floral: That parcel in question was bought by his grandfather and has been in his family for about 100 years and said south of County Road E is zoned for retail business. Mark Putman did the concept plan that showed the land as a place for retail business. Mr. Birkeland feels a car dealership would ruin his business. Mr. Birkeland has been working with Vadnais Heights to detach a small portion of his land which is currently located in Vadnais Heights and annex it into Gem Lake. Mr. Whitaker feels his cliental would improve John's businesses. He wants to be a long term member of the Gem Lake business community. Whitaker's potential Phase II has an investment partner and an architectural firm to help put higher quality tenants in the new spaces. Commissioner Wippich asked how many people visit an automobile lot before a car is sold. Mr. Whitaker stated that there are typically three to five people his sales force talks to before selling a car. He added that the internet helps bring into the business. Acting Chair Lindner stated that with the 1997 Comprehensive Plan there was language regarding limiting auto dealerships in the former retail district, but that has now been changed in the new 2008 Comprehensive Plan. Now, Gem Lake has formed based zoning that says if the planned building use meets the requirements, it can be built. Commissioner Herzog stated that the existing strip mall needs to be torn down as it's an eye sore. She asked if Mr. Whitaker would get tenants before taking down the strip mall. Mr. Whitaker stated he would need to get tenants first. He thinks any new strip mall would be a retail mall. Acting Chair Lindner wanted to know what a car dealership might look like in the next five to ten years. Mr. Whitaker stated will have to have inventory. Phase I holds 50 vehicles for the dealership. Jim Segermark: Is a car dealership in the plan versus a Lowes or Trader Joes? He suggested Gem Lake open the property to a more generalized attraction. Tiffany's Gifts and Thrifts: The corner has grown and she wants to know if the little business will stay or will larger companies will move in? She feels the ugly building could use a face lift, but if a dealership goes in there, will it benefit the people who are in there now? Commissioner Herzog stated that corner has gotten a lot of small business off the ground. But that strip mall has not been touched in many years. Could be a lot more. The whole piece needs to be bulldozed to build new space. Mr. Whitaker's plan is an enhancement to the parcel. Public Hearing Closed at 8:34 p.m. There are three requests: Conditional Use Permits for dealership, relocate pole building, and fence around business. Commissioner Herzog stated if Gem Lake is going to change, she would not like to see another automobile dealership go in, but going forward, if this passes, then she wants to see a change to the Waldoch property. She wants to see landscaping and better looking buildings. Commissioner Pratt stated change is needed and there is no time like the present. Commissioner Wippich stated the strip mall needs to go, but needs to be done quickly. He thinks there should be a timeline on the projects. City Attorney Patrick Kelly stated to the Planning Commission that they can make reasonable conditions on Phase I, which is before them tonight. Approve or disapprove of three Conditional Use Permits before them and vote on each of the Conditional Use Permits requests. Item One: Conditional Use Permit for the requested site improvements and use of the property for outdoor display and sales. Original motion by Commissioner Wippich and seconded by Commissioner Pratt to grant the CUP to allow for site improvements and allow outdoor display and sales. Ayes — 4, Nays — 0. Discussion followed the motion at the end of which Commissioner Wippich amended his original motion to say that there needs to be more detailed plans submitted on the project and that all proposed development must comply with all Gem Lake ordinances and all appropriate permits be secured before initiating any work on the site. Pratt seconded the amended motion. Lindner called for voice vote. Commissioner Wippich — yes, Commissioner Pratt — yes, Commissioner Marier — yes, Commission Herzog — yes. Motion passes. Ayes — 4, Nays — 0. Item Two: Conditional Use Permit to relocate existing pole barn since it exceeds1, 000 square feet. Upon motion by Commissioner Pratt and seconded by Commissioner Wippich. Ayes — 2, Nays — 2. Motion does not carry. Commissioner Wippich made a motion to reconsider of previous motion. Upon motion by Commissioner Wippich, and seconded by Commissioner Pratt. Ayes — 4, Nays — 0. Sufficiently refurbish exterior of existing pole barn to like new condition. If that is not feasible, the complete structure is removed from the site. Upon motion by Commissioner Wippich and seconded by Commissioner Pratt. Ayes — 4, Nays — 0. Item Three: Conditional Use Permit to install a chain link fence on the property. Discussion followed and Mr. Whitaker clarified that there will only be chain link fencing in the back where a similar fence exists now. The remainder of the lot would be bordered with a two or three foot high stranded metal cable fence, so there would be no new chain link fence thus this CUP was not needed. No motion was made and discussion ended. The Planning Commission will forward two recommendations for Conditional Use Permits to the City Council for approval.
