The following members were present: Mayor Robert Uzpen, Councilmembers James Lindner, Gretchen Artig-Swomley, Richard Bosak, and Thomas Rasmussen. Members of the public attending per the sign in sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the agenda. Upon motion by Councilmember Artig-Swomley, and seconded by Councilmember Rasmussen, the November 201234789, 2012 agenda was approved. Ayes — 5, Nays — 0. City Council October Meeting Minutes: The October 2012 minutes were presented and corrections were needed. Upon motion by Councilmember Lindner, and seconded by Councilmember Bosak, the October City Council minutes were accepted. Ayes — 5, Nays —0. Planning Commission October Meeting Minutes: The minutes were tabled until the December City Council meeting. Planning Commission Chair Report: Planning Commission Chairperson Faith Kuny was not present at the meeting. OLD BUSINESS November/December Newsletter: Councilmember Artig-Swomley stated that she had a few topics for the newsletter. • Charitable gambling donations • Welcoming Faith Kuny to the City Council • Final Budget for 2013. • Fee Schedules for 2013 Gem Lake City Council Meeting Page 2 of 5 • Final votes from the election. • Voter turn out • Property taxes for 2013 • Feature story on a Gem Lake resident. PUBLIC HEARING Fee Schedule - 2013: The City Council discussed the fee schedule at the November Workshop. Gardening fee will be $100 for the second year going forward. In addition, there was a fee instituted for commercial paving. Councilmember Artig-Swomley stated she was not at the Workshop and had a question on the Gardening fee. The City Council will vote on it tonight and then discuss the fee further at the December Workshop. Public Hearing opened at 7:15 p.m. No comments from the public. Public Hearing closed at 7:16 p.m. Upon motion by Councilmember Bosak and seconded by Councilmember Rasmussen, 2013 Fee Schedule has been approved. Ayes — 5, Nays — 0. Resolution 2012-15 City of Gem Lake 2013 Budget: Tom Kelly from White Bear Township, Treasurer for the City of Gem Lake presented with handouts to the City Council the budget for 2013. Mr. Kelly stated that the budget has not changed much for 2013. Mr. Kelly looked at what the City spent in 2012 and the last two years. Mr. Kelly explained the 2013 property tax levy of $368,994. Total budget for the City is $557,493 in total expenditures for all funds. There is no Park Fund expenditure due to no parks in the City. General Fund is at $311,344; biggest fund is for administrative services, and Public Works. Property values are still decreasing which will affect the amount of taxes paid. The trend is that by 2014 you will see an increase or the real estate market will stay flat. The budget is a 10% decrease from 2012. Public Hearing opened at 7:42 p.m. Mr. Bolfing wanted Mr. Kelly to explain the debt levy for Heritage Hall. Mr. Kelly explained the City of Gem Lake has three different payments that it makes. The debt on Heritage Hall was a levy. The levy in 2007 was for the Capital Improvement Bond to construct the building and has a principal and interest payment for 2012. The bond has fifteen years left on it. Upon motion by Councilmember Lindner, and seconded by Councilmember Artig- Swomley, Resolution 2012-15 passed. Ayes — 5, Nays — 0. A voice vote was taken: Mayor Uzpen — yes, Councilmember Bosak — yes, Councilmember Lindner — yes, Councilmember Artig-Swomley — yes, and Councilmember Rasmussen — yes. NEW BUSINESS Resolution 2012-13: There was extra money in the charitable gambling fund to go to the Union Gospel Mission. Upon motion by Councilmember Rasmussen and seconded by Councilmember Bosak, Resolution 2012-13 passes. Ayes — 5, Nays — 0. Resolution 2012-14 — Election Results: Upon motion by Councilmember Artig- Swomley and Councilmember Rasmussen, Resolution 2012-14 passes. Ayes — 5, Nays — 0. Claims for November: The claims for November was discussed and authorized to pay. Upon motion by Councilmember Lindner and seconded by Councilmember Bosak, the claims for November passes. Ayes — 5, Nays — 0. Monthly Financial Reports: The City Council received and reviewed the report and had no questions. PRESENTATIONS FROM THE PUBLIC Mr. Bolfing stated he feels Ordinance 29 Dangerous Weapons is against the hunting. Mayor Uzpen stated an article in the White Bear Magazine stated Gem Lake has hunting and hunters came into the City and were knocking on resident's doors asking to hunt on their land. Gem Lake received many complaints regarding this. Mr. Fritz asked what the City was doing to manage the deer over population in Gem Lake. Mayor Uzpen explained how the Hunting Ordinance was created by viewing the surrounding communities Hunting Ordinances. Mr. Bolfing feels by winter deer will run out of food will look for food in the City and will end up on the road hit by cars. Councilmember Lindner feels the Hunting Ordinance is fine. Councilmember Artig-Swomley feels the Ordinance is too strict. Mr. Dave Imsdahl, 10440 Kelman Avenue North, Grant, Minnesota was asking for approval for a hunting permit on Linda Hoeschlers land. Mr. Imsdahl was at the October City Council meeting and was missing a couple of signatures and at this time has all the signatures. Mr. Imsdahl has deposited the money for the permit and the landowner had emailed the City Council giving her permission for Mr. Imsdahl to hunt Look for us on the World Wide Web at gemlakemn.org Gem Lake City Council Meeting Page 4 of 5 on her land. Mr. Tom Riedesel from White Bear Township has all the original paperwork. A voice vote was taken to approve the hunting permit: Mayor Uzpen — no, Councilmember Bosak — yes, Councilmember Artig-Swomley — yes, Councilmember Lindner — yes, and Councilmember Rasmussen — yes. Upon motion by Councilmember Lindner and seconded by Councilmember Artig- Swomley, the hunting permit application was approved. The permit will be signed with the conditions and sent to the landowner. Ayes — 4, Nays — 1. OPEN ITEMS FROM THE CITY COUNCIL Mayor Uzpen stated at the VLAWMO meeting the past week, the Board approved the swale to be built on Highway 61 in Gem Lake funded by VLAWMO. VLAWMO is also putting a floating island in at Tamarack Park. FUTURE COUNCIL MEETINGS Workshop Meeting: December 3, 2012 at 7:00 p.m. City Council Meeting: December 18, 2012 at 7:00 p.m. ADJOURN The November 20, 2012 regular meeting of the City Council adjourned at 8:20 p.m. Upon motion by Councilmember Lindner, and seconded by Councilmember Bosak, the City Council meeting was adjourned. WHEREAS, The City of Gem Lake participates in the distribution of gambling funds from the Country Lounge, WHEREAS, The City of Gem Lake distributes these funds to local schools and charities, BE IT RESOLVED, that the City Treasurer is authorized to send to Union Gospel Mission the amount of $250.00 for the cities contribution for the year 2012.
