Minutes of Gem Lake City Council Workshop
1 February 2010
The workshop meeting of the City Council of the City of Gem Lake started at 7:05
p.m. on Monday, February 1, 2010 in the Gem Lake City Hall meeting room.
The following members were present: Mayor Robert Uzpen, Council members
Gretchen Artig-Swomley, Thomas Rasmussen, and James Lindner. Other
members of the public attended per the sign in sheet sent around the room.
The informal meeting started out with the City Council members introducing
themselves the public who attended the workshop.
Councilmember Watson Replacement on City Council Board: The first item
on the agenda was to fill Councilmember Watson's place on the City Council.
Due to the demands of his job, he has resigned from the City Council Board.
Interest was mentioned by Dan Maier, from the Planning Commission and Mr.
and Mrs. Kuney who are new residents moving in the City of Gem Lake in March,
2010. Mrs. Kuney gave a summary of her background and interest in the
position. Also recommended by Councilmember Artig-Swomley was Rick Bozak.
Mayor Uzpen mentioned that after speaking with Gem Lake Attorney Trevor
Oliver, it was recommended that there are three (3) options to replacing the
position. Step 1 would be placing an ad in the newspaper. Step 2 would be the
Mayor appointing someone and step three would be to keep the position open
until the fall election.
Hoffman Road Sewer Problem: Mayor Uzpen mentioned the situation of the
sewer backing up on Hoffman Road. Mayor Uzpen contacted White Bear
Township to unplug the sewer so the residents could use their facilities. The
sewer broke by Jerry's Upholstery and Waldock. When the sewer on the north
side of County Road E was cleaned out, there was a lot of clay. The actual
sewer was put in over 50 years ago. Mayor Uzpen spoke to SEH and Bill Short,
from the White Bear Township. Justin is going to create a few different proposals
to present to the City of Gem Lake. Councilmember Rasmussen suggested just
looking into fixing the one problem spot for now. There is a video tape that the
previous Mayor had of the sewer line and will look for that to present to the City
Council.

Newsletter — Councilmember Artig-Swomley had spoken to State
Representative Bev Scalze asking if she would write up something for the next
newsletter regarding about the agenda for the year 2010 and responded with an
email inviting people to come to the Town Meeting on February 20, 2010.
2010 Goals for the City of Gem Lake: Councilmember Artig-Swomley
suggested coming up with some way for volunteers for short projects, appointing
a task force for the City of Gem Lake.
Mayor Uzpen suggested putting an article in the newsletter stating volunteer
positions, one being for VLOMO Group. Also mentioned were volunteers for
positions of the City of Gem Lake including sitting on other commission
committees for the City. Update or create Ordinances for hunting, flood plain,
and sub -divisions. Councilmember Rasmussen feels the dog ordinance needs to
be looked at and updated. The Comp Plan needs to be approved by the
Metropolitan Council and start working on updating with current information.
Public Works goals would be the business on business sewer district. First on
the agenda will be to take care of Scheuneman Road and McNaulty Road to
flush out the sewers and catch up on road repair. The two flagpoles will be
available in the next few months. Since the flag will be displayed twenty-four
hours a day, seven days a week, an electrician will need to install a light to shine
on the flag during the evenings.
The MS4 report is due in May and Gem Lake needs a map of the in flow/out
flows locations throughout the city. When obtained, Justin from SEH would make
a map for the city.
Councilmember Artig-Swomley suggested another spring clean up in late April.
Gem Lake needs to have more events to get the residents together. The CPR
class was a good start for the community events and National Night Out.
Something else to add would be a history night inviting the older residents to
discuss the depression and recession of the 1970s and how Gem Lake has
changed.
Mayor Uzpen feels the newsletter updates the residents of current events within
the community. Also suggested was putting together an information packet
making Gem Lake more developer ready. Planning Commissioner Rafferty
explained that developers want incentives, roadway variances, parkland and to
investigate what the City of Gem Lake can offer. At this time Gem Lake has no
money in the budget for incentives of this nature, but has spoken with a bonding
company and that company was invited to attend the February 23, 2010 City
Council meeting to present options on what Gem Lake can do for developers.
Another option would be tax abatement, a special assessment for 30 feet level.
The City would create an ordinance and get a bond for cost and the developer
would pay the City back with interest. Mayor Uzpen stated that he does not want

to put the City in debt at this time and economy, but these are options to get
developers to build in Gem Lake without hurting the residents.
Also mentioned was starting a $500 to $1,000 scholarship for a Gem Lake
student graduating from high school each year. The money would come out of
the gambling fund. The scholarship would be used for any secondary education
not just college.
A current list of all businesses of the City of Gem Lake needs to be updated so
each business can be sent a yearly business license application with a fee for
license and fire inspection.
Road striping was discussed, as this needs to be restriped every two to three
years. This will be looked at in the spring.
OPEN DISCUSSION
Councilmember Lindner updated the Council on the 17 water kits received from
the residents and suggested doing this again in May 2010.
A question was raised about the sports center development in Vadnais Heights.
Will this affect any development in Gem Lake because of that as traffic will be
affected on County Road E. The Hansen land was discussed about any
development regarding the Gateway Ordinance 107 project.
Trails and parks through Gem Lake were discussed, but at this time, there is no
city or state owned land.

Gem Lake Planning Commission Meeting
2 February 2010
The regular meeting of the Planning Commission of Gem Lake was called to
order by Chairman Craig Rafferty on Tuesday, February 2, 2010 at 7:01 p.m. in
the Gem Lake City Hall conference room.
The following members were present: Chairman Craig Rafferty, Planning
Commission members Beth Herzog, and Dan Marier.
APPROVAL OF AGENDA AND MEETING MINUTES
Planning Commission Agenda: Chairman Rafferty asked for any changes,
deletions or added agenda items. None was given, so proceeded to move
forward with the meeting.
Planning Commission Minutes: Chairman Rafferty called to approve the
January Planning Commission meeting minutes. The January Planning
Commission minutes were discussed and upon motion by Commissioner Herzog
and seconded by Commissioner Marier. The January minutes were approved.

NEW BUSINESS
Conditional Use Permit: Modification of 4 Seasons Auto was discussed.
Denny from the used car sales was there to discuss that he moved his office to a
different location on the site. The condition was one auto per parking space, no
parking on the street and no should be displayed for sale. Drop off on the side of
the building and operating hours will be 6 a.m. through 10 p.m. Monday through
Saturday. With approval from the City Council it will be amended to be the
shifting location of the office change with four to six cars parked in front. Per the
State of Minnesota he would need a zoning approval as the actual address will
change with seven parking spots up front and four parking spots on the side of
the building by the office. All car inventories will be in the back of the building
and he will pull the car around for the customer to view. Questions were asked
by the Planning Commission and Chairman Rafferty stated that Tom Reside from
the White Bear Township had gone through the zoning and recommended the
conditional use permit to be granted and keep conditions that were related to the

permit by the City Council. It was stated that it would be 20 parking spaces with
one parked car per space and with an additional six parking spaces that go with
the front office. The Planning Commission will make a recommendation to
approve and send forward to the City Council. Upon motion by Commissioner
Maier and seconded by Commissioner Herzog, the conditional use permit was
approved to forward to the City Council. Ayes — 3, Nays — 0.
3599 Scheuneman Road: Conditional use permit request from Mr.
starting a business by the name of High Tech Auto Services, Inc. The store will
be in the old Surround Sound store. His business is restoring/service repair of
old autos and full auto service. His place of business will be selling auto alarms,
custom tires, anything that has to do with restoring older vehicles. Most of his
stock is custom order. He will be the person working at the Gem Lake store. His
plan is to paint the outside and wants to clean up the area. He will view the sign
ordinance to see what is acceptable. The Planning Commission discussed the
issues and upon motion by Commissioner Herzog and seconded by
Commissioner Maier, it was approved to forward to the City Council and
suggested to attend the February 23, 2010 City Council meeting. Ayes — 3, Nays
— 0.
Hansen Property (West of Daniels Farm Road): There was discussion related
to the development of the Hansen property. The developer did not attend the
workshop meeting on Monday, February 1, 2010 and Chairman Rafferty stated
that the developer had called him and had the dates mixed up.
OPEN DISCUSSION
It was discussed that the Planning Commission is waiting for a response back
from the Metropolitan Council. It was mentioned by Mayor Uzpen that the Comp
Plan is from 2008. The Planning Commission agreed to view the updated Comp
Plan and focus on sections three, five, and nine and will discuss at the March
Planning Commission meeting. Will look over a chapter at a time. Mayor Uzpen
stated that there is money in the budget for the Planning Commission to work
with SEH. The Gateway Ordinance has been passed and zoning changed, but
nothing from 2009 (i.e. Gateway Ordinance) is not in the plan. SEH will start
working on the Comp Plan after Gem Lake does more research on their own.
Goals for 2010: Chairman Rafferty suggested that Gem Lake resolves the bike
trails and the safety to the community. Also mentioned was the opportunity to
get the community together. Go forth on the discussion of the Hansen property.
Figure out ways to handle requests for help in financing and finding alternative
ways to help developers.

Re: 2010 — 2011 LMCIT Insurance Package Renewal
I have been working with the Bill Blake, the City's Insurance Agent of Record on the
insurance package renewal for the policy period 04-01-10 to 04-01-11. We have submitted
the renewal application with the League of Minnesota Cities Insurance Trust.
We have received binders for the policy period. There is one additional item that must be
addressed by the City Council before the LMCIT will finalize the policies. Minnesota Statutes
provide for monetary limits on municipal tort liability at $500,000 per occurrence and
$1,500,000 in aggregate. Cities do have the option to waive these statutory limits if they are
willing to either carry umbrella policies or have another means to cover anything over the
limits.
It has been the past practice, based on policy history, to NOT WAIVE the monetary limits
provided under the statutes however I have not been able to locate where the City Council
actually discussed and voted on whether to waive or not waive the limits. The LMCIT has
asked that I provide a date of the City Council meeting where the Council actually approved
to waive or not to waive and submit the Liability Coverage Waiver Form (a copy is attached
for your reference).
At this time Council is being requested to make a motion to NOT WAIVE the monetary limits
on municipal tort liability; and to authorize the Treasurer to complete the Liability Coverage
Waiver Form indicating the Council's desire to NOT WAIVE the limits and submit to the
LMCIT accordingly.
SECTION I: LIABILITY COVERAGE WAIVER FORM
Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide whether or not to
waive the statutory tort liability limits to the extent of the coverage purchased The decision to waive or not to waive
the statutory limits has the following effects:
if the city does not waive the statutory tort limits, an individual claimant would be able to recover no more than
S00,0o0. on any claim to which the statutory tort limits apply The total which all claimants gould be able to
recover for a single occurrence to which the statutory tort limits apply would be limited to $1,1 00,000 These
statutory tort limits would apply regardless of whether or not the city purchases the optional excess liability
coverage
If the city waives the statuto tort limits and does not purchase excess liability coverage, a single claimant could
potentially recover up to $lio,000 on a single occurrence The total which all claimants would be able to
recover for a single occurrence to which the statutory tort limits apply would also be limited to $1*o,000 ,
regardless of the number of claimants
If the city waives the statutory tort limits and purchases excess liability coverage, a single claimant could
potentially recover an amount up to the limit of the coverage purchased The total which all claimants would be
able to recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount

Claims to which the statutory municipal tort limits do not apply are not affected by this decision

SUBJECT: FEES FOR TOWNSHIP SERVICES
On January 20, 2007, the City of Gem Lake and White Bear Township entered
into a Joint Services Agreement which outlined services that the Township would
provide to the City, and included in the Agreement is Appendix A which outlines
the staff billing rates to be charged.
At this time I have drafted a Second Amendment to Joint Services Agreement
Between the Town of White Bear and the City of Gem Lake which authorizes
amendment of Appendix A to reflect current Township staff billing rates. I have
also added "Equipment Billing Rates" which could be charged if Township
equipment is required.
Requested Action:
Approve the Second Amendment to Joint Services Agreement Between the
Town of White Bear and the City of Gem Lake which authorizes amendment of
Appendix A to reflect current Township staff billing rates, and authorize execution
by the Mayor and Clerk.

SECOND AMENDMENT
TO
JOINT SERVICES AGREEMENT
BETWEEN THE TOWN OF WHITE BEAR
AND THE CITY OF GEM LAKE
THIS AMENDMENT AGREEMENT, made as of this day of
February, 2010, by and between the TOWN OF WHITE BEAR (the Town), a
statutory township of the State of Minnesota, and the CITY OF GEM LAKE (the
City), a Minnesota municipal corporation,
WHEREAS, the Town and the City have an active Joint Services
Agreement between them which has been in effect and annually renewed since
January 22, 2007,
WHEREAS, a First Amendment to that certain Agreement was executed
by both parties on January 20, 2009,
WHEREAS, the Town desires to amend the fees for services outlined in
Appendix A of the original Agreement,
WHEREAS, Minnesota Statutes, Section 471.59, provides that a
governmental unit may enter into an agreement with another governmental unit
to provide services or perform functions on its behalf, provided that the services
or functions are those which the providing governmental unit is authorized to
provide for itself,
NOW, THEREFORE, in consideration of the mutual undertakings herein
expressed, the Town of White Bear and the City of Gem Lake agree to amend
their Joint Services Agreement — Appendix A as attached.
The parties hereby affirm that the Joint Services Agreement Between the
Town of White Bear and the City of Gem Lake, dated January 22, 2007, and First
Amendment dated January 20, 2009, and Appendix A as amended herein, is the
entire Agreement between the parties.

SECOND AMENDMENT
TO
JOINT SERVICES AGREEMENT
BETWEEN THE TOWN OF WHITE BEAR
AND THE CITY OF GEM LAKE
THIS AMENDMENT AGREEMENT, made as of this day of
February, 2010, by and between the TOWN OF WHITE BEAR (the Town), a

The Gem Lake City Council recently approved a Conditional Use Permit for Four
Seasons Auto Service and Sales which permits auto sales and repair at 3622
Scheuneman Road. The applicants for the Conditional Use Permit were Rick
Wilson, who operates the auto repair portion of the business and Dennis
Newcomb, who operates the auto sales portion of the business.
The Council approved the Conditional Use Permit for a period of 12 months with
follow-up by the City at the time of permit expiration. The Permit was approved
on 9/15/09, and is subject to the following requirements:
• No autos shall be displayed for sale on the street
• The Permit is non-transferrable;
• There shall be no complaints during the 12 month period;
• 20 auto maximum for sale on the property;
• One auto per parking space;
• Business hours 6 a.m. — 10 p.m. — Monday — Saturday; and
• Auto drop off shall occur on the side of the building and not on street.
Mr. Newcomb has submitted a Conditional Use Permit application which
requests City approval to relocate the auto sales portion of the business to the
southwest corner of Mr. Drummond's building. This portion of the building faces
County Road E, and has a County Road E address.
With the relocation of the sales office, the outdoor display area is also requested
to be modified, Mr. Newcomb would like to display up to 10 vehicles in front of
the building. Six spaces are proposed to be on the County Road E side of the
building with 3 stalls facing the building, and 3 stalls facing County Road E. Four
additional stalls are requested on the west side of the building, abutting
Scheuneman Road. An additional 6 spaces are proposed on the north side of the
building adjacent to the spaces currently identified for use by Four Seasons Auto.
All vehicle parking is proposed in existing striped parking spaces. Mr.
Newcomb's goal is to have 20-26 cars displayed for sale at any given time.
The proposed hours of operation are: Monday — Thursday 10 a.m. — 6 p.m.,
Friday 10 a.m. — 4 p.m., and Saturday 10 a.m. — 2 p.m. The business is proposed
to be closed on Sunday. Some business may occur outside of the listed business
hours if requested by potential auto buyers.
Two actions are required by the City to approve the requested changes by the
applicants:
1. Approve a Conditional Use Permit to Mr. Newcomb (Four Seasons Auto
Sales) in order to permit the outside display and sale of autos. Approval
may be subject to reasonable conditions determined by the City.
2. Amend the current Four Seasons Auto Conditional Use Permit, listing
conditions relating to the auto repair business and eliminating the
conditions relating to the auto sales portion of the business.

It is the policy of The City of Gem Lake that all identifiable costs associated with
Conditional Use Permits within the City shall be the sole responsibility of the owner of
said property. The costs shall include, but are not limited to the following: City
planning review costs (reports, meetings, site review); engineering review costs; legal
costs (preparation of hearing notices, legal research, certification costs); publication
costs (notice of hearing); reapportionment of assessments (engineers report); mailings
and Ownership Reports (ownershiplencumbrance).
Prior to the final approval by the City Council, all City expenses to date shall be paid by

I have reviewed the Agreement for Law Enforcement Services proposed by the Ramsey County
Sheriffs Department. It is identical to the agreements proposed to other municipalities served
by the Sheriff's Department. The agreement is consistent with past agreements between the City
and the Sheriff's Department, in terms of each parry's duties and responsibilities. I approve of
