Mayor Emeott, Councilors Rasmussen, Watson, Shilling, and Artig-Swomley were present. Also present was City Attorney Patrick Kelly. Other members of the public were also in attendance per the sign in sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES Minutes of City Council meeting of October 2007: Mayor Emeott called for additions, deletions or corrections to the October 2007 City Council meeting minutes. Motion by Hutch, Second by Artig-Swomley to approve October 16, 2007 meeting minutes as printed was unanimously approved. City Council Agenda for this meeting: Mayor Emeott called for additions, deletions or corrections to the City Council meeting agenda for November 20, 2007. Motion by Artig-Swomley, Second by Rasmussen to approve agenda as printed was unanimously approved. PUBLIC NOTICES Mayor Emeott noted that the time period for residents to request SAC charge credits to hook up their sewer has expired on Schuneman road. All of the Metro SAC credits available to the city have now been used up. PRESENTATIONS FROM THE FLOOR Mike Turnbull, White Bear Lake Fire Department, presented information regarding what happens when a fire call is made from within the City of Gem Lake. When a fire call goes out to 911, the fire chief or one of the four deputy chiefs goes directly to the fire to assess it. Currently Gem Lake has no fire hydrants. Because of this, the first truck on the scene would be Tanker #5 holding 1500 gallons of water. Mutual aid is called as needed upon assessment of the fire. A drop tank (modified wading pool) which holds 2000 gallons can be erected if needed to hold water. Trucks would dump water and then it is suctioned into the primary truck to fight the fire. Swimming pools or lakes are mostly not usable since the truck cannot get close enough to them to access the water without sinking and becoming useless. Response time to fires by the White Bear Fire department is approximately 5'/2 to 6 minutes on average. White Bear Lake has its own dispatch system and own volunteer ambulance service. Up to eight dispatch calls may go out to get an ambulance to the scene but it is the most cost effective program in the state and comparable in response time. The White Bear Lake dispatch received a FEMA grant to upgrade to 800 MHz radios for more ability to communicate to other cities. Ideally, the fire department would like to see one fire hydrant every 500 feet in residential areas and one to two per 500 feet in commercial. A fire hydrant has the capacity to provide 1000 gallons of water a minute which allows for a quick attack of the fire. AED are also recommended in every public building. Sprinkler systems can be found in both Tousley Ford and the Montessori school. As the city develops, it is recommended that fire hydrants be included. Residents are encouraged to call the fire department to request a fire inspection. They are happy to inspect fire places and make recommendations to home owners on how to prevent fires. Businesses are required in Gem Lake to have an annual fire inspection. Fire prevention is the key. Look for us on the World Wide Web at gemlakemn.org COMMITTEE REPORTS Planning Commission November meeting report (Jim Lindner): Jim Lindner presented the November planning commission meeting minutes to the council and summarized by stating that the Planning Commission recommended accepting the Putman Development Guidelines, but with the knowledge that more work is anticipated to be needed including new zoning ordinances. Mr. Lindner stated that the Barnett parcel was not considered in this plan although probably should be looked at. The commission considered the idea of a development moratorium, but was hesitant to recommend it to the council because of the negative connotation a moratorium might hold. Mr. Lindner stated that he didn't think any developers would be looking at this land now because of the economy. Several typos were found by Council Members. The approval of the minutes of the November Planning Commission meeting will be tabled until the December 2007 City Council meeting after typos have been corrected. Mr. Lindner suggested that a formal thank you be made to Tousley Ford for hosting the City of Gem Lake meetings for so many years. Building Committee (City Hall) report (Craig Rafferty): Mr. Rafferty reported that delays in connecting water and sewer under the railroad tracks have slowed progress. However, these connections are almost completed. Still need carpeting and tile. Also pipe work, electrical and lighting still left to do. Carpeting and tile work remain. OLD BUSINESS A) RFP (Request for Proposal) - City Audit process for next 4 years: Mayor Emeott reported that he and Councilor Schilling were meeting next week to review RFPs regarding an audit of the city financials. B) City MS4 report for 2006 (Watson): Councilor Watson reported that he has a first draft and needs to meet with Mayor Emeott to review it. NEW BUSINESS A) Approval of payment of claims for October -November 2007: Mayor Emeott referred the Council to the listing of payments requiring approval. Mayor Emeott noted that the payment to Leonard O'Brian was an attempt to request a withdrawal of the Rob Hanson appeal from the first detachment annexation case in 2006. Currently this has been put on hold and there has been no court date set. The council agreed that Attorney Kelly would call and check the status of this in attempts to move this to resolution. Mayor Emeott stated that a job description for City Clerk is currently being written. This would probably be a joint position with White Bear Township as they need additional help as well. Motion by Watson, Seconded by Rasmussen for approval of payment of claims for time period above was unanimously approved by voice vote. B) Acceptance of November 2007 Financial Report: The city finances are low right now until the second half of the tax payments are received in December. Mayor Emeott, Watson and the Gem Lake City Treasurer/White Bear Township Finance Director, Jessie Hart, will be meeting to go through the budget in anticipation of the December workshop. Motion by Schilling, Seconded by Artig-Swomley to accept the November 2007 Finance report was unanimously approved by voice vote. C) Acceptance of Putman Development Guidelines (Mark Putman): Mr. Putman reviewed his request for official acceptance of the Putman Development Guidelines for land areas in the Co Rd E, Highway 61 area as submitted to the council and approval of final payment for services and reports provided. He responded to questions regarding building use by indicating that building uses aren't pre -determined in the Guidelines, but suggested that current businesses such as Tousley Ford may wish to evolve into a more Village like feel and may even be better positioned in a different location in the long term. The Guidelines provides the city with a dynamic long term vision that it can use for developing a mixed -use zoning ordinance. Motion by Schilling, Seconded by Artig-Swomley for official acceptance of the Putman Development Guidelines. Discussion followed regarding whether a moratorium should be in place while the planning commission reviews the Report and completes the city's Comprehensive Plan. The city has the flexibility to allow a variance to the moratorium if a proposal was made that the council felt met all of the points outlined in the Putman Development Look for us on the World Wide Web at gemlakemn.org Guidelines. Mr. Lindner stated that while the Planning Commission recommended the acceptance of the Guidelines, they could not endorse its immediate implementation at this time because further work needs to be done to create new zoning ordinances. Councilor Rasmussen suggested the council accept the Guidelines and then move on to further discuss how to adopt these ideas into the city. Mr. Putman stated that using the Guidelines, the city does have a basis and criteria for a moratorium while these guidelines are put into zoning ordinances. Mr. Rafferty also suggested that a vote of confidence by accepting the Guidelines the city could accept the Guidelines and use it for the basis of planning and zoning and incorporation into the comprehensive plan. The motion to accept the Putman Development Guidelines in its current form was unanimously approved by voice vote. D) Building Moratorium for Development areas: Mayor Emeott reminded the council that currently, if someone came to the city with building plans for the four corners at Highway 61 and County Road E and met current zoning criteria, the city would have to issue a building permit regardless of the work that the city has done in long range planning. A 6-18 month building moratorium for this corner would allow the city to generate new zoning ordinances and rules for the area to be sure that the City's new ideas for development were incorporated. Six months would be the minimum recommended time and the city could choose to extend it if work was not complete. A variance clause can be added to the moratorium for builders that come right on target with the Putman Development Guidelines recommendations. The city could easily deny variances if they did not meet all of the requirements or were less than what the city council had envisioned. Discussion continued about the north east corner of Highway 61 and County Road E, which has not yet been reviewed. Mr. Putman suggested the council could also include a moratorium for building on adjacent land stating that development on this parcel requires mutually consistent implementation of the guidelines out outlined in the Putman Development Guidelines. Further discussion occurred about the fact that the Planning Commission will need help in writing zoning ordinances. Recommend continue work with Putman. Mr. Putman will put together a proposal regarding continued service to Gem Lake as describe in the Putman services brochure Option 9, Ordinance writing and consultation. Mr. Putman again stated that the 3-D visioning option might be a good option for the city to allow residents and land owners to really envision the recommendations of the Putman Development Guidelines. The review of this proposal will be included in the December City Council meeting. Discussion regarding the length of time the moratorium should be in effect. Various times periods were considered with a final determination that nine months seemed appropriate as this is also the time period until the due date of the City's comprehensive plan. Motion by Artig-Swomley, Seconded Schilling for a nine (9) month building moratorium on the land as described in the Putman Development Guidelines, and including the north east corner of Highway 61 and Co Road E. The final wording of the moratorium will be developed by Attorney Kelly. A voice vote by individual Council Member was requested by Mayor Emeott. The motion was unanimously approved with the following recorded votes: Councilor Artig-Swomley — Aye Councilor Schilling — Aye Mayor Emeott — Aye Councilor Watson — Aye Councilor Rasmussen — Aye E) New Building change order acceptance — Mayor Emeott reported that a rebate of $25,000 for the roofing system might not materialize because the truss company were delivered different than what was specified and the insulators could not get to the vaults of the roof to spray in insulation. So they had to use foam. There was much discussion about if this is the responsibility of the contactor, or the truss manufacturer. The good news is that the change has created a value added situation as the way the insulation is now installed; much higher R values have been obtained. It was decided that the City would wait until close out of the project and final payment to negotiate the details. F) Snow plowing contract for winter 07-08 (Schifsky and WBT quote): Mayor Emeott has obtained two bids for snow plowing for the current winter season of 2007-08. Motion by Schilling, Seconded Artig-Swomley for Look for us on the World Wide Web at gemlakemn.org approval of the Schifsky quote with a statement regarding responsibility to Schifsky for repairing curb damage caused by the plows was unanimously approved by voice vote. G) City Newsletter (Artig-Swomley): Councilor Artig-Swomley reported that the December City newsletter would include info about the progress of the new city hall, a spotlight on Cafe Cravings, info presented by Mike Turnbull regarding fire inspections, ordinances, storm water, a fact or fiction questions, progress on Comprehensive Plan, Profile on a Resident, and an explanation of the building moratorium. Mayor Emeott indicated that he received proposal from Town Life for 2008. It was decided not to continue publishing in this as it is not recognized as the city newsletter and the deadlines for submission are too far in advance. H) New building furniture: Mayor Emeott discussed several options for furniture for the new City Hall including option to use S&T furniture (about $100/chair) or Sam's Club. Mayor Emeott brought to the meeting a sample chair from Sam's Club as an option. Councilor Artig-Swomley agreed to help plan a grand opening of the new City Hall in conjunction with White Bear Township and to look further into other options for free of low cost furniture. I) New ordinances or revision to City Ordinance: New and revised city ordinances will be discussed at the January City Workshop to be held January 7`s. PRESENTATIONS FROM THE FLOOR None. Also during that meeting, several residents asked if the City Councii would consider extending the time period for residents to take advantage of this savings. Councilor Schilling made a motion that the waiver of both City and Metropolitan Council SAC charges be waived for two (2) construction seasons until 15 November 2007. The motion was seconded by Councilor Rosak and approved by a unanimous (5 Aye, 0 Nay, 0 Abstain) vote of the City Council. By this action, both the City SAC charge and the Metro SAC charge will be waived for all residents who convert their individual Septic Treatrnent Systems to municipal sanitary sewer according to the standards established by the Gem Lake inspectors. This action will save each resident who takes advantage of the offer S2,150 in 2005, $2,250 in 2006 and more in 2007 as Metro usually increases annually. To qualify, you must make a permit application and complete all necessary work on or before 16 November 2007. When your final inspection is filed by the City inspector, a SAC statement will be sent showing your charges paid. Commissioners Lindner and Derek Wippich were present. Also present were Bryan Hansen, Tom Hansen, Rob Hansen, Gretchen Artig Swomley, Jack Hoeschler, Bob Uzpen, Tom Rasmussen, and Paul Emeott. Comprehensive Plan/Marc Putman concepts We discussed Marc Putman's plan as it relates to potential density along the County Road E parcels of the Hansens. Given the current zoning for the Hansen parcels (LDB, R1), the Murphy parcel (R1), and Tousley Ford (GB), we talked about what types of development would be most marketable. We also talked about the Hoffman's Corners RB district. Tousley Ford and Hoffman's Corners are only half of the E-61 intersection so we also speculated about the Barnett parcel as a potential candidate for some type of redevelopment. The final quadrant of the intersection is in Vadnais Heights, so it makes sense to include them in any concepts we come up with for the Gem Lake portions of the area. There is a joint planning effort in place between Gem Lake and Vadnais Heights, though it is currently not active. We might approach VH and introduce Marc's concept plans them. We generally agreed that Tousley Ford will remain an automobile dealership for the foreseeable future, so we will consider what type of development would benefit from that type of anchor store. We believe any planning ought to reflect a transition from general business to residential as one progresses westward along County Road E. Given the current economy limiting the Tom Hansen parcel to strictly R1 residential development may prevent developers from coming forward with plans. Likewise, LDB may not be the best type of zoning for the Bryan Hansen parcel. We like the idea of mixed use zoning that gives a developer greater flexibility in coming up with development proposals. The same holds true for the RB section of Hoffman's Corners. Mixed use does not limit a developer to any one type of zoning. As a result, we recommend our 2008 comprehensive plan reflect a desire to get away from current zoning and emphasize mixed uses. This is consistent with Marc Putman's idea of "form -based" zoning, where the developer has a set of predetermined guidelines to pick and chose from. The more options he elects to implement, the more flexibility the city grants. We want to include Hoffman's Corners, Tousley Ford, the Murphy parcel, Bryan and Rob Hansen's R1/LDB, and Tom Hansen's R1 in a new planning area known as the Gem Lake Gateway District. It will encourage mixed use, open space, single family residential, retail and commercial uses, and business parks across the planning area as parcels become available for development. As a whole, we like the ideas presented by Marc Putman, but we are hesitant to formally adopt the plan as it now stands. One sticking point is Tousley Ford. Marc's plans are based largely on Tousley Ford not occupying its current location, something we do not Look for us on the World Wide Web at gemlakemn.org feel is consistent with a vision for the next ten years. Another Putman plan that is problematic is the use of roundabouts along County Road E, including a big roundabout at the E-61 intersection. Such a plan would impact Vadnais Heights and MnDOT, and likely should not be adopted until both of those entities are consulted and are in agreement with Marc's plan. Marc's plan does not include the Barnett parcel or the Vadnais Height corner of the E-61 intersection. Other parts of Marc's plan are very attractive and we believe are readily accomplished. Mixed use across the several Hansen parcels are one such attractive idea. Marc's density proposals reflect 3 units per acre as required by the Met Council and that will likely make Gem Lake's plan acceptable to Met Council reviewers. Development moratorium While we work to incorporate those portions of Marc's plan we agree with into the 20087 comprehensive plan, we are faced with realities that could result in further piecemeal development of Hoffinan's Corners, something that has been with the city since its inception. We talked over the merits and detriments of imposing a development moratorium to give the city time to decide how best to achieve the Gem Lake Gateway vision. In the end, however, we declined to recommend the City Council impose a moratorium as it invokes images of our past when we were seen as anti -development. Even a limited moratorium focused on Hoffinan's Corners exclusively was viewed as impractical. Given current market conditions, the Planning Commission believes we can achieve a Gateway vision and accommodate development without artifical restrictions like moratoriums. Putman plan acceptance Mayor Emeott informed the Planning Commission that there must be a Planning Commission recommendation to accept Marc Putman's plan so that his invoice can be paid. Upon a motion by Lindner seconded by Wippich, Marc's plan was recommended for acceptance but not for formal adoption into our current or future comprehensive plan. Commissioner Wippich reiterated his concerns that there needs to be a greater scope to the Putman plan (Barnett parcel and areas east of Schueneman Road). The motion was approved, 2-0. There being no further discussion of merit, the meeting adjourned at 8:52PM. Note: the December 4, 2007 Planning Commission will also be held at the White Bear Town Hall. PURPOSE. 1-1. The City of Gem Lake has authorized a land use planning study in the City of Gem Lake to review the impact of the current land use regulations upon public health, safety and welfare. 1-2. The objective of this study is to develop land use and zoning regulations that are consistent with livable neighborhoods and traffic safety, consistent with the "Gem Lake Gateway & Village Centers Vision Corridor (Highway 61 & Co. Rd. E), Transitional and Mixed -Use Guidelines," dated October 29, 2007, which the Council accepted as the guidance document for potential changes to the City's official land use controls on November 20, 2007. 1-3. There is a need for these studies to be conducted so that the City can consider adopting changes to the City's official land use controls. SECTION 2. MORATORIUM. 2-1. The City staff shall coordinate the study with the Planning Commission, consultants, property owners, interested citizens and the City Council. 2-2. Distribution Town Life is printed six times each year. It's working calendar and two -month coverage of community news and events gives it a longer "shelf -life" than other publications. The magazine is mailed to 12,500 upscale homes with another 600 copies sold via subscription and retail stores. Newsletter In 1999, White Bear Township asked me to create and include its White Bear Township Report within the magazine. In return I mailed a copy of every issue to all homeowners and businesses in the community. Last year the City of Gem Lake made the same request. And I have done the same for you.
