June meeting Of the City Council of the City of Gen Lake was calledto order on Monday,: 20 June 1994, at 7:00 p.m. in the first floor meeting roOml Of Tousley Ford. Mayor Emeott, Councilmember:s Nielsen., Igo, McPhillips and.Birkebak, Clerk Magnuson, Treasurer Nordstrom, Planning Commission Cha ff[uan David Gardner, and Zoning Administrator Jim Arend were present.. Also present were Joseph Franz, Lloyd Nielsen, Deb Oswald, Ray Taschin, Vince Johnson, Peter Oswald, Rob Hansen, and Dick Hansen. The minutes of the 16 May 1994 City Council Meeting were, upon, motion duly made and seconded, unanimously approved with amendments indicating Counci1member McPhillips and Nielsen as present. Mr. Gardner was then recognized. Minutes of the 31 May 1994 and 13 June 1994 meetings of the Gem Lake Planning Commission, attached hereto as Exhibits "A" and "B" were presented for discussion and action as follows: 1. At the recommendation of the Planning Commission and upon motion duly Made {McPhillips.} and seconded {Birkebak}, a SF.ecial. Use Permit was unanimously approved for construction of a twenty- four (24' f foot x thirty-two (32 `) foot .addition to the garage of Mr. & Mrs. Joseph Franz providing said addition is in accordance with the bu.il.ding code and with the condition that they maintain..a natural landscape screen on the west side of the building and Use the building for storag.e:.only. A copy of said Special Use Permit is attached hereto as Exhibit "Cu. Also included in the motion ap- proved was a Variance allowing six -hundred sixty-four (664 sf) square feet over the tine -thousand (1,:(70.0 sf) allowed. A copy of the Variance i.s attached hereto as Exhibit "D". 2. At the recommendation of. the Planning Commission and upon. motion duly made {McPhillips} and seconded {Birkebak}, a Variance was unanimously granted to Mr. & Mrs. Ronald Docken, said variance providing a six (6 0") foot variance to nine (9.' 0") feet from the Zoning Ordinance side yard setback requirement of fifteen (15'0") feet for :construction of a south facing attached garage. A copy of said Variance is attached hereto as Exhibit 3. Discussion then followed regarding filling activity at 3516 North Highway 61, 3524 Hoffman Road, 3538.Hoffman Road, and 3542 Hoffman Road. At therequest of Mayor Emeo:tt., Mr. Arend had inves- tigated the filling activity at:all addresses. Regarding the prop-- erty at 3516. North. Highway 61 owned by Peter and Deb Oswald, a Filling Permit was approved 17 May 1993 for this property, said Permit having expired on 17 May 1994.It was: then noted that fill- ing at the three Hoffman Road properties was initiated in the fall of 1993 without firstobtaining. permits. Mr. McPhillips asked the parties involved what the source of this significant amount of fill was.. Mr. Ray Taschin responded that itwas being delivered froth a f.ed.era:lly funded sewer renovation project near Grand and St. Clair Avenues in St... Paul. In as much as the materials are beingtaken from an urban site involving potential ground contamination from sewer systems, Mx'. McPhillips further:asked if any soil boring and testing have been completed on the fill insuring that contaminated fill is not being dumped in the City of Gem Lake where ground water contamination could pose a serious problem. No one present was 1 It was noted that no prosecution matters have been billed in two (2) months:.. The Council asked the Clerk to contact Mr. Meslow to deter- mine our status. The Clerk then: presented an estimate from T.A. Schifsky & Sons in the amount of $880 for repair of City streets, a copy of which is. at-. tached hereto as Exhibit "L".. The Council accepted: the .proposal and noted that the amount was within the Clerk's jurisdiction for ❑rdering said work done without Council action. The Clerk then presented a proposal from T.A. Schifsky & Sons Inc._ for Ongoing Maintenance of city streets, a copy of which is attached. hereto as Exhibit "M". Mr. McPhillips felt the proposal seemed reason- able and that an independent contractor would have excellent knowledge of said costs. Mr. Bernie Meier of Schifsky performs similar work for the city of Oakdale. The Clerk noted that he needs to determine if competitive bids are required due to the dollar amount of the contract Mayor Emeott then reported that M.r. Ecklund Will commence septic inspections as soon as he completes similar work in Dellwood. Upon motion duly made {McPhillips} and seconded {Birkebak}, the Clerk was empowered to execute and return the "FIRST AMENDMENT TO RAMSEY COUNTY HOUSING AND: REDEVELOPMENT AUTHORITY JOINT COOPERATION AGREEMENT", a copy of which is attached hereto as Exhibit "N". The Clerk then reported that a nuisance complaint against Allied Electrostatic has been filed by Rob Cory stating noxious fumes are bothering him. EPA states this is not a violation and referred the Matter to the City. No action hasbeen taken. Mayor Emeott then suggested. that he, Mr. Arend and Mr. Gardner tour the city to determine. possible Ordinance Violations and discuss sign inspections.. The Treasurer's Report, a copy of which is attached hereto...as Exhibit HO.", indicating:a balance in the General Fund of $6:07..07 and in the Sewer Fund of $34,260.65 was accepted. Payment of bills: totaling $5,08.7.71, a copy of which is attached hereto as Exhibit "P", wasunanimously approved. The Clerk then rioted the next council Meeting will be held on 18 July 1994. There being no further business, the meeting was adjourned by Mayor Etmeott at 8:58 pm. AUTHORED: 21 June 1994 APPROVED: 18 July 1994 Frederic C. Magnuson, City Clerk aware of any tests that had been performed. It was stated by one of the parties that Mr. Noble; Gem. Lake's former Zoning. Administrator had given verbal authorization for some filling, although no writ- ten record or knowledge:of said authorization was presented. Based upon the fact that the Oswald Filling Permit has expired; that no permits were applied for or issued, and that no information on the content of the fill has been presented, and upon motion duly Made {McPhillips} and seconded {Birkebak}, the Council voted unanimously to order all filling terminated until such a time as the` following are delivered to the Gem Lake Planning Commission: a) Correspon- dence from the legal jurisdiction(s) (eg city, town, etc.). from which the Materials used for filling were taken stating contents of the materials and listing any and all potential contaminants tothe satisfaction of the Gem. Lake Planning Commission and City Council, and; b) Correspondence from the contractor who removed the materi- als used for filling from the point(s) of origin stating the oxi-- gin (s) of the : materials , naming the Carrier(S) who removed said material's from the point (s} of origin, stating that only materials identified in a) above were delivered by the carrier (s) , and Stat- ing the quantity of materials removed from each of the paint(s) of origin, and; c) Correspondence from the carrier stating the date of first delivery to your site and the total quantity of materials delivered toyour site from each of the point(s) of origin of said materials. Upon receipt by the Planning Commission, said documents will be: reviewed and Applications For Filling Permits reviewed, includingpossible penalties for work performed without permits. Copies of letters sent to the parties are attached hereto as Exhib- its " F "G" and „g n D. Discussion then followed regarding the proposed Fontana Devel- opment in Vadnais Heights which includes a Target Store as anchor tenant. The position of the Planning Commission is stated clearly in minutes attached. After discussion and upon mo.t.ion duly made €Mc:Ph ]lips.} and seconded 4Birkebak},. Resolution No. 94fl.8, a copy of which is attached hereto with supporting information as Exhibit "I" was unanimously adopted.. E. Additionally, Vadnais. Heights development along County Road "E" and the I-35E Corridor Study were discussed with no action taken. Mr. McPhillips suggested that we contact neighboring cities and obtain copies of their long range community plans for review as each of the communities actions seem to affect Gem Lake. The. Recycling Report for May was then presented, a copy of which is attached hereto as Exhibit "J" Discussion then followed regarding. the Smart Cart use: and replace- ment of Traffic: Officer. A copy of the 19 May 1994 Minutes and 16 June 1994 agenda for the contract cities group are attached hereto as Exhibit "K" The Clerk then reported: that fire inspections should be started and that no reports have yet beet filed.
