Mayor Uzpen called the meeting to. order at 7:00. p.m. Councilmembers Bosak, Kuny and.Liindner were

Justin Gese.from S:E.H. presented a brief overview of the.project noting that the project is :a. two part
process, total estimates $460,0.00,. part 1- $290,000, .part 2 - $171;000. Estimated -assessments:— part. J.
- $8,600/acre, part 2 - $.10;000/acre. It was noted that the assessment would be spread out over a 10.
year period. Mayor Uzpen opened the public hearing at 7:.10 p,m. John Birkeland; White Bear Floral,
3550 Hoffman Roar! West, asked. what were:the properties in yellow?. Stated that estimated proposed
assessment w.as okay and that this project is needed and the value:will be really noted. starting now and
in the:future. No other public rna..de comments..Mayar Uzpen called the public hearing`to a close at 7:13
P.M.

AN ORDINANCE REGULATING THE DISCHARGE OFWEAPONS- AND HUNTING ON
PROPERTY LOCATED WITHIN THE -CITY OF GEM LAKE, MINNESOTA.
THE CiTY COUNCIL OF -THE CITY OF GEM .LAKE: ORDAINS:
Section 1. Intent and purpose. The CityCouncil intends to protect the pubtic safety -of its
citizecis by regulating the use and discharge.ofcertain weapons on real. property in the Cite oiQe.m
Lake,.as permitted -by Minnesota Statutes; § 471..633. The City Council re.cognizes.that $tatelaw
governs all other matters regarding firearms, including purchase, possession, andrights to carry.
The Council also intends that existing State law relating to the discharge ofbows and arrows -
in Minnesota Statutes, Chapter 9713, and. to .the purchase: possession, carrying or use of other
potentially dangerous weapons under Minnesota Statutes, § 609.66 and siniilar Jaws, be enforced
in the City.

Section 4. Exceptions. Dangerous weapons may be discharged orused in the CityonIyunder the

4:.1 Permits for Archery Deer Hunting. The City Council may issuepermits authbriziiig the
useofdischarge ofabowand arrowwithin t.heCity forpurposesofdeerhunting.. Said perm it
shall be issued onlyduringthe appropriate game season fordeer, Oros deer hwiting is otherwise
authorized by the State «f Minnesofa� Department ofNatural Riesources.

4.1.2 The property owner�xjmust apply for theperni it on a fonn approved bp*the City. The -
application must be accornpanied by a petition or other writing shoving the consent ofthe
owne rs ofall parcels adjacentto thepfoposed hunting property. The appl icant must subm i to

4:1:3 TheCity Council,in grantingtheper mit, shall establish boundaries forthe hunting
area. -on the property wbich.shall be sufficient to protect public safetybut.inno event lessthan
300 feet Erorn any home or 1000 feet from anyschool.`The City Council may further limit
hunting areas within the.specified. parcel of property, and attach other conditions to:the
hunting peiitiit.deemed necessary to protect thepublic safety and welfare.
4.1.4 A landowner obtaining a hunting permit is responsible for ensuring that tbetenns of
the pennit are observed. Ifa permit is approved by. the. City Council, the landowner in«st.post
a cash security of$50.0.00:before the permit~is issued: Iftheie is.a complaint orreport that
permit teens were violated during the hunt; the City Council shall hold a Bearing onthe
complaint and report, after givingthe affected owner at least fourteen (14) days' notice ofthe
heating: i f. rollowing the..bearing, thKity Counci [:concludes that: a permit violation did
occrir, the Council may require that sorneorall ofthecashsectn•ity be forfQited totheCity.in
.theCounciI's discretion .

pennits forali deertaken. All Stateand. Federal hunting. rules and regulations shall apply in

4.2 Target Archery. Aperson .mayuseabowandarrow-onprivateproperty,with.-pennission
:from*the owner, fortarget. archery. An ows used fortarget archery must have points that areno
wideethanthe. shaft ofthe arrow. and*not razor edged on any surface. Archersmust shootata.
target.:and targets must be mounted on material ofsufficientdepth and density to stop an arrow
fired from the bow used by the archer. Trm and other I ive plants are notconsidered suitable
backing material for mounting targets. The shooting area and the targets must be placed so that
there are no buildings; rights -of -way, orpiublic. lands within a reasonable distance behind the

4.3 Defense of Selfarid Property Against Vicious Animals. It is riot a violation of this

The tnaminium duration of a ]It111ting peen lit sliall be three weeks. A permit may
authorize the :discharge and use of weapons a. maximum of three days in any single
week. Other activities (such as setting up stands) mtiy 'take place on the days oil
which weapons discharge is not permitted.
Any person hunting.. -under a pem lit who is riot one -of the.-pertnit applicants must have
written permission to hunt signed by the property ovlei The hunter must have this
permission fonn and a copy of the. permit in their possession while huntin& under the
