MINUTES ❑F MEETING ❑F CITY COUNCIL <br />OF CITY OF GEM LAKE <br />The August meeting of the City Council of the City of Gem Lake was <br />calkedto order on Monday, 08 August 1994,..at 8.:58 p.m. in thefirst <br />floor meeting room of Tousley Ford. Mayor Emeott, Councilmembers Igo, <br />McPhillips, Nielsen and Birkebak, Clerk Magnuson, Zoning Administrator <br />Arend, City Attorney Newcome, and Planning Commission Chairman David <br />Gardner were present. Also present were Mr. John Birkeland, Mr. Ray <br />Waschin, Mr.Rob Hansen, Mr. & Mrs. Peter Oswald, Mr. & Mrs. Edgar A. <br />Johnson. <br />The minutes of the 18 July 1994 City Council Meeting were, upon <br />motion dulymade and seconded, unanimously approvedas amended.. <br />Discussion then followed regarding the recommendation of the Plan- <br />ning Commission that Special Use: Permits No. 9402 through 9405 be issued <br />to Birkeland, Hansen, Johnson and Oswald respectively. Upon motion duly <br />made (Nielsen) and seconded (Igo), Special Use Permits No. 9402 through <br />9405 were unanimously approved subject to: the following .conditions: <br />1) Issuance of all permits is contingent uponreceipt by the <br />City of an executed Indemnification Agreement holding the City <br />harmless for any and all claims resulting from filling and <br />grading; and <br />2 } Issuance of all permits is contingent upon payment by the <br />parties to the City of Gem Lake for all liabilities incurred <br />as a result of previous and future filling activities includ- <br />ing, but not limited to, engineers fees, attorneys: fees and <br />handling fees. <br />3) In as much as approval by the Board Of Managers ❑f the <br />Ramsey Washington Metro Watershed. District can not beobtained <br />until 14 September :1994, all permits are to be issued as 1) <br />Filling Permits and 2.). Grading Permits pending approval by <br />said Board. of Managers; and <br />4} Grading permits may notbe issued until the City receives <br />notice of approval from said Board of.Managers.; and <br />Copies of Permits are attached hereto as Exhibits "A" through "Dry _ Rela- <br />tiv..e to fines for filling without first obtaining pernuts, .Councilmember <br />McPhillips admonished the parties and waved penalties subject to future <br />compliance by the parties to all City of Gem Lake ordinances. <br />Additional items of the Planning Commission discussed with no <br />action taken were completion of Tousley landscaping, Continuing alter- <br />ati:ons by Tousley to: former Summit Farms metal building and lot areas, <br />current update of. I-3.5E Corridor Study, and status of citations/fines <br />issued against Mr. LeRoy Harwell of the Furniture Store at County Road <br />"E" and Hoffman Road. <br />Discussion of the need to clarify and update fines: and citation <br />procedures with the City Attorney and: City Prosecuting Attorney was then <br />discussed. The Clerk was then asked to contact the attorneys and discuss. <br />the matter. <br />Discussion of the Proposed 1995 Law Enforcement Budget was tabled <br />to September with concern over our participation in the DARE Program <br />when no schools are located in the City of Gem Lake. The Clerk was asked <br />to clarify and report in September. <br />1 <br />
