HomeMy WebLinkAbout1994 08-08 CC MinutesMINUTES ❑F MEETING ❑F CITY COUNCIL OF CITY OF GEM LAKE The August meeting of the City Council of the City of Gem Lake was calkedto order on Monday, 08 August 1994,..at 8.:58 p.m. in thefirst floor meeting room of Tousley Ford. Mayor Emeott, Councilmembers Igo, McPhillips, Nielsen and Birkebak, Clerk Magnuson, Zoning Administrator Arend, City Attorney Newcome, and Planning Commission Chairman David Gardner were present. Also present were Mr. John Birkeland, Mr. Ray Waschin, Mr.Rob Hansen, Mr. & Mrs. Peter Oswald, Mr. & Mrs. Edgar A. Johnson. The minutes of the 18 July 1994 City Council Meeting were, upon motion dulymade and seconded, unanimously approvedas amended.. Discussion then followed regarding the recommendation of the Plan- ning Commission that Special Use: Permits No. 9402 through 9405 be issued to Birkeland, Hansen, Johnson and Oswald respectively. Upon motion duly made (Nielsen) and seconded (Igo), Special Use Permits No. 9402 through 9405 were unanimously approved subject to: the following .conditions: 1) Issuance of all permits is contingent uponreceipt by the City of an executed Indemnification Agreement holding the City harmless for any and all claims resulting from filling and grading; and 2 } Issuance of all permits is contingent upon payment by the parties to the City of Gem Lake for all liabilities incurred as a result of previous and future filling activities includ- ing, but not limited to, engineers fees, attorneys: fees and handling fees. 3) In as much as approval by the Board Of Managers ❑f the Ramsey Washington Metro Watershed. District can not beobtained until 14 September :1994, all permits are to be issued as 1) Filling Permits and 2.). Grading Permits pending approval by said Board. of Managers; and 4} Grading permits may notbe issued until the City receives notice of approval from said Board of.Managers.; and Copies of Permits are attached hereto as Exhibits "A" through "Dry _ Rela- tiv..e to fines for filling without first obtaining pernuts, .Councilmember McPhillips admonished the parties and waved penalties subject to future compliance by the parties to all City of Gem Lake ordinances. Additional items of the Planning Commission discussed with no action taken were completion of Tousley landscaping, Continuing alter- ati:ons by Tousley to: former Summit Farms metal building and lot areas, current update of. I-3.5E Corridor Study, and status of citations/fines issued against Mr. LeRoy Harwell of the Furniture Store at County Road "E" and Hoffman Road. Discussion of the need to clarify and update fines: and citation procedures with the City Attorney and: City Prosecuting Attorney was then discussed. The Clerk was then asked to contact the attorneys and discuss. the matter. Discussion of the Proposed 1995 Law Enforcement Budget was tabled to September with concern over our participation in the DARE Program when no schools are located in the City of Gem Lake. The Clerk was asked to clarify and report in September. 1 Further discussion of ongoing maintenance proposal from T.A. Schif- sky was tabled to September. Resolution No. 94 - 09 was then adopted and is attached hereto as Exhibit t'E" . The July Recycling Report was then presented and is attached hereto as Exhibit."F" Affidavits For Candidacy were then distributed.to Mayor Emeott and Councilmembers Nielsen and Birkebak. The Treasurer`s Report, a copy of which is attached hereto as Exhibit "G", and. indicating a balance in the General Fund of $106,142.04 and in the Sewer Fund of $35,396.86 was unanimously approved,. Payment of bills, a copy of which is attached hereto as Exhibit totaling $.5,718,5.4 and purchase of a Parks & Playground Certificate Of .D.eposit in the amount of. $16, 9.57..00 was, upon` motion duly made and seconded, unanimously approved. The. next Meeting of the City Council will be in the first floor meeting room of Tousley Ford. There being no further business, the meeting was Emeott at 9:34 pm..
