The site is located in the Neighborhood Center Zoning District and was previously used by Sround Soundz. Mr. Padilla sells and installs auto accessories and performs minor auto repair. Mr. Padilla is the only person employed by the business. He operates a similar business on Buerkle Road, in the City of Vadnais Heights. He is looking to expand his business to the Gem Lake site. Section 9.6.5(A) of the Gem Lake Zoning Ordinance, Commercial, states in part: "Conditional uses of space assigned as "commercial" are: automotive repair and service (including gas stations); car wash; light industrial uses which manufacture, process, store and distribute foods and materials not likely to create offensive noise, odors, vibrations, dust smoke, heat, glare or other objectionable influences and are in general dependent upon raw materials refined elsewhere." Therefore a Conditional Use Permit must be approved prior to Mr. Padilla using the site for auto service. Approval of the permit may be subject to conditions established by the City of Gem Lake. The following members were present: Chairman Craig Rafferty, Planning Commission members Beth Herzog, Dan Marier and Derek Wippich. APPROVAL OF AGENDA AND MEETING MINUTES Planning Commission Agenda: Chairman Rafferty asked for any changes, deletions or added agenda items. None was given, so proceeded to move forward with the meeting. Planning Commission Minutes: Chairman Rafferty called to approve the December Planning Commission meeting minutes. The December Planning Commission minutes were discussed and upon motion by Commissioner Herzog and seconded by Commissioner Marier. The December minutes were approved. Ayes — 4, Nays — 0. OPEN FORUM Hansen West Property (West of Daniels Farm Road): Chairman Rafferty met with Tom Riedesel, Bill Short from White Bear Township and Eric Anderson from Ryan Companies who is the developer. Also present was Mike Brass and Louis DeMedici III who represents the assisted living project. Bill Short outlined the steps necessary to go through the process. Bill also stressed that the City of Gem Lake has no money in their budget for development. Chairman Rafferty invited the developers to the February City Council Workshop to ask any questions of the council in an informal setting. There were a number of items that were discussed in the meeting concerning the road and the set back but they were just ideas. It was also pointed out by the Planning Commission that there will be more police and ambulance calls and the developers will look into that and put together some numbers regarding their other developments sites. J Gem Lake Planning Commission Minutes Page 2 of 2 Another consideration is putting the two development projects together as one project versus two projects. The developers will consider the proposal. Chairman Rafferty stated that the developer was not overly encouraged, but not discouraged at this point and feels that this is a great location. It is possible that the Gem Lake project will be done first instead of the Vadnais Heights area. Again, it was stated that the developer would pay all costs. At this time, the City has no reserve to fall back on. Also discussed was abatements and if Gem Lake could offer incentives. GOALS FOR 2010 Comp Plan: Mayor Uzpen is currently working on the plan to obtain Metropolitan Council approval. Upon receiving approval, it is the desire of the City Council for the Planning Commission to work on updating the plan. Newsletter: Commissioner Marier commented that he has talked to a few residents and some concerns are the railroad tracks, which Mayor Uzpen stated that the County will not be fixing the railroad tracks, but the road will be fixed. Commissioner Marier felt that a corner of the newsletter would be a great spot to state questions and answers from the residents of Gem Lake. Walking/Hiking Trails: Chairman Rafferty asked the question on how Gem Lake could have walking/hiking trails that would be enclosed and still be safe. There are property line and road right -a -way issues but at this time, there is no plan in place. Tousley's Ford Lease: The lease agreement expires in 2010 with the option to buy the land the building is on and the City Council does not know the status of negotiations. The applicants for the Conditional Use Permit were Rick Wilson, who operates the auto repair portion of the business and Dennis —� Newcomb, who operates the auto sales portion of the business. The Council approved the Conditional Use Permit for a period of 12 months with follow-up by the City at the time of permit expiration. The Permit was approved on 9/15/09, and is subject to the following requirements: No autos shall be displayed for sale on the street The Permit is non-transferrable; There shall be no complaints during the 12 month period; 20 auto maximum for sale on the property; One auto per parking space; Business hours 6 a.m. — 10 p.m. — Monday — Saturday; and Auto drop off shall occur on the side of the building and not on street. Mr. Newcomb has submitted a Conditional Use Permit application which requests City approval to relocate the auto sales portion of the business to the southwest corner of Mr. Drummond's building. This portion of the building faces County Road E, and has a County Road E address. With the relocation of the sales office, the outdoor display area is also requested to be modified, Mr. Newcomb would like to display up to 10 vehicles in front of the building. Six spaces are proposed to be on the County Road E side of the building with 3 stalls facing the building, and 3 stalls facing County Road E. Four additional stalls are requested on the west side of the building, abutting Scheuneman Road. An additional 6 spaces are proposed on the north side of the building adjacent to the spaces currently identified for use by Four Seasons Auto. All vehicle parking is proposed in existing striped parking spaces. Mr. Newcomb's goal is to have 20-26 cars displayed for sale at any given time. The proposed hours of operation are: Monday - Thursday 10 a.m. - 6 p.m., Friday 10 a.m. - 4 p.m., and Saturday 10 a.m. - 2 p.m. The business is proposed to be closed on Sunday. Some business may occur outside of the listed business hours if requested by potential auto buyers. Two actions are required by the City to approve the requested changes by the applicants: 1. Approve a Conditional Use Permit to Mr. Newcomb (Four Seasons Auto Sales) in order to permit the outside display and sale of autos.
