MINUTES OF PUBLIC HEARING AND REGULAR MEETING
13 DECEMBER 1995
A Public Hearing was convened at 7:05 p.m. by Chairman Gardner on 13 December 1995 in
the first floor meeting room of Tousley Ford, 1493 East County Road E, Gem Lake, Ramsey County,
Minnesota 55110 as advertised on 29 November 1995 in the Legal Section of the White Bear Press,
the City's official publication. The purpose of the hearing was to receive public comment on a
properly filed application submitted by Robert J. Hansen to rezone property from R-1 Residential (3
acre) to R-4 Residential (24,000 sf.). Notice of this hearing and the legal description of the property
was duly mailed to a certified list of affected property owners and is attached to the permanent file.
In attendance were Mr. Gardner, Mr. Nielsen, Mr. Titcomb and Mr. Bemis. Also present were
Clerk Magnuson, Attorney Newcome, Barbara Bemis, Paul Emeott, Kevyn Burger, Bobby Yates,
Roland Birkebak, Rob Hansen, Clare Nielsen, Wally Hilke, Mike Gerner, Dan Kunin, Constance
Kunin, Brad Ward, Rodden Turner, Louis Turner, Howard Cammack and Chris Cammack..
Mr. Gardner announced that he is advised by the Hansen family that their Application For
Rezoning has been withdrawn. At Mr. Gardner's request, Mr. Hansen confirmed withdrawal. Mr.
Bemis then asked Hansen if and when he thought he may resubmit said application to which Hansen
offered no response at this time. Mr. Gardner then asked Mr. Newcome for a ruling as to when Mr.
Hansen may resubmit said application whereupon Mr. Newcome indicated he would research said
matter and advise.
Mr. Hansen then indicated that a request for the city to enter into a joint powers agreement
with Vadnais Heights to provide utilities for his property would be forthcoming.
Regarding the matter of an extension of Variance No. 95-01 issued to Mike Gerner and due
to expire on 22 January 1995, upon motion duly made (Mr. Titcomb) and seconded (Mr. Nielsen),
it was unanimously recommended that the City Council extend Mr. Gerner's variance through 22 July
1996.
Regarding the matter of signage for Tousley Sports Center, Mr. Gardner reported that he, Mr.
Titcomb and Mayor Emeott had met with Tousley representatives to discuss their proposal and
indicated that a substantially revised proposal with a significant reduction in square footage of signage
needs to be developed and resubmitted. The matter was tabled pending Tousley's resubmittal.
Discussion of the concept of "principal entrance" followed with the conclusion that a business may
have only one (1) principal entrance.
Regarding the Birkeland sign violation along Highway 61, the consensus recommendation of
the Commission is that Mr. Birkeland be allowed to leave the sign in question in place until after 25
December 1995 at which time he shall remove the current sign which violates the variance granted
and return to the forty (40 sf.) square feet allowed. Failure so to do will result in revocation of the
original variance.
Regarding the matter of Brian Hansen's storage of Boyer used cars on Scheuneman Road,
Mr. Gardner reported on pending settlement offer forwarded By Meslow to Hansen which includes:
proper application for a Special Use Permit; 2) Hansen's agreement to pay for bi-annual inspections
at a cost not to exceed $200 each inspection; 3) Hansen's agreement to terminate "open sales lot"

activities and acknowledgement of same as a violation; 4) the city's right to spot inspect at any time;
5) Hansen's agreement to restore proper fencing and security measures including, but not limited to,
motion detectors with flood lights and alarms; 6) Hansen's agreement that any storage of "junk",
unlicensed, inoperable, or otherwise objectionable vehicles represents a violation of the Special Use
Permit; and 7) an understanding that Hansen be provided fourteen (14) days to resolve any violation
by Boyer and that failure to resolve said violation or any second violation would result in revocation
of the Special Use Permit. Upon receipt of the aforementioned application and attachments, the
Commission agreed to hear the matter.
Regarding the matter of Filling Permits issued to Hansen, Birkeland, Oswald, and Anderson
(now Birkeland), Mr. Hansen responded that he did not know if work to be completed by 19 October
1995 was completed. Mr. Magnuson advised that RWMWD had a strong interest in the project and
had agreed to monitor same. Magnuson indicated he will file a report to the Planning Commission
after inquiry to RWMVVD.
Regarding the matter of Vadnais Heights request that the traffic controls at the intersection
of LaBore Road and County Road E be studied and a proposal be prepared by SEH at a cost in
excess of $4,000 in which Gem Lake would participate at 50%, Mr. Magnuson reported that he had
discussed the matter with the City Council, that Mayor Emeott has tendered a letter to Mayor Haider
regarding and generally opposing the matter, and that Mr. Magnuson had discussed the matter with
Vadnais Heights this day indicating: 1) an isolated study of the problem vs. a complete study of the
County E/LaBore corridor was unacceptable; 2) the I-35E Corridor Study should be addressing the
matter as part of it's work; 3) only one of four corners (25%) are in Gem Lake, hence participation
at 50% is unacceptable. The matter was tabled. Mr. Gardner noted the changes on Lexington
Parkway in St. Paul and indicated that similar conceptual work would be appropriate along County
E and that the city should take a proactive approach to forming a small group to work on same.
Premiminary results of the Community Survey were then discussed. Mr. Magnuson indicated
final results will be available shortly and will be distributed, including Mr. Bromander at SEH. Mr.
Magnuson also invited the Planning Commission along with the City Council to continue the effort
by developing a similar effort targeted at Gem Lake business response.
There being no further business, the Public Hearing and meeting of the Planning
Commission was adjourned at 8:05 p.m.
