MINNESOTA 55110 November 10, 1993 Mr. Paul Emeott 3960 Scheuneman Road Gem Lake, MN 55110 Dear Paul: The Gem Lake Planning Commission met on Monday, November 8, 1993 at 7:30 P.M. in the Tousley Ford conference room. Present were Gardner, Leider, Nielsen, Bemis, Noble and Emeott. Ken Lorenz, 1299 Goose Lake Road, has requested a special use permit to expand an outbuilding beyond the limit of our ordinance. Several of his neighbors were in attendance: S. Quam, Rick & Nancy Bosak, Tom & Lenore Bolfing. Discussion centered on the use for the building (which Lorenz assures us is for personal storage), the possibility of his disturbing his neighbors while working on his vehicles, and the setback from the property line. As the addition is already complete, and the code does allow for a minimal setback on remote outbuildings, the location was deemed acceptable. The Commission unanimously recommends that the City Council grant Mr. Lorenz a special use permit to exceed the outbuilding limitation of the R-2 District by 880 square feet (i.e., a building of 1,880 sq ft), provided: 1. That all construction meets code requirements, 2. That there be no commercial use of the property, 3. That noise be kept to a minimum, and particularly between 10 PM -and 7 AM, 4. That he secure building permits on his deck construction and the remodeling of the existing building, and 5. That he pay double the fees required on work initiated prior to permitting. Ron Glassman represented Tousley Ford's request for a building permit to relocate the old Fastbank structure to the new sales lot as an information building. Once again, the work was already complete, and the permit request after -the -fact. Discussion centered on the revised landscape plan for the remodeled pole barn, which had not been submitted. Mr. Glassman provided a suggested plan, and, after considerable discussion agreed to "work out the details" to our mutual satisfaction. On this basis, the Commission voted in favor, with one abstention, of recommending the City Council grant the building permit required to relocate the portable bank building (8' X 161) to the site directly behind (North) the large elm tree in the new sales lot on County Road E, to be used as a customer information booth, and landscaped according to the plan submitted. Dick & Helen Lindholm (The Trike Shop) and Richard Priestley (Rick's Auto Body) requested a variance to allow them to locate a new sign on the corner of their property (3744-48 Scheuneman Rd). Mr. Noble testified that their neighbor Gary Nelson has no objection. The Commission voted unanimously to recommend the City Council grant The Trike Shop and Rick's Auto Body an 18 1/2 foot variance from the setback requirement of the zoning ordinance to allow an 8' X 8' illuminated sign (shared 50/50) to be located at the property line, due to the exceptional nature of the lot and its proximity to Highway 61, and on the condition that this is the only sign allowed these businesses other than a single directional sign to distinguish driveways. The meeting adjourned at 10:00 PM. Hiniker Vice President - General Counsel October 25, 1993 Mr. David Gardner 1399 East County Road E Gem Lake, MN 55110 Dear David: For your information I am enclosing a copy of a Permit Application that I am going to file with Bob Noble to relocate the former Fast Bank building to a site immediately behind the elm in the center of the property. This will remain a portable building and we propose to anchor it in a manner acceptable to Bob. The only utilities running to the building will be electricity and telephone. The building itself was constructed for the First Bank System as a portable Fast Bank. It's designed in such a manner that it can be relocated from site to site by merely lifting it up from cable connections on the top. This gives you an idea of how stable and substantial this building is. The object is to provide a central area for information to Tousley customers as they enter the site and as they walk through the car displays located in that portion of the property. When I talked with Bob Noble he conversed with the Mayor and the Mayor asked that the matter be scheduled to appear before the planning commission at their regular meeting on November Sth. Since I will be out of town at that time Ron Glassman will be making the appearance. I am also enclosing a copy of the landscaping for that site. In light of our prior conversation Ron will also have a landscaping plan for in front of the addition to the pole barn. As to the addition on the building, Morton Construction says they will be in here early the week of October 26th to pour the footings. Then the mechanical contractors will be in with plumbing and heating for the central portion and Morton will be back on site the October 25, 1993 Mr. David Gardner Page 2 week of November 8th to actually complete the construction of the building. Both Tom and I had an opportunity to discuss the plans with Judsin and at his suggestion we did make one minor alteration and changed it from one cupola to two cupolas, one on each end of the building. I did want you to know that at the time you are conducting your meeting Elizabeth and I will be basking in the sun in sunny New Zealand. In anticipation of your visiting there later we'll be sure to try and gather some information and we are going to be obviously taking many pictures and if you are interested we will bore you with them.
