ADJOURNMENT: Emeott at p.m. NOTES. on 17 October 2 CITY OF GEM LAKE RESOLUTION NO. .94-1.3 .1:9 September .1994 WHEREAS, the City of Gem Lake contracts with the Ramsey County Sheriff's Department for Law Enforcement Services in the City; and. WHEREAS, Ramsey County has requested an amend -rent to said contract allowing- the purchase of alternative insurance for the contract cities through the Minnesota County Insurance Trust via a Joint Powers Agreement with a term of three (3) years; and WHEREAS, said amendment will significantly reduce insurance costs for law enforcement provided to the contract cities; and WHEREAS said reduction in costs is consistent with the City of Gem Lake guidelines for providing all government services to the Community at the lowest possible cost and, therefore, is in the. best interest of the business and residential citizens of Gem Lake; and WHEREAS, the City Council did on 08 August 1994 adopt Resolution No. 94-09 providing for an execution of an Amendment To Contract o.n behalf of the Citizens of Gem Lake allowing Ramsey County on behalf of Gem Lake to enter into a Joint Powers Agreement with the Minnesota County Insurance Trust. Enclosed is a copy of the resolution along with a signed copy of the amendment to your contract with Ramsey County. We have bound coverage with MCIT effective 9/21/94. The policy will be issued on a short term basis to expire on 1/1/95. The renewal policy will show a slight increase in premium to $117,205. This still shows a significant reduction in premium over the current pro- gram. I would like to thank all the cities for their cooperation in securing this insurance program for the Contracted Cities pro- gram. Paragraph 11.5. is amended to read as follows: 5. The COUNTY agrees to maintain, during the term of this. Agreement, automobile, general liability, workers' compensation, and professional liability insurance in amounts deemed appropriate by the COUNTY through its Risk Manager. The COUNTY shall name the MUNICIPALITY as an additional insured on these policies except for the workers' compensa- tion policy. The MUNICIPALITY agrees to pay, as a part of the actual cost as provided in Section IV below, a pro rata share of insurance costs. These costs shall include the costs for any assessments and credits for any dividends by participating in any insurance pools or trusts. The COUNTY may elect to self -insure all or any portion of these risks. If the COUNTY cannot obtain insurance and/or elects to self -insure, the MUNICIPALITY shall pay a pro rata share of the costs of self- insurance. Insurance costs as they relate to insurance coverage shall include premiums and deductibles. Costs of self-insurance shall in- clude reserves, claims and damage payments, and administration costs required to maintain self- insurance. 2. Paragraph II.6. is added to read as follows:. 6. The MUNICIPALITY acknowledges that the COUNTY may, in an effort to provide the best insurance cover- age at the most economical cost, become a member of the Minnesota COUNTY Insurance Trust or some similar organization; and the MUNICIPALITY further. acknowledges that membership in such an organiza- tion may be for a fixed minimum term and may expose the COUNTY to some type of contingent cost liability, such as debts, obligations and.liabili- ties, in the event that the COUNTY withdraws its membership. The MUNICIPALITY agrees to reimburse the COUNTY for the MUNICIPALITY's pro rata share of any such contingent cost liability arising during the term of this Law Enforcement Service Contract and assessed against the COUNTY. Upon notification to the COUNTY of any such contingent cost liability, the COUNTY will notify the MUNICI- PALITY in a timely manner. 3. FAX 429-5034 GEM LAKE PLANNING COMMISSION MEETING THURSDAY,SEPTEMBER 15, 1994 7:3.0 PM TOUSLEY FORD CONFERENCE ROOM This will be a brief meeting to review the landscaping plan for Tousley Ford's addition (pole barn, being renovated to accomodate an expanded parts department). I would encourage each of you to visit the site. The history of this building is a tender subject and our primary objective in the landscaping is to break up the mass of steel presented to County Road E. When we last visited this subject, Tousley was uncertain of the building's use, and asked that we postpone the landscape plan until that use was decided. Indeed, they have altered their plans somewhat, and the proposed use is more retail in nature. The interior of the building is being substantially redesigned, for which building permits are being held pending our satisfaction on the landscaping issue. Theme will be two entrances, one retail and one wholesale, requiring handicap access; other than that, the exterior of the building will not be changed significantly. There will be some signage required, and Jim Arend will have inventoried the property for that purpose. Chief Forester Leider and.I will have negotiated an arrange- ment with Tousley prior to the meeting (we hope!). Please let ripe know if you are not able to attend. All storm sewer catch basins not needed for site drainage during construction shall be covered to prevent runoff from entering the storm sewer system. Catch basins necessary for site drainage during construction shall be surrounded by silt fence or double ring of staked hay bales backed by snow fence. The fence or bales shall be installed and main- tained around all catch basins until the tributary areas are restored. 11. All storm sewers discharging into wetlands or water bodies shall outlet at or below the normal water level of the re- spective wetland or water body or at an elevation where the downstream slope is 1 percent or flatter. The normal wa- ter level shall be the invert elevation of the outlet for the wetland or water body as approved by the District. 16. Low floor elevations of homes or buildings adjacent to wetlands or water bodies shall be a minimum of two (2) feet above the critical 100 year flood elevation for the respective wetland or water body as approved by the District. 17. The toe of the silt fence shall be trenched in a minimum at 6 inches. The trench backfill shall be compacted with a vi- bratory plate compactor. 18. Upon completion of the project and stabilization of all graded areas. all temporary erosion control facilities (silt fences, hay bales, etc.) shall be removed from the site. 19. SECOND QUARTER 1994 CRIME REPORTS. Lt. Dornbusch presented the second quarter comparative crime statistics and a report on the calls for service compared to the service cases actually investigated. He noted that a recent Supreme Court decision has made it mandatory to record all interviews when Miranda is involved. BOARD OF GOVERNMENT INNOVATION & COOPERATION .GRANT Lt. Mike Shanley and Gary Koliman, Communications Supervisor, Ramsey County Sheriff's Department, explained three types of grants currently available through the State of Minnesota (Serv- ice Budget Management, Cooperative Planning & Service Sharing) Lt. Shanley felt the Service Sharing Grant would be most appro- priate for the Group. He explained that it is a cooperative type of grant where two or more partners come together to share a service. The grant, up to $100,000, can be used for start-up costs and equipment only. None of the grant monies can be used to fund wages or recurring costs. The Community Service Officer concept was discussed for possible grant funding. Bergeron noted that cars, radio & emergency equipment, phones, pagers, uniforms and training could be funded through the grant. Discussion concerning a temporary vs. annual CSO position followed. Bergeron explained the benefits of the position, noting that a CSO could take routine or low priority calls, which would result in freeing up the current officer's time. Shanley explained that the pre -application can be very general, and would not require a commitment. Pre -application deadline is August 23, 1994. If 1 Sheriff Contract Group Minutes. July 21, 1994 approved, then a commitment from the Group would be necessary. Short moved to request the Ramsey County Sheriff's Department to prepare a pre -application for a grant to fund the start-up and equipment costs for a temporary / full-time CSO Program for 19.95. Urban seconded., Ayes all MINNESOTA COUNTIES INSURANCE TRUST THREE-YEAR ISSUE Schwerm explained that Shoreview's City Attorney has expressed concern with regard to the proposed amendment to the Law Enforcement Service Contract, in that it would expose the City to. joint and several liability and would seem to automatically extend the Law Enforcement Service Contract for a three-year term. He has proposed language to satisfy this concern. Georgie Schulte, Ramsey County Risk Management, stated that she has presented the language to the County Attorney. It is tentatively scheduled for County Board Finance Committee review on August 9th. She will fax each Community theamendment when available. Everyone was urged to process the amendment. as soon as possible. 1995 BUDGET The Traffic Car Summary Report shows that the Group is getting less revenue than originally projected ($28.000 collected totally - traffic deputy cost approx. $70,000). The Group discussed the traffic deputy's hours and felt they would like to see him service both the am / pan rush hours. The consensus of the Group was to retain the Traffic Deputy for one additional year. It was noted that the proposed budget did not reflect the insurance savings. Dornbusch will make the revisions and mail to each community. Urban moved. to recommend adoption of the 1995 .budget with the insurance adjustments, and the addition ❑f one patrol deputy•as previously agreed upon. Short seconded. Ayes .all. FORMAL CONTRACT DOCUMENT Bergeron asked the Group if the current document was if they wished t❑ make revisions. A longer term (3 year) was discussed. Each community agreed to document and provide comment at next month's meeting. ❑THER DISCUSSION The Group talked about strategic planning. AN/NMI CONTROL SERVICES, INC. Rick Ruzicka, President, ACSI, stated that he will begin call out service on October lst, and patrol service on Monday, October 3► 1994. He requested permission to link into the Sheriff's radio frequency. Commander Bergeron directed him to contact Gary Kollman, Communications Supervisor, to work out the details. Mr. Ruzicka requested that each community provide current licensing information, including dog tag numbers, owners and addresses, and that this list be updated quarterly. The Group asked Mr. Ruaicka to submit written details with regard to his operation, including kennel hours and the procedure to handle calls for service. It was suggested that the communities prepare press releases upon receipt of this information. CONTRACT REVISIONS - INSURANCE Georgie Schulte, Ramsey County Risk management, explained that the County has requested that each community adopt a uniform amendment to the Law Enforcement Services Agreement. She also noted that Paragraph 11.6 needs revision. The Group agreed to adopt the uniform arr:endrnent, as presented, with the following changes: page one, paragraph Ti.;5last line - strike the word "if"; page two, strike the entire first line, and part on the second line, adding '"incurred during the tern of this Law Enforcement Services Contract, and assessed against the County". 1 SEP-12-94 MON 15:16 CITY OF LITTLE CANAL I FAX NO, 484 4538 PA4 Sheriff Contract Group Minutes August 1S, 1994 Ms. Schulte will prepare and fax the revised amendment to each community. She requested that the executed documents be provided to her as soon as possible, as she will present them to the County Board. on September 13th. CONTRACT REVISIONS The Group discussed the idea of extending the length of the contract to three years. Shoreview intends to request their Attorney to review the contract and suggest options / modifications. Hopefully, these suggestions will be available for review at September/s meeting. NEISANCU ORDINANCE Commander Bergeron requested that this item be tabled until next month. SMART VM UPDATE Commander Bergeron reported that the SMART Unit is being used almost every day. Lt. Shanley noted that there had been a period of approximately 5 weeks that it was not in service, The Group requested that a quarterly log sheet be provided to them, including the street, community, date, and if possible, an indication if it was requested by a particular community. It is their desire that the Unit be used on a regular basis. OTHER MASERS Commander Bergeron reported that the City of Centerville has requested a proposal far police services. The Group agreed that the request for proposal should be declined due to logistical concerns. Lt. Shanley requested clarification with regard to the Government Innovation & Cooperation Grant. The Group directed him to Complete the pre -application for a Community Service Officer Position - 182 days, B hours / day, (1:00 p.m. - 9:00 p.m.), a smaller type vehicle, 10-speed bicycles, radio equipment, uniforms and training. The correct speed limit is posted and you realize you are going five miles over the legal limit. You slow down and look around. You have just been recorded by the new SMART Unit of the Ramsey County Sheriffs Patrol. Today you were lucky, this was only a warning. The SMART Unit, or Speed Monitoring Awareness Radar Trailer was purchased this past year by the cities which contract for Sheriffs patrol services with Ramsey County. These include: Arden Hills, Gem Lake, Little Canada, North Oaks, Shoreview, Vadnais Heights and White Bear Township. This self-contained unit is generally parked in a problem area, where accidents are up or complaints are called in by residents. It monitors all cars passing on the same side of the street as the unit and informs motorists immediately of their speed. The unit stores this information and a print out can provide officials with car counts and average speeds. This information is helpful when planning road expansion or knowing where more traffic control is needed. "Most people tend to stretch the speed limit by five miles -per -hour and feel safe, says Ramsey County's Lt. Mike Shanley, who is in charge of the uniform patrol. "All you have to do is look around you on your way to work to realize that most people are in violation of the speed limit. The only perfect solution for traffic problems is to have more officers on the roads. Taxes would go up, but accidents would go down." Shanley's concern is that the habit of speeding on the freeways is carried over to county roads and main streets. Now you add intersections, and accidents happen. There's is a hope that this new SMART Unit will slow drivers down. Everyone looks for a cushion in the speed limit, but sometimes a reminder is helpful when a road is traveled. OVER. One patrol car in particular is dedicated to speed control and tickets an average of 15 speeders per day. The average speeding ticket costs between $60 and $70, and can be even higher if the vehicle is clocked going more than 16 miles over the speed limit. "Some residents call and complain that traffic is moving too fast through residential areas, but the standard speed limit is 30 miles -per -hour, and through a neighborhood that is fast," he says. The SMART Unit is helpful in monitoring the speed of traffic through neighborhoods to determine if problems exist. "Our new radar systems have ways to circumvent the radar detectors or "fuzz busters" that some drivers invest in," says Shanley. "The only sure way to keep from getting a speeding ticket is to drive the speed limit." As a result of the Metropolitan Reorganization Act passed by the 1994 Minnesota Legislature, the Metropolitan Waste Control Commission (MWCC) on July 1, 1994, became an operating function of the Metropolitan Council. We are now known as Metropolitan Council Wastewater Services (MOWS). The legislation eliminated the MWCC Board of Commissioners and we are now governed by the Metropolitan Council. The Metropolitan Transit Commission (MTC) also merged with the Metropolitan Council on July 1, and the merger with the Regional Transit Board (RTB) will occur this October 1. The reorganization will bring the planning and operation of regional services closer together, and provide greater opportunities to improve services and make them more cost-effective. Our goal is to carry out a smooth transition with no disruption in our service to the communities. Regarding the cost allocation system, you should know that it will be fundamentally the same in 1995 as in prior years, with one difference. The MWCC Board of Commissioners decided to fix the percentage of the debt service paid by SAC for the years 1994 and 1995 only. The MWCC Board's action was in direct response to community concerns raised in our pre -budget surveys, indicating a desire for fewer "spikes" in rates. As a result, the revenue will be fixed based on the engineering estimate completed as part of the budget process, and no adjustment for actual flow for SAC revenue will be made at the end of the year. However, there will still be year-end adjustments for other factors, as in past years. The annual charges are proportioned according to flow volume: your community's flow volume relative to the total flow volume in the Metropolitan Disposal System. The proportion is based on estimates. When 1995 is completed and the actual flows are known, the estimated sewer service charges are adjusted to reflect the actuals. Also, the 1995 sewer service charges are based on budgeted revenues and expenditures. At year end they are adjusted for variances from budget. The 1995 estimate of your community's flow is based on records of past flows, precipitation trends and anticipated community growth. The statement also shows any credits or debits from these sources: Current Value Credit, Debt Payment Credit and the 1993 final cost allocation. Enclosed for your information is a copy of the four turnback options proposed by the County to accomplish the roadway jurisdiction transfers recommended by the Ramsey County Local Government Services Study Commission in its 1992 report on Functional Consolidation. Also enclosed is a turnback list prepared by Ramsey County showing the funding alternatives of the various turnback options for each local unit of government. Ramsey County is asking each local unit of government to select a funding alternative for each turnback route and to select a year, within the next ten years, for the improvement to occur. The County has scheduled a meeting for THURSDAY, SEPTEMBER 22, 1994, 10:00 A.M., ROSEVILLE CITY HALL, to meet with the local units of government and develop a ten year schedule of all the County/Local turnbacks. Based on the information gathered during the EAW process and the comments received on the EAW, the. City Council on September 6, 1994 adopted a resolution determining that no environmental impact statement is .re ;uired pertaining to the Fontana Square Retail Development. The City Council also adopted the attached findings of facts in support of such determination. The City's decision has been provided to all persons on the EAW distribution list pursuant to part 4410.1500, and to all persons that commented in writing during the 30 day review period. PERTAINING TO THE FONTANA SQUARE RETAIL DEVELOPMENT AND ADOPTING FINDINGS OF FACT IN. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL ❑F THE CITY OF VADNAIS HEIGHTS: The City Council now makes the following: FINDINGS .OF FACT 1. Ecologically Sensitive Resources: a. The site was evaluated for habitat suitability for Blandings Turtles and White False Indigo. Neither Blandings Turtles nor White False Indigo were observed on the site. Suitable aquatic conditions are not present for Blandings Turtles and the site has very low potential for their presence. The site has had substantial prior disturbance for area plant communities and has very low potential for presence of White False Indigo. b. "Ecologically Sensitive Resources" are not known to be present on the site. The wetland areas are presently highly degraded and dominated by invasive exotic plant. species. The upland areas are now significantly degraded, reducing their value for wildlife and sensitive rare species. 2. Ground Water and Storm Water Concerns: The increase in impervious area (due to buildings and parking lot of the proposed project) will .have, at most, a negligible effect on ground water levels, ground water flow directions and yield of residential wells. All storm water runoff will, be managed in accordance with the City's Surface Water. Management. plan, as approved by the Vadnais Lake Water Management Organization. 3. Air Quality: 2 a. Noise analysis showed that none of the increased noise levels that are predicted with the proposed project will be more than 3dHA. The highest level increase between the conditions when the project is completed and present conditions is 1.4 dBA. Noise levels up to 3dBA are ordinarily not perceptible to the human ear and are therefore insignificant. b. No air quality violations of any kind will occur with implementation of the project as designed. 4. Traffic: a. With mitigation at Centerville Road and County Road E, as described by Short -Elliott -Hendrickson :i n the EAW and the responses to comments, the combination of 1996 background traffic, Wa1-Mart generated traffic, and traffic generated by the proposed project can be accommodated at level of service C during p.m. peak hour from Centerville Road to the east ramp of interstate 35E. Level of service C is an acceptable handling of traffic in urban areas according to transportation industry standards. 5. Lighting: All light standards along the west and north sides of structures will be 20 feet in height and designed with house shields to project light towards project structures. Light contours demonstrate that illumination will be one-half foot candle or less at locations within 5 to 7 feet of the west access curb lines, which is within code standards. 5. The project is compatible with the City's comprehensive land use plan. 7. T_he proposed project is described and expected to meet applicable local and state requirements, standards and guidelines for the type of commercial improvements as proposed. Areas which have a potential for producing significant environmental effects have been identified and addressed. 8. The proposed project does not have the potential for significant environmental effects and no environmental impact statement is required. 9.. Pursuant to Minnesota Rule part 4410.1700., the City administrator is ordered to maintain in a separate file the EAW, specific responses to all substantive and timely comments on the EAW, and: all documents and memoranda received by the City and pertaining to the EAW process.
