CITY OF GEM LAKE MINUTES OF CITY COUNCIL MEETING FEBRUARY, 2005 The February, 2005 regular meeting of the City Council of the City of Gem Lake was called to order by Mayor Emeott on Monday, 28 February 2005, at 7:15 PM in the first floor meeting room of Tousley Ford following the Annual NPDES Public Meeting. Mayor Emeott, Councilors Bosak, Schilling, Rasmussen and Watson, and Clerk Magnuson were present. Also present were Vern Grundhoffer, Helen Kahl, Wendy Turnbull, Barbara Kearns of Willow Lane School and Randy Ostebo of People's Plumbing. Clerk Magnuson noted that the change of meeting from 21 February 2005 to 28 February 2005 was duly published in the 16 February 2005 edition of the Legal Notices Section of the White Bear Press. Following Mayor Emeott's request for additions, deletions, or corrections, the following actions were taken: 1) unanimous approval of the Minutes of the 24 January 2005 City Council meeting as presented on Motion by Bosak, Second by Rasmussen; 2) unanimous approval of the City Council Meeting Agenda as presented for 28 February 2005 on Motion by Watson, Second by Bosak. Mr. Lindner then presented the report of the Planning Commission meeting convened on 01 February 2005. Public Hearings were held coincidental to the meeting on Variance No. 2005-01 for Turnbull and Variance No. 2005-02 for People's Plumbing. Following the public hearings, the variances were discussed and recommendations to approve both were prepared and are included in the body of the minutes. Additional time was spent discussing possible changes to Ordinance No. 43 that could be done coincidentally in April. Following discussion and upon motion by Schilling and second by Watson, Variance No. 2005-01 for Turnbull was unanimously approved with the codicil that a berm of not less than 4' - 6' in height be established along the eastern property line where there are currently no trees and that 6' evergreen trees be planted atop the berm to perpetuate the City's desire to establish barrier trees. Mr. Magnuson suggested that this should be a neighborhood funded effort. Following discussion and upon motion by Watson and second by Rasmussen, Variance No. 2005-02 for Ostebo and People's Plumbing was unanimously approved as presented. Mayor Emeott then presented his recommendations for changes to Section 18, Ordinance No. 43 noting that the City had requested input for proposed changes from the owner but no response has been received. It was noted that these recommendations could be a part of the public hearing before the Planning Commission in April and Council comments would be appreciated. Magnuson then presented the most recent Sherifs report including Calls For Service from 1997 to 2004. Budget discussions and concerns over call center location and control remain in the forefront as well as concerns over the 800 mhz system. Magnuson then reported on current snow plowing efforts by Schifsky noting some damage to boulevards. It was suggested that residents acquire stakes for their properties and place same prior to first snow falls. Tree trimming to the 3/10 standard remains a problem. Emeott also indicated he and Magnuson are currently working on a parking ordinance that will address winter parking, parking of vehicles for sale, boulevard maintenance and the like with hopes of first drafts being available in May. Motion by Watson and second by Schilling to accept the 2004 NPDES Report prepared and presented by Magnuson was unanimously approved. Magnuson reported that due to the recent death of Joe Thury, proceedings relative to existing violations has been temporarily suspended to allow the family time to memorialize Mr. Thury and to determine their course of action relative to the property and it's need to be cleaned up. Magnuson then presented a letter from Guy Peterson of the Metropolitan Council relative to the proposed Northcountry changes to the Boulders Project. The letter indicates the Metropolitan Council believes the change does not affect Gem Lake's intention to support life -cycle housing. Magnuson will notify attorney Johnson of same. Magnuson then indicated he and Emeott are working on an ordinance as required to provide for renaming and renumbering streets. They hope to have this done by June.
