HomeMy WebLinkAbout2005 02-28 CC PACKETCITY OF GEM LAKE MINUTES OF CITY COUNCIL MEETING FEBRUARY, 2005 The February, 2005 regular meeting of the City Council of the City of Gem Lake was called to order by Mayor Emeott on Monday, 28 February 2005, at 7:15 PM in the first floor meeting room of Tousley Ford following the Annual NPDES Public Meeting. Mayor Emeott, Councilors Bosak, Schilling, Rasmussen and Watson, and Clerk Magnuson were present. Also present were Vern Grundhoffer, Helen Kahl, Wendy Turnbull, Barbara Kearns of Willow Lane School and Randy Ostebo of People's Plumbing. Clerk Magnuson noted that the change of meeting from 21 February 2005 to 28 February 2005 was duly published in the 16 February 2005 edition of the Legal Notices Section of the White Bear Press. Following Mayor Emeott's request for additions, deletions, or corrections, the following actions were taken: 1) unanimous approval of the Minutes of the 24 January 2005 City Council meeting as presented on Motion by Bosak, Second by Rasmussen; 2) unanimous approval of the City Council Meeting Agenda as presented for 28 February 2005 on Motion by Watson, Second by Bosak. Mr. Lindner then presented the report of the Planning Commission meeting convened on 01 February 2005. Public Hearings were held coincidental to the meeting on Variance No. 2005-01 for Turnbull and Variance No. 2005-02 for People's Plumbing. Following the public hearings, the variances were discussed and recommendations to approve both were prepared and are included in the body of the minutes. Additional time was spent discussing possible changes to Ordinance No. 43 that could be done coincidentally in April. Following discussion and upon motion by Schilling and second by Watson, Variance No. 2005-01 for Turnbull was unanimously approved with the codicil that a berm of not less than 4' - 6' in height be established along the eastern property line where there are currently no trees and that 6' evergreen trees be planted atop the berm to perpetuate the City's desire to establish barrier trees. Mr. Magnuson suggested that this should be a neighborhood funded effort. Following discussion and upon motion by Watson and second by Rasmussen, Variance No. 2005-02 for Ostebo and People's Plumbing was unanimously approved as presented. Mayor Emeott then presented his recommendations for changes to Section 18, Ordinance No. 43 noting that the City had requested input for proposed changes from the owner but no response has been received. It was noted that these recommendations could be a part of the public hearing before the Planning Commission in April and Council comments would be appreciated. Magnuson then presented the most recent Sherifs report including Calls For Service from 1997 to 2004. Budget discussions and concerns over call center location and control remain in the forefront as well as concerns over the 800 mhz system. Magnuson then reported on current snow plowing efforts by Schifsky noting some damage to boulevards. It was suggested that residents acquire stakes for their properties and place same prior to first snow falls. Tree trimming to the 3/10 standard remains a problem. Emeott also indicated he and Magnuson are currently working on a parking ordinance that will address winter parking, parking of vehicles for sale, boulevard maintenance and the like with hopes of first drafts being available in May. Motion by Watson and second by Schilling to accept the 2004 NPDES Report prepared and presented by Magnuson was unanimously approved. Magnuson reported that due to the recent death of Joe Thury, proceedings relative to existing violations has been temporarily suspended to allow the family time to memorialize Mr. Thury and to determine their course of action relative to the property and it's need to be cleaned up. Magnuson then presented a letter from Guy Peterson of the Metropolitan Council relative to the proposed Northcountry changes to the Boulders Project. The letter indicates the Metropolitan Council believes the change does not affect Gem Lake's intention to support life -cycle housing. Magnuson will notify attorney Johnson of same. Magnuson then indicated he and Emeott are working on an ordinance as required to provide for renaming and renumbering streets. They hope to have this done by June. Magnuson then advised the Council of the death of Peter Meslow, son of Gem Lake Prosecutor Doug Meslow. Magnuson indicated he had forwarded condolences on behalf of the community and that he and Emeott had forwarded a $100 memorial in Peter Meslow's name to the White Bear Lake Area Educational Foundation. Magnuson reported on forward movement on the County E/Highway 61 reconstruction project indicating a mid -July start is probable. Magnuson then introduced Barbara Kearns, Willow Lane School Principal. Ms. Kearns discussed with the Council the ongoing literacy project which Gem Lake gambling proceeds have funded for the last several years and Willow Lane's plans for the future. She also addressed the many challenges faced by changing demographics including language barriers, cultural differences, etc. The "Golden Rule Project" spearheaded by Gem Lake resident Dawn Segermark was also discussed with Magnuson indicating a $100 donation from SEH has been received and forwarded to the school. Magnuson then reported that the balance in the Charitable Gambling Fund is $3,190.12 versus the $3,106 reported on the agenda. Following discussion, motion by Watson and second by Schilling to distribute the funds as follows was unanimously approved: Friends of the Ramsey County Parks & Trails $ 200.00 White Bear Lake Emergency Food Shelf $ 300.00 Lake Area Transit $ 500.00 Willow Lane School $ 2,190.12 Magnuson will issue checks within ten days. Motion by Bosak and second by Watson to accept the February Treasurer's Report as prepared by Cobian and indicating a balance in the General Fund of $81,880.03, in the Sewer Fund of $116,014.12, in the Capital Projects Fund of $319,898.48, and in the Gem Lake Bond Debt Service Fund of $26,868.85 was unanimously approved. Motion by Bosak and second by Watson to approve Accounts Payable for January totaling $56,892.68 was unanimously approved. Mr. Grundhoffer was recognized and expressed concern over he drainage along his property on Scheuneman Road. Emeott and Magnuson indicated they would advise engineer Parotti of the problem and request he address the problem in the spring hen the contractor undertakes completion of the project. The next meeting of the Gem Lake City Council is scheduled for 21 March. There being no further business, motion by Bosak and second by Schilling to adjourn at 8:40 PM was unanimously approved. Emeott City Clerk Mayor efile: rninutes/2005/177febm2005.wpd J J CITY OF GEM LAKE MINUTES OF ANNUAL MEETING NPDES / MS4 / SWPPP 28 February 2005 The second annual Public Meeting of the City of Gem Lake to review the City's report of performance in accor- dance with the National Pollution Discharge Elimination System (NPDES) and the related Small Municipal Separate Storm Sewer Systems (MS4) Phase II Permit which is guided by the City's Storm Water Pollution Prevention Program (SWPPP) was held at 7:00 PM on 28 February 2005 in the first floor meeting room of Tousley Ford. A Public Notice of the meeting was placed in the White Bear Press, the City's Legal Publication on 23 February 2004 as Public Notie No. 2005-06. Mayor Emeott, Councilors Watson, Rasmussen, Schilling and Bosak , and City Clerk Magnuson were present along with residents Vern Grundhoffer, Helen Kahl, and Wendy Turnbull. Mayor Emeott then made opening comments stating, for the record, that this hearing is required as part of our SWPPP to provide both education of City efforts to it's residents and to make known it's accomplishments, commitments and challenges. Mayor Emeott then presented the Agenda for the Public Meeting. Motion by Bosak, Second by Watson to adopt the Agenda for the Public Meeting as presented was unanimously approved. Mr. Magnuson was then recognized. Mr. Magnuson presented the thirty (30) page Draft Annual Report summariz- ing the three (3) page formatted report and each of the twenty-eight (28) pages of criteria, allowing time for questions and answers from the City Council or those present. Mr. Magnuson also presented 13 pages of attachments demonstrating City efforts to meet the challenge of the NPDES Program. Following Mr. Magnuson's presentation, Mayor Emeott asked if there had been any written or oral input on the City's SWPPP for consideration and inclusion in the record and for consideration as changes to the City's SWPPP. Mr. Magnuson replied that no written or oral input had been received prior to convening this meeting. Mayor Emeott then asked if any Councilors wished to make comments with no response from the Councilors. Mayor Emeott then asked if anyone present wished to make comments with no response from those present. Mayor Emeott then declared that since there were no comments, no Record of Decision (ROD) would be required and no amendment of the SWPPP appeared necessary. There being no further business, the First Annual Public Meeting for review of the City's MS4 / SWPPP was adjourned at 7:15 PM. The private road has been paved and the sanitary sewer installed and tested. The Model Home on Lot # 17 is under construction and should be available for viewing by next summer. Meanwhile, the former Bemis barn is serving well as a sales office. Congratulations to Jim McNulty and his team for working closely with our Planning Commission and engineers to create what will be undoubtedly a very special development in Gem Lake. SCHEUNEMAN ROAD As of August Is', Scheuneman Road from Otter Lake Road to Highway 61 became a city street. With the addition of Scheuneman Road to Tessier Road, Haven Lane, Big Fox Road and Little Fox Lane, we doubled the total length of our city streets. Gem Lake will now maintain, plow and sand the road. Following a series of public hearings that were well attended by residents of Gem Lake, construction commenced rebuilding the (Scheuneman) roadway, closing it's southern access to Highway 61 and installing sanitary sewer along it's entire length. Congratulations to Bel Air Contracting for getting the paving put down just as the asphalt plants were closing. A final lift of paving and repairs to driveways where needed will be applied in late spring or early summer. An assessment hearing will be held in June to discuss repayment ofthe $586,000 bond which was required to pay for the work. SNOWPLOWING & WINTER PARKING In 2005, the Gem Lake City Council selected T.A. Schifsky & Sons as our snow plowing and street sanding contractor. Streets will be plowed on an as needed basis this winter as determined by Nate Jaus, Schifsky's plowing supervisor. Make sure you let us know how we're doing this year so we can improve the system as needed. To help us keep costs down and avoid return trips by our plows and drivers, please DO NOT PARK on City streets until they have been plowed curb -to -curb. COYOTES SIGHTED We were notified in November that a pack of 5 or 6 coyotes has been spotted in several places in the northern half of the City. Based upon sightings, we believe they may have taken up residency in the northwest corner of the City. Generally, coyotes are more afraid of us than we are of them. If sighted, make loud noises and they will generally "bug out". Care should be taken, small pets and children should not be left unattended in the yard and call if concerned. WINTER TREE TRIMMING Please remember that all residents are asked to keep trees trimmed along City streets so that a clear area ten (10') feet high and three (Y) feet back from the curb is maintained. This area is required to avoid costly damage to the snow plows, sanding trucks and street sweepers as they work to keep our streets plowed and sanded. Please check your boulevard and make sure your trees have been trimmed as needed. F i ....... H ++++-f ......... +�-F+-I ....++++++. The Gem Lake Planning Commission met on Tuesday, February 1, 2005 in the first floor meeting room of Tousley Ford. Members Jim Lindner, Kathy Robins, and Derek Wippich were present. In the absence of chairman Hoeschler, Mr. Lindner served as acting chair. Also present was John Lovelette, Mr. and Mrs. Kahl, Gretchen Artig- Swomley, and Randy Ostebo. Gloria Tessier arrived later. Before the Commission tonight were two scheduled public hearings. The first involved a request for a 3 foot variance from the 25' maximum building height in the R3 zoning district as stated in Ordinance 43 section 9.4 (1). Mr. and Mrs. Turnbull were unable to attend tonight's meeting but they were represented by John Lovelette, division president for Wayne Homes. Mr. Lovelette explained how the finish grade of the proposed house was three feet over l the 25' height limit. From the curb to the garage floor is two feet and the floor joists J range between 12-14 inches brining the total to three feet. A 6:12 roof pitch is planned for the house. The primary conflict facing the Turnbulls is having a four bedroom house without jeopardizing the 6:12 roof pitch makes the house three feet too high. A similar house in a rambler style would run face issues due to the shape of the lot (which is on the radii of a cul de sac. The total intended finished square footage is 2695 sq. ft. Mr. Lovelette explained the two story house of this size is in the $80-85/sq. ft. range while a similar size rambler is about $105/sq. ft. His company builds this same house in other cities and variances are often necessary. Pioneer Engineering addressed the ordinary high water level of the adjacent wetland and assured the builder the house, if properly placed, would be at minimum two feet higher than the water level. The meeting was then opened to the public for comment. Mrs. Kahl acknowledged that modern houses have steeper roof pitches and she wants this house built next to hers. Gretchen Artig-Swomley recommended changing the zoning to allow for higher house heights rather than grant a variance. Mr. Kahl asked if we could both grant a variance and change the zoning to which we said we could indeed do so. Most agreed that this shape lot demands this style of house. Discussion then was among the Commission. Mr. Wippich recognized two neighborhoods in Gem Lake. One neighborhood is less restricted by costs than the other. He said 2695 sq. ft. is not extravagant. He calculated a rambler would cost 25% more than a two story house. A split level house would not meet the needs of the height limit. Mrs. Robins had no comment. Mr. Lindner asked if engineering requirements mandated the house height. Mr. Lovelette answered that the house would be 28' whether the house was near a wetland or not. Mr. Lindner then read from Ordinance 43 section 5.4 outlining the specifics of granting variances. The primary reason a variance is warranted pertains to zoning ordinance language identifying the unique topographic and water conditions of the lot shape which makes a rambler style house unfit for this setting. A rambler would encroach on lot setbacks and by nature would push the main house back and hence closer to the wetland. We discussed the merits of not granting the variance and changing the zoning to allow for increased height limits. The commission agreed that this is a sensible thing to consider and will in fact request that the city clerk publish notice for a public hearing at the March Planning Commission meeting. We concur that height limits should remain at 25" in R4 and at 35' in R1, but that R2 and R3 represent a transition where greater building heights is logical. While there are very few if any undeveloped lots in these areas, there is the possibility that current houses may be torn down for rebuilding. Consequently it makes sense to modernize the zoning ordinance to meet current building requirements. Mr. Wippich then made a motion to allow for the variance. Mr. Lindner seconded. The motion carried 3-0. Mr. Lindner then explained the matter would be brought before the City Council on February 28 with a recommendation for approval from the Planning Commission. We agreed that the variance was warranted but we intend to review the ordinance and work to change the height requirements for future construction projects. Our next order of business was a public hearing concerning a request for a variance from Ordinance 43 15.15 (1) a, which limits businesses to one primary sign. Randy Ostebo represented his company, People's Plumbing and HVAC. He occupies the portion of Waldoch's strip mall formerly occupied by the wood molding company. Mr. Ostebo has one sign over the entrance to his office that faces County Road E. He wishes to add a second sign of identical dimensions (4'X12') on the west side of his shop. This would face Highway 61. His main purpose is to have sign exposure to traffic on each of the primary roads in the area. Much of his business is from people driving past his shop and seeing the signs. He primarily does residential work. His company is eighty years old and he bought it five years ago. He was formerly located on Otter Lake Road and in White Bear Lake. Mr. Ostebo drew a diagram of his building as it relates to the main roads on the white board. His claim to hardship is the unique shape of his building that does not lend itself well to one primary sign. J The meeting was then opened to the public for comment. Gretchen Artig-Swomley agreed the unique shape of the building warranted a variance. Gloria Tessier agreed that this was a good business to have in Gem Lake. Discussion then returned to the Planning Commission. Mr. Wippich and Mrs, Robins agreed that the shape of the building was a hardship and that a second sign was necessary for Peoples to maximize its business potential. Mr. Wippich then made a motion to approve the variance so long as the proposed sign was within its allowable size limit and was consistent with the current existing sign. Mrs. Robins seconded the motion. The motion passed 3-0. Mr. Lindner then instructed Mr. Ostebo to plan on attending the February 28 City Council meeting for final approval. He recommended Mr. Ostebo bring with him handouts and be prepared to explain his request, but that the Planning Commission would send forth a recommendation for approval.
