Minutes of Gem Lake City Council meeting, January 21, 2014
Mayor Uzpen called the meeting to order at 7:01PM
Present: Mayor Uzpen, Council members Lindner, Artig-Swomley, and Bosak. Absent: Council member
Kuny. Also present were several attendees per attached sign -in sheet.
January agenda
Mayor Uzpen asked for additions to the amended January agenda. Upon hearing no new additions,
motion by Bosak seconded by Artig-Swomley to approve agenda, the council voted 4-0 to approve
tonight's agenda.
December City Council minutes
Upon motion by Artig-Swomley and seconded by Bosak the council voted to approve December, 2013
minutes with minor spelling corrections 4-0.
Old business
City newsletter for January, 2014. Potential topics included current events, 2013 accomplishments, and
outcomes from tonight's meeting.
Public Hearing
Mayor Uzpen gave a brief history of Four Season's Auto from the time it received its Conditional Use
Permits (CUP) through several instances of violations to the CUP between 2010 and 2013.
Mayor Uzpen opened the hearing at 7:16PM
Giorgi Gochitashvili, owner, Vera Auto Sales, 1577 County Road E (business address) confirmed Mayor
Uzpen's conversation with Dennis Newcomb and said Four Season's Auto lease is month to month. He
recommended the city council do not revoke Four Season's CUP because in his opinion Four Season's
would be relocating in a few months.
Mayor Uzpen closed the public hearing at 7:18PM.
General council discussion on Four Season's Auto. Council member Bosak moved to table final decision
on Four Season's Auto until February city council meeting. Seconded by Artig-Swomley. Upon a vote of
2-2 the motion did not carry.
Council member Bosak then moved to approve Resolution 2014-04 with the following amendment to
the effective date: "effective as of March 1, 2014." Lindner seconded. Upon a vote of 4-0 the council
approved resolution 2014-04 with the effective date becoming March 1, 2014.
New business
Resolution 2014-01, 2014 city appointments motion by Lindner second by Artig-Swomley approved 4-0
Resolution 2014-02 to appoint Benjamin Johnson to Gem Lake Planning Commission chair motion by
Lindner second by Artig-Swomley approved 4-0
Resolution 2014-03 to approve the contract for Putman Planning and Design Development Study motion
by Artig-Swomley second by Bosak approved 4-0
Gem Lake Hills golf course on -sale and Sunday liquor licenses renewal motion by Bosak second by
Lindner approved 4-0
Country Lounge on -sale and Sunday liquor licenses, tobacco license, and charitable gambling license
renewals motion by Bosak second by Artig-Swomley approved 4-0
Cafe Cravings on -sale and Sunday liquor licenses renewals motion by Bosak second by Lindner approved
4-0
Mayor Uzpen spoke of Black Sea restaurant will apply for a beer license from Gem Lake and wine license
from State of Minnesota and will be a February city council agenda item if all paperwork is completed in
time.
January claims. Upon motion by Lindner and seconded by Bosak the council voted to approve the claims
for January 4-0.
The monthly financial statement was unavailable.

Dennis Newcomb of Four Season's Auto disagrees that he was in violation of his CUP during his
conversation with Mayor Uzpen in December, 2013.

Council member Artig-Swomley said she believes there are too many deer in Gem Lake, she added that
she has nine on her property causing damage to landscaping. Mayor Uzpen explained the hunting
process followed by a general discussion of deer and other animals residing within Gem Lake's borders.

Minutes of Gem Lake City Council meeting, December 17, 2013
Mayor Uzpen called the meeting to order at 7:05PM
Present: Mayor Uzpen, Council members Lindner, ARTIG-Swomley, and Bosak. Absent: Council member
Kuny. Also present were City Attorney Patrick Kelly and several attendees per attached sign -in sheet.
December agenda
Mayor Uzpen asked for additions to the December agenda. Lindner added discussion of MS4 permit
application. Upon motion by Bosak seconded by Lindner to approve agenda with the addition, the
council voted 4-0 to approve tonight's agenda.
November City Council minutes
Upon motion by Lindner and seconded by Artig-Swonley the council voted to approve November
minutes with minor editand spelling corrections 4-0.
Old business
City newsletter for January, 2014. Potential topics were discussed by the council including new city
residents and various city council actions such as tonight's public hearing.
New business
Ramsey County is requesting Gem Lake enter into a joint powers agreement to participate in the
county's acquisition and operation of a new voting system. Gem Lake's portion of the agreement is
$550.38 per annum. Upon motion by Artig-Swomley and second by Bosak, the council voted 4-0 to
enter into the joint powers agreement with Ramsey County.
Resolution 2013-17 offered by Lindner and seconded by Artig-Swomnley to transfer $70,000 from the
city's general fund into reserves. Voice vote: Uzpen yes, Lindner yes, Bosak yes, Artig-Swomley yes.
Resolution passed 4-0
December claims. Upon motion by Lindner and seconded by Artig-Swomley the council voted to
approve the claims for December 4-0.
Mayor Uzpen presented the financial report. The auditors will come out in January to audit the city's
financial records. Mayor Uzpen has asked the auditors to also review the city's charitable gambling
records. Mayor Uzpen explained the city's charitable gambling program to the audience.
MS4 application. Lindner explained to the council the need for the city to reapply for its MS4 permit as
required by the Minnesota Pollution Control Agency (MPCA) by December 30. He stated that he
received a voice message at his house from the MPCA and then logged onto the MPCA website to look
at the application. As he considered the technical nature of the application he determined that he did
not have the necessary expertise to complete the application thus he forwarded an email to Mayor
Uzpen suggesting the city utilize its engineering firm, SEH, to complete the application. He also noted
that he contacted the MPCA to inform them that the city may not have the application complete by the
December 30 deadline. Based on comment from the mayor and council, plus input from Attorney Kelly,
Lindner will contact the MPCA via email to explain that the city will be moving forward with completing
the application as soon as possible.

Presentations from the council — Uzpen stated the proposed contract from Marc Putman will be
reviewed at the January, 2014 workshop. Lindner said that at the most recent Vadnais Lake Area Water
Management Organization (VLAWMO) technical commission meeting, VLAWMO staff stated they would
work to organize the impaired water stakeholder meeting for Gem Lake in January, 2014.

Public hearing on Gateway District interim ordinance (commonly referred to as the "moratorium
ordinance")
Attorney Kelly gave the legal background of the state statute authorizing the interim ordinance for up to
one year from the date of enactment and provided for the official record a copy of the Minnesota
statute 462.355 Adopt, Amend Comprehensive Plan; Interim Ordinance. Kelly stated that an interim
ordinance must establish findings based on the study area. The study area for this interim ordinance is
defined as the Neighborhood Center Subzone of the Gateway Zone lying East of the Centerline of
Highway 61.
The council then discussed how long should the interim ordinance should be in effect. Artig-Swomley
suggested four months. Lindner said he was comfortable with one year provided progress was being
made to complete the study. The council agreed that the interim ordinance be in effect for four months
from the date of adoption with the possibility of being extended up to one year from the date of
adoption.
Mayor Uzpen opened the public hearing at 8:10PM
Tom Bolfing asked about the area where the moratorium would be in effect. The council responded
that the study area was the Neighborhood Center Subzone of the Gateway Zone lying east of Highway
61. Bolfing then asked what retail the city wished to see come to this area. He next asked about
automobile sales to which the council said automobile sales are not retail and that it was confusion on
this item that led to the need for the city to be clearer in the wording of the Gateway Ordinance. Dennis
Olson, the owner of Mouldings, Doors and More also participated in the conversation. Discussion
followed on various types of potential uses and the actual size of the study area.
Mayor Uzpen closed the public hearing at 8:22PM
Lindner offered a motion to approve "An Ordinance for the Purpose of Enacting a Moratorium to
Preserve the Status Quo for a Specific Period of Time Within Certain Areas Under Study in the City of
Gem Lake" which was then seconded by Artig-Swomley. The motion passed 4-0

There being no further business upon motion by Artig-Swomley and seconded by Bosak, Mayor Uzpe-n

SUBJECT: GEM LAKE HILLS LIQUOR LICENSE RENEWAL
It is time again for the City Council to consider approving the renewal of the On -Sale and
Sunday Intoxicating Liquor License for the Gem Lake Hills Golf Course.
The completed application, appropriate fees, and Certificate of Insurance listing the City
of Gem Lake as an additional insured have been received.
I have requested the background check from the Ramsey County Sheriff's Department
but haven't received it as of today. I don't anticipate any problems as the person is the
same as in previous years.
Requested Action:
Approve the renewal of the On -Sale and Sunday Intoxicating Liquor License for Gem
Lake Hills Golf Course, 4039 Scheuneman Road, for the period of January 1, 2014
through December 31, 2014, and authorize execution of the license by the City Clerk, and
further authorize staff to forward the documents to the Alcohol and Gambling Enforcement
Division of the State of Minnesota.

or require the applicant, by contract, understanding or otherwise, to handle or sell
only the products of such manufacturer or wholesaler; and,
(6) No other retailer's license has been issued, directly or indirectly, to the applicant or
for said premises other than a cigarette license; no license of a class other than

premises are neither owned nor controlled by any person to whom no license could

A RESOLUTION APPOINTING INDIVIDUALS AND FIRMS TO PERFORM THE
FUNCTIONS NECESSARY FOR SUPPORTING THE GOVERNING BODY OF THE
CITY OF GEM LAKE, RAMSEY COUNTY, MINNESOTA.
WHEREAS, the individuals, municipalities and or companies identified have agreed to
serve in the appointed positions identified for the period 01 January 2014 to 31 December
2014 or until replaced by another in an updated resolution.
Appointed City Officials and other appointed companies to represent the City.

A RESOLUTION SUPPORTING THE REVOCATION OF FOUR SEASONS AUTO
CONDITIONAL USE PERMIT IN THE CITY OF GEM LAKE, MN.,
WHEREAS, the City Council of Gem Lake, by this Resolution has acknowledged that
Four Seasons Auto has been in violation of its Conditional Use Permit in October 2010, April
2012 and January 2014, therefore,
By this Resolution The City Council for the City of Gem Lake hereby revokes the
Conditional Use Permit for Four Seasons Auto.
NOW, THEREFORE, the motion for the adoption of the foregoing Resolution was made
