Home My WebLink About2006 05 15 CC PACKETCITY OF GEM LAKE MINUTES OF CITY COUNCIL MEETING 15 MAY 2006 The May, 2006 regular meeting of the City Council of the City of Gem Lake was called to order by Acting Mayor Schilling on Monday, 15 May 2006 at 7:01 PM in the first floor meeting room of Tousley Ford. Acting Mayor Schilling, Councilors Bosak, Rasmussen and Watson and Clerk Magnuson were present. Also present were Jim Lindner of the Planning Commission, Mr. & Mrs. Swomley, and Mr. McNulty. Following Mr. Schilling's request for additions, deletions, or corrections, the following actions were taken: 1) unanimous approval ofthe 19 April 2006 Minutes of the City Council meeting as presented on Motion by Bosak, Second by Rasmussen; 2) acceptance of the written record of the General Information Meeting for Public Improvement Project No. 2006-03 held on 24 April 2006; 3) unanimous approval of the 15 May 2006 Agenda of the City Council meeting as amended on Motion by Watson, Second by Rasmussen. The Clerk then presented General Announcements. The report of the Planning Commission was acknowledged and accepted as received in the form of a letter from the Chairman to Mayor Emeott, said report having been distributed electronically to the Council in advance. Staff reports were presented by the Clerk and included comments as follows: 1) The application for a variance submitted by Mr. Macalus remains incomplete and it is noted for the record that Mr. Macalus failed to appear before the Planning Commission and present supplemental data as requested. Notice to Mr. Macalus will be sent again. 2) The pending application by Flanagan Properties of 1567 East County Road E and Enterprise Car Rental has been delayed due to unexpected terms included in the lease by Enterprise. The matter may still come before the Planning Commission and City Council in April. 3) An application for a Variance has been received from Mike Strommer to allow construction of a detached 24' x 24' garage on his property within 6' (a 9' variance from set -back) of his property line with Vomacka. The matter has been set for a public hearing on 05 June 2006 before the Planning Commission. 4) An application for a Special Use Permit to allow construction of a single family residence at 1400 Goose Lake Road by Bruce and Lorry Shirley which will include a facade in excess of the 35' allowed by the existing city zoning ordinance. With the permission ofthe owner and his architect, the matter is being handled consistent with both the current rules regarding height and the proposed rules regarding height to assist in debugging the procedures. Completion of the preliminary plan review by the Plan Review Commission was completed in 6 days, well within the original guidelines set for the procedure. 5) Completion of the proposed changes to Ordinance No. 43 is now at hand and will be incorporated into the document for a final reading before the Planning Commission at a public hearing scheduled for 05 June 2006. Notwithstanding incorporation of comments received at the public hearing, the matter is expected to be sent to the City Council for approval in June. 6) Public Improvement Project No 2006-01 is nearing the bid stage and it is anticipated that work will commence in the first 2 weeks of July and be complete by the end of August. Currently it is anticipated that the City Council will be asked to approve plans, details and specifications at the June meeting followed by acceptance of the low bid and order for the work to begin. 7) Steady progress continues with the Public Improvement Project No. 2006-02, the City Water Plan. As this plan remains in progress with a completion date currently unknown, it will most likely be beneficial to delay installation of city water and other infrastructure in accordance with Public Improvement Project No. 2006-03 until all details have been concluded with PIP2006-02. White Bear Lake has called and offered whatever assistance might be needed relative the projects and other municipal matters. 8) Public Improvement Project No. 2006-04 has been stalled due to staff and volunteer time. The hope is to get back on track as soon as possible, still with an eye on 2007 completion. Page 1 of 4 9) Mr. Macalus has been notified by certified mail to cease and desist any further storage of machinery and rubbish/debris on his property. He has been further advised to establish sediment and erosion controls until such time as he reestablishes ground cover on his property. Finally, he has been notified that failure to comply with this order will result in citation for each violation as a misdemeanor with each day unresolved considered a separate violation. 10) Mr. Ophelan has been advised he must cease and desist operation of his landscape business from his home on Scheuneman Road adjacent the south entrance to Hillary Farm and remove all machinery on or before a date specific. Similar to Macalus, failure to comply with this order will result in citation for each violation as a misdemeanor with each day unresolved considered a separate violation. 11) Since accepting the sewer system on Scheuneman Road, approximately 21 connections have been completed or are in progress. This is approximately equal to or slightly greater than what was anticipated at this time relative to existing residences. 12) The I" Quarter Crime Report was acknowledged as sent electronically. Much of the current work is future planning which includes responses to and operational readiness in the face of pandemic scale problems. Following discussion and inclusion of Mr. Schilling's statement of willingness to serve as Chairman, motion by Bosak, second by Rasmussen to adopt Resolution No. 2006-13 establishing a committee to be known as the Gem Lake Business Development Commission was unanimously approved. Following discussion regarding the requirements of the Metropolitan Council to update the Gem Lake Comprehensive Municipal Plan on or before 12 September 2008, motion by Watson, second by Bosak to approve Resolution No. 2006-14 charging the Planning Commission, City Planner and City Staff to work together to complete necessary updates to the Gem Lake Comprehensive Municipal Plan at least one year ahead of schedule was unanimously approved. Following discussion, motion by Watson, second by Rasmussen to authorize the City Clerk to hire a summer intern from the Hubert H. Humphrey Institute with an attendant stipend of $2,000 was unanimously approved. Mr. Schilling offered assistance in the form of work space for the intern who will answer to Mr. Magnuson for his work effort. Mr. Magnuson will work same out with Mr. Schilling. Motion by Bosak, Second by Rasmussen to accept the April, 2006 Treasurer's Reports as prepared by Cobian which indicate balances in the General Fund of $117,922.19, in the Sewer Fund of $26,701.31, in the Capital Projects Fund of $0.00, and in the Gem Lake Bond Debt Service Fund of $71,310.74 were unanimously approved. Payment of bills totaling $57,522.93 was unanimously approved. Mr. Watson asked if a total spent on the current annexation matter has been kept. Mr. Magnuson indicated he would determine the current total and advise the Council within the next few days. Discussion of the newsletter followed and Mr. Watson asked for current details prior to mailing same. Mr. Watson suggested opening dialogue with Eugene Newcome about the possibility of securing his property for addition to the City Hall project. The next meeting of the Gem Lake City Council is scheduled for 19 June 2006. Public hearings are scheduled before the Planning Commission for Monday, 05 June 2006 for several matters. The Planning Commission is rescheduled to meet on Monday, 05 June 2006. There being no further business, motion by Rasmussen, second by Bosak to adjourn at 7:42 PM was unanimously approved. Messrs Rafferty, Lindner and Hoeschler were present along with Paul Emeott acting as co -zoning administrator. We were also joined by Mr. McNulty and his counsel, Mrs. Shearen, and the Swomleys. The main focus of the evening was the changes to the zoning ordinance (43G) embodied in so- called Version F. We spent most of the evening discussing possible changes to our height regulations — the topic that had started us on our review of the entire document so long ago. There was agreement that the language should be changed to establish the low point of measurement at the ground level 6 feet from the front door of a house. After considerable discussion, we agreed to continue to use an "absolute" method of measuring height — i.e. to the highest point of a roof (not counting cupolas, antennae, or chimneys) rather than to the mean height of the roof structure. We agreed that the absolute height limits for the main structure and any accessory structures in the various districts should be as follows (measurements are in feet; new reflects change agreed upon; old reflects former rule): District R-1(3 ac) R-2(lac) R-3(3/4 ac) R-4(1/2 ac) Main Structure -new 35 30 30 30 Main Structure -old 35 30 30 25 Accessory Structure 25 15/20* 15/20* 15 Accessory -old 25 15 15 15 *In R-2 and R-3 districts, an accessory structure may exceed 15 feet (up to 20 feet) upon issuance of a special use permit which will address: a) The location of the structure in the back yard (i.e. behind the rear line of the principal structure) of the lot; b) With such landscape screening as the city may require; and c) Along with such other requirements as the city may deem appropriate to mitigate the impact of the size of the structure on the neighborhood. We agreed to adopt the wordsmithing changes suggested by Mr. Rafferty to the language of the height rules that Mr. Hoeschler had circulated (these changes drop restrictions on fenestration and also drop any specific numerical requirement for screening 60% of the structure and instead simply reference the need for "partial" vegetative or topographical screening). During the course of the discussion Mr. Rafferty spoke strongly in favor of not attempting to "legislate" good design. In the end, we agreed that we were merely trying to state outer limits for good neighborliness by these rules. We hoped that the site review process we have set in motion will provide a forum for discussion and negotiation of ways to realize the sense of place that Gem Lake has. Mr. Hoeschler again expressed concern that we were losing the "back -1 woods" feel of the lake area and were instead moving toward an Edina or Eden Prairie suburban lake feel with the most recent structures. He hoped that with time and the growth of the promised additional plantings, the "peek-a-boo" screening that Mr. Rafferty had described could be achieved for those new houses. Mr. McNulty said that the owners of Lots 6 and 7 had agreed to provide additional plantings and screening (even though they were not required to do so) as a result of the site review process. We all agreed that we hoped the site review process would provide an informal vehicle for these important discussions. We looked at the plans submitted by the Shirleys for their new house on the Thury property (which plans are currently being reviewed by Paul and Craig) as a successful example of that process. Mr. Hoeschler urged Paul and Craig to give informal notice and opportunity to be heard to affected neighbors when such a review is going on so that their opinions can be heard without the need for a formal public hearing and the delays that would be attendant to that. After a full discussion, it was unanimously agreed that Version F should be amended to include the changes proposed by Mr. Hoeschler as modified by Mr. Rafferty along with our agreements on height and that this language of Version F should be reviewed one last time by Messrs. Emeott, Magnuson and Hoeschler for consistency and form and that resulting Version F changes should be distributed to all interested parties and recommended to the next City Council meeting for adoption. For the record, therefore, these minutes will be supplemented by the final wording of Version F changes to Ordinance 43G, which final version will be sent out shortlyl. This will allow all interested parties to make their final comments before the language is voted upon by the Council. The meeting closed with a brief discussion of Mr. McNulty's overtures to the City of Vadnais Heights to have Hillary Farm annexed to Vadnais Heights. It was the sense of the meeting that we hoped Mr. McNulty would reconsider the wisdom of such a move since it seemed to many to be both legally outrageous and politically distasteful. Mr. McNulty did not express himself on this matter. In a post meeting discussion with the Mayor, it was decided to hold one last public hearing on the foal himpia,e of the ordinance at the June S (note change of date) meeting of the Plannin Commission before the language is presented to the Council. This will allow the McNulty team and Mr. Hanson one last chance to present any objections or comments that they may have.
