CITY OF GEM LAKE CITY COUNCIL WORKSHOP MINUTES 14 AUGUST 2006 The August 2006 City Council Workshop was called to order by Mayor Emeott at 7:OOPM. Mayor Emeott thanked those in attendance for participating in this evenings workshop noting input from the community will enhance these efforts as time passes. Although a general agenda has been prepared, no formal agenda will be used and, thus, no agenda approval will be necessary. Those present were encouraged to participate and, to the extent time allows, hopefully all will be heard. Brief staff and councilor reports on elections, meeting schedule revisions, website development, public relations, "36 Point List", City Limit Signs, Joint City Hall Project, 2008 Comprehensive Municipal Plan and the pending developments of the Hansen and Hoffman Corners areas followed. Mayor Emeott then indicated that education is one of the key elements of the City Council workshops and this evenings presentations are designed to assist both the City Council and Planning Commission in working on current and pending projects with a greater understanding of outcome based processes. City Attorney Patrick Kelly and his associate Dave Ramberg were then introduced and a presentation on the annexation process followed by a presentation on Planned Unit Developments (PUDs) were given. Questions and answers were interspersed with the presentations. Mayor Emeott thanked Mr. Kelly and Mr. Ramberg for their informative presentation. Discussion ofwebsite content followed with many suggestions offered for consideration. Additional discussion of proactive efforts with the City of Vadnais Heights followed although the effort was shortened by the need to adjourn in consideration of Tousley's closing schedule. Emeott City Clerk Mayor 4114,1G-L efile: Mlinutes\2006\198augmw.wpd CITY OF GEM LAKE MINUTES OF CITY COUNCIL MEETING 21 AUGUST 2006 - The August, 2006 regular meeting of the City Council ofthe City of Gem Lake was called to order by Mayor Emeott on Monday, 21 August 2006 at 7:04 PM in the first floor meeting room of Tousley Ford. Mayor Emeott, Councilors Bosak, Schilling and Watson. Also present were City Clerk Magnuson, Mark Sweet of the Business Development Committee. Others in attendance included: Connie Kunin, Linda Hoeschler, Bryan Hansen, Holly Watson, Ray & Joan Tessier, Scott Tessier, Holly Watson, and Gretchen Artig & Dale Swomley. Mayor Emeott thanked those in attendance for coming. Following Mayor Emeott's request for additions, deletions, or corrections, the following actions were taken: 1) approval of Workshop Minutes for 14 August 2006 was tabled; 2) unanimous approval of the 24 July 2006 Minutes of the City Council meeting as amended on Motion by Bosak, Second by Watson; 3) unanimous approval of the 21 August 2006 Agenda of the City Council meeting as amended on Motion by Schilling, Second by Watson. RESOLVED. Following questions by Mayor Emeott, Motion by Schilling, Second by Watson to approve the Consent Agenda as presented was unanimously approved. In his capacity as Zoning Co -Administrator, Magnuson recommended the City Council formally deny the Macalus Application for a Variance and Conditional Use Permit. RESOLVED. Motion by Watson, Second by Schilling to formally deny Application No. 2006-01 for a Variance and Conditional Use Permit submitted by Fred Macalus, 1216 Little Fox Lane was unanimously approved. Magnuson was ordered to notify Macalus. In his capacity as Zoning Co -Administrator, Magnuson presented application by Giovanna Leick to subdivide a small area of property from her property at 1546 Goose Lake Road (PIN #22-30-22-43-0035) for reattachment to the adjacent parcel owned by Ray and Joan Tessier, 1560 Goose Lake Road (PIN #22-30-22-43-0016). Once completed, the additional property on the Tessier property will make each lot very nearly equal in area with both substantially larger than the requirements of the R-4 district. Further, it will provide adequate space so that the Tessier home will comply with side yard set -backs for the R-4 district. As no other properties are affected and zoning remains unchanged, no public hearing was necessary. RESOLVED. Motion by Bosak, Second by Schilling to approve Resolution No. 2006-27 approving the Leick minor subdivision was unanimously approved. Mr. Tessier was asked to file the subdivision within ninety (90) days. Discussion followed regarding the preliminary 2007 Budget and Tax Levy. Following discussion, consideration of Resolution No. 2006-28 was tabled to September 14. Discussion of the September Workshop Agenda followed with a recommendation that the City Planner, City Engineer and Intern attend and no further action taken. RESOLVED. Motion by Bosak, Second by Watson to change the September meeting date from Monday, September 18 to Thursday, September 14 at 7:00 PM to provide additional time for consideration ofthe 2007 Preliminary Budget and to make time for a meeting with the White Bear Township Board of Supervisors at 8:00 pm on Monday, September 18 at the White Bear Town Hall was unanimously approved. The Clerk was ordered to publish same. RESOLVED. Motion by Schilling, Second by Watson to approve Resolution No. 2006-29 recognizing benefit to the community of meeting attendance by both elected and appointed officials and agreeing to compensate said officials at a rate of twenty-five ($25.00) dollars per meeting was unanimously approved. RESOLVED. Motion by Watson, Second by Bosak to adopt Resolution No. 2006-30 approving the Clerk's selection of Head Election and Election Judges was unanimously approved. RESOLVED. Motion by Watson, Second by Bosak to adopt Resolutions No. 2006-31 and No. 2006-32 honoring and thanking Jack Hoeschler and Kathy Robins for their respective major contributions to the community through their term as Planning Commission Chair and Planning Commissioner was unanimously approved. The Clerk was ordered to select and forward honorariums for both Mr. Hoeschler and Mrs. Robins. Discussion followed regarding Mrs. Hoeschler's inquiry regarding the Plan Review Commission's process for 1J review and how adjacent property owners were included in the process. Page 1 of 7 Motion by Emeott, Second by Schilling to allocate eight hundred ($800.00) dollars for acquisition of 10-12 locking file cabinets was unanimously approved. Mr. Schilling indicated he will check with his suppliers for availability. A fee for accessing records must also be established. Motion by Bosak, Second by Watson to consider digitizing all city records and to begin a project for consideration of this was unanimously approved. It was discussed and recommended that each elected official receive a copy of the Minnesota Data Practices Act for general information purposes. Emeott recommended a fee be established by the City for zoning inquiries ADJOURN: Motion by Watson, second by Bosak to adjourn at 9:10 PM was unanimously approved. Sale of Bonds. 1.01. Award to the Purchaser and Interest Rates. The proposal of Wells Fargo Brokerage Services, LLC (the "Purchaser") to purchase $245,000 General Obligation Improvement Bonds, Series 2006A of the City described in the Terms of Proposal thereof is hereby found and determined to be the highest and best bid received pursuant to duly advertised notice of sale and is hereby accepted, the proposal being to purchase the Bonds at a price of $241,325 plus accrued interest to date of delivery, for the Bonds bearing interest at 4.30%. True interest cost: 4.58% 2915200 MNI GE190-5 1.03. Good Faith Check and Contract with the Purchaser. The City Clerk is directed to retain the good faith check of the Purchaser, pending completion of the sale of the Bonds, and to return the good faith checks of the unsuccessful proposers forthwith. The Mayor and City Clerk are directed to execute a contract with the Purchaser on behalf of the City. 1.04. Terms and PrinciRal Amounts of the Bonds. To provide financing for the Improvements, the City will issue and sell the Bonds in the original aggregate principal amount of $245,000, originally dated August 23, 2006, in the denomination of $5,000 each or any integral multiple thereof, numbered No. R-1 upward, bearing interest as above set forth, and maturing serially in the years and amounts as follows: Term Bonds due February 1, 2017 in the aggregate principal amount of $245,000. 1.05. Optional Redemption. The City may elect on August 1, 2010, and any day thereafter to prepay Bonds due on or after February 1, 2011. Redemption may be in whole or in part and if in part, at the option of the City and in such manner as the City will determine. Prepayments will be at a price of par plus accrued interest. 1.06. Mandatory Redemption. Dates; Interest Payment Dates. The Bond will be dated as of the last interest payment date preceding the date of authentication to which interest on the Bond has been paid or made available for payment, unless (i) the date of authentication is an interest payment date to which interest has been paid or made available for payment, in which case the Bond will be dated as of the date of authentication, or (ii) the date of authentication is prior to the first interest payment date, in which case the Bond will be dated as of the date of original issue. The interest on the Bonds is payable on February 1 and August 1 of each year, commencing February 1, 2007, to the registered owners of record thereof as of the close of business on the fifteenth day of the immediately preceding month, whether or not that day is a business day. 2.03. Registration. The City appoints the City Clerk as bond registrar (the "Registrar"). The effect of registration and the rights and duties of the City and the Registrar with respect thereto will be as follows: (a) Register. The Registrar must keep at its principal corporate trust office a bond register in which the Registrar provides for the registration of ownership of Bonds and the registration of transfers and exchanges of Bonds entitled to be registered, transferred or exchanged. (b) Transfer of Bonds. Upon surrender for transfer of a Bond duly endorsed by the registered owner thereof or accompanied by a written instrument of transfer, in form satisfactory to the Registrar, duly executed by the registered owner thereof or by an attorney duly authorized by the registered owner in writing, the Registrar will authenticate and deliver, in the name of the designated transferee or transferees, one or more new Bonds of a like aggregate principal amount and maturity, as requested by the transferor. The Registrar may, however, close the books for registration of any transfer after the fifteenth day of the month preceding each interest payment date and until that interest payment date. (c) Exchange of Bonds. When Bonds are surrendered by the registered owner for exchange the Registrar will deliver one or more new Bonds of a like aggregate principal amount and maturity as requested by the registered owner or the owner's attorney in writing. (d) Cancellation. Bonds surrendered upon transfer or exchange will be promptly cancelled by the Registrar and thereafter disposed of as directed by the City. (e) Improper or Unauthorized Transfer. When a Bond is presented to the Registrar for transfer, the Registrar may refuse to transfer the Bond until the Registrar is satisfied that the endorsement on the Bond or separate instrument of transfer is valid and genuine and that the requested transfer is legally authorized. The Registrar will incur no liability for the refusal, in good faith, to make transfers which it, in its judgment, deems improper or unauthorized. (f) Persons Deemed Owners. The City and the Registrar may treat the person in whose name a Bond is registered in the bond register as the absolute owner of the Bond, whether the Bond is overdue or not, for the purpose of receiving payment of, or on account of, the principal of and interest on the Bond and for all other purposes and payments so made to registered owner or upon the owner's order will be valid and effectual to satisfy and discharge the liability upon the Bond to the extent of the sum or sums so paid. 2915200 MNI GE190-5 (g) Taxes, Fees and Charges. The Registrar may impose a charge upon the owner thereof for a transfer or exchange of Bonds, sufficient to reimburse the Registrar for any tax, fee or other governmental charge required to be paid with respect to the transfer or exchange. (h) Mutilated Lost Stolen or Destroyed Bonds. If a Bond becomes mutilated or is destroyed, stolen or lost, the Registrar will deliver a new Bond of like amount, number, maturity date and tenor in exchange and substitution for and upon cancellation of the mutilated Bond or in lieu of and in substitution for a Bond destroyed, stolen or lost, upon the payment of the reasonable expenses and charges of the Registrar in connection therewith; and, in the case of a Bond destroyed, stolen or lost, upon filing with the Registrar of evidence satisfactory to it that the Bond was destroyed, stolen or lost, and of the ownership thereof, and upon furnishing to the Registrar of an appropriate bond or indemnity in form, substance and amount satisfactory to it and as provided by law, in which both the City and the Registrar must be named as obligees. Bonds so surrendered to the Registrar will be cancelled by the Registrar and evidence of such cancellation must be given to the City. If the mutilated, destroyed, stolen or lost Bond has already matured or been called for redemption in accordance with its terms it is not necessary to issue a new Bond prior to payment. (i) Redemption. In the event any of the Bonds are called for redemption, notice thereof identifying the Bonds to be redeemed will be given by the Registrar by mailing a copy of the redemption notice by first class mail (postage prepaid) not more than 60 and not less than 30 days prior to the date fixed for redemption to the registered owner of each Bond to be redeemed at the address shown on the registration books kept by the Registrar and by publishing the notice if required by law. Failure to give notice by publication or by mail to any registered owner, or any defect therein, will not affect the validity of the proceedings for the redemption of Bonds. Bonds so called for redemption will cease to bear interest after the specified redemption date, provided that the funds for the redemption are on deposit with the place of payment at that time. 2.04. Execution and Delivery. The Bonds will be prepared under the direction of the City Clerk and executed on behalf of the City by the signatures of the Mayor and the City Clerk, provided that those signatures may be printed, engraved or lithographed facsimiles of the originals. If an officer whose signature or a facsimile of whose signature appears on the Bonds ceases to be such officer before the delivery of a Bond, that signature or facsimile will nevertheless be valid and sufficient for all purposes, the same as if the officer had remained in office until delivery. When the Bonds have been so prepared and executed, the City Clerk will deliver the same to the Purchaser upon payment of the purchase price in accordance with the contract of sale heretofore made and executed, and the Purchaser is not obligated to see to the application of the purchase price. 2.05. Temporary Bonds. The City may elect to deliver in lieu of printed definitive Bonds one or more typewritten temporary Bonds in substantially the form set forth in Section 3 with such changes as may be necessary to reflect more than one maturity in a single temporary bond. Upon the execution and delivery of definitive Bonds the temporary Bonds will be exchanged therefor and cancelled. Section 3. Form of Bond. 3.01. Execution of the Bond. The City Council has designated the issue of Bonds of which this Bond forms a part as "qualified tax exempt obligations" within the meaning of Section 265(b)(3) of the Internal Revenue Code of 1986, as amended (the "Code") relating to disallowance of interest expense for financial institutions and within the $10 million limit allowed by the Code for the calendar year of issue. This Bond is one of an issue in the aggregate principal amount of $245,000 all of like original issue date and tenor, except as to number, maturity date, and interest rate, all issued pursuant to a resolution adopted by the City Council on July 31, 2006 (the "Resolution"), for the purpose of providing money to defray the expenses incurred and to be incurred in making local improvements, pursuant to and in fall conformity with the Constitution and laws of the State of Minnesota, including Minnesota Statutes, Chapter 429, and the principal hereof and interest hereon are payable from special assessments against property specially benefited by local improvements, as set forth in the Resolution to which reference is made for a full statement of rights and powers thereby conferred. The full faith and credit of the City are irrevocably pledged for payment of this Bond and the City Council has obligated itself to levy ad valorem taxes on all taxable property in the City in the event of any deficiency in special assessments pledged, which taxes may be levied without limitation as to rate or amount. The Bonds of this series are issued only as fully registered Bonds in denominations of $5,000 or any integral multiple thereof of single maturities. As provided in the Resolution and subject to certain limitations set forth therein, this Bond is transferable upon the books of the City at the principal office of the Bond Registrar, by the registered owner hereof in person or by the owner's attorney duly authorized in writing, upon surrender hereof together with a written instrument of transfer satisfactory to the Bond Registrar, duly executed by the registered owner or the owner's attorney; and may also be surrendered in exchange for Bonds of other authorized denominations. Upon such transfer or exchange the City will cause a new Bond or Bonds to be issued in the name of the transferee or registered owner, of the same aggregate principal amount, bearing interest at the same rate and maturing on the same date, subject to reimbursement for any tax, fee 1 or governmental charge required to be paid with respect to such transfer or exchange. 2915200 MNI GE190-5 The City and the Bond Registrar may deem and treat the person in whose name this Bond is registered as the absolute owner hereof, whether this Bond is overdue or not, for the purpose of receiving payment and for all other purposes, and neither the City nor the Bond Registrar will be affected by any notice to the contrary. IT IS HEREBY CERTIFIED, RECITED, COVENANTED AND AGREED that all acts, conditions and things required by the Constitution and laws of the State of Minnesota, to be done, to exist, to happen and to be performed preliminary to and in the issuance of this Bond in order to make it a valid and binding general obligation of the City in accordance with its terms, have been done, do exist, have happened and have been performed as so required, and that the issuance of this Bond does not cause the indebtedness of the City to exceed any constitutional or statutory limitation of indebtedness. (b) The proceeds of the Bonds, less the appropriations made in paragraph (a), together with any other funds appropriated for the Improvements and Assessments collected during the construction of the Improvements will be deposited in a separate construction fund (which may contain separate accounts for each Improvement) to be used solely to defray expenses of the Improvements and the payment of principal and interest on the Bonds prior to the completion and payment of all costs of the Improvement. Any balance remaining in the construction fund after completion of the Improvements may be used to pay the cost in whole or in part of any other improvement instituted under the Act. When the Improvements are completed and the cost thereof paid, the construction account is to be closed and subsequent collections of Assessments for the Improvements are to be deposited in the Debt Service Fund. 4.02. City Covenants. It is hereby determined that the Improvements will directly and indirectly benefit abutting property, and the City hereby covenants with the holders from time to time of the Bonds as follows: (a) The City has caused or will cause the Assessments for the Improvements to be promptly levied so that the first installment will be collectible not later than 2008 and will take all steps necessary to assure prompt collection, and the levy of the Assessments is hereby authorized. The City Council will cause to be taken with due diligence all further actions that are required for the construction of each Improvement financed wholly or partly from the proceeds of the Bonds, and will take all further actions necessary for the final and valid levy of the Assessments and the appropriation of any other funds needed to pay the Bonds and interest thereon when due. (b) In the event of any current or anticipated deficiency in Assessments, the City Council will levy ad valorem taxes in the amount of the current or anticipated deficiency. (c) The City will keep complete and accurate books and records showing: receipts and disbursements in connection with the Improvements, Assessments levied therefor and other funds appropriated for their payment, collections thereof and disbursements therefrom, monies on hand and, the balance of unpaid Assessments. (d) The City will cause its books and records to be audited at least annually and will furnish copies of such audit reports to any interested person upon request. 4.03. No Tax Levy Required. It is hereby determined that the estimated collections of Assessments and interest thereon for payment of principal and interest on the Bonds will produce at least five percent in excess of the amount needed to meet when due, the principal and interest payments on the Bonds and that no tax levy is needed at this time. 2915200 MNI GE190-5 �1 4.04. County Auditor Certificate as to Registration. The City Clerk is authorized and directed to file a certified copy of this resolution with the Director of Property Records and Revenue of Ramsey County and to obtain the certificate required by Minnesota Statutes, Section 475.63. Section 5. Authentication of Transcript. 5.01. City Proceedings and Records. The officers of the City are authorized and directed to prepare and furnish to the Purchaser and to the attorneys approving the Bonds, certified copies of proceedings and records of the City relating to the Bonds and to the financial condition and affairs of the City, and such other certificates, affidavits and transcripts as may be required to show the facts within their knowledge or as shown by the books and records in their custody and under their control, relating to the validity and marketability of the Bonds, and such instruments, including any heretofore famished, may be deemed representations of the City as to the facts stated therein. 5.02. Certification as to Offering Memorandum. It is determined that no comprehensive Official Statement or offering material has been prepared or circulated by the City in connection with the sale of the Bonds and that the City is relying on the investment representation of the Purchaser in an investment letter of even date now on file with the City Clerk. 5.03. Payment of Costs of Issuance. The City authorizes the Purchaser to forward the amount of Bond proceeds allocable to the payment of issuance expenses (other than amounts payable to Kennedy & Graven, Chartered as Bond Counsel) to U.S. Trust Company, Minneapolis, Minnesota on the closing date for further distribution as directed by the City's financial adviser, Ehlers & Associates, Inc. Section 6. Tax Covenant. 6.01. Tax -Exempt Bonds. The City covenants and agrees with the holders from time to time of the Bonds that it will not take or permit to be taken by any of its officers, employees or agents any action which would cause the interest on the Bonds to become subject to taxation under the Internal Revenue Code of 1986, as amended (the "Code"), and the Treasury Regulations promulgated thereunder, in effect at the time of such actions, and that it will take or cause its officers, employees or agents to take, all affirmative action within its power that may be necessary to ensure that such interest will not become subject to taxation under the Code and applicable Treasury Regulations, as presently existing or as hereafter amended and made applicable to the Bonds. 6.02. No Rebate Required. (a) The City will comply with requirements necessary under the Code to establish and maintain the exclusion from gross income of the interest on the Bonds under Section 103 of the Code, including without limitation requirements relating to temporary periods for investments, limitations on amounts invested at a yield greater than the yield on the Bonds, and the rebate of excess investment earnings to the United States, if the Bonds (together with other obligations reasonably expected to be issued in calendar year 2006) exceed the small -issuer exception amount of $5,000,000. (b) For purposes of qualifying for the small -issuer exception to the federal arbitrage rebate requirements, the City finds, determines and declares that the aggregate face amount of all tax-exempt J bonds (other than private activity bonds) issued by the City (and all subordinate entities of the City) 291520v3 MNI GE190-5 during the calendar year in which the Bonds are issued is not reasonably expected to exceed $5,000,000, within the meaning of Section 148(f)(4)(D) of the Code. 6.03. Not Private Activity Bonds. The City further covenants not to use the proceeds of the Bonds or to cause or permit them or any of them to be used, in such a manner as to cause the Bonds to be "private activity bonds" within the meaning of Sections 103 and 141 through 150 of the Code. 6.04. _Qualified Tax -Exempt Obligations. In order to qualify the Bonds as "qualified tax- exempt obligations" within the meaning of Section 265(b)(3) of the Code, the City makes the following factual statements and representations: (a) the Bonds are not "private activity bonds" as defined in Section 141 of the Code; (b) the City hereby designates the Bonds as "qualified tax-exempt obligations" for purposes of Section 265(b)(3) of the Code; (c) the reasonably anticipated amount of tax-exempt obligations (other than any private activity bonds that are not qualified 501(c)(3) bonds) which will be issued by the City (and all subordinate entities of the City) during calendar year 2006 will not exceed $10,000,000; and (d) not more than $10,000,000 of obligations issued by the City during calendar year 2006 have been designated for purposes of Section 265(b)(3) of the Code. 6.05. Procedural Requirements. The City will use its best efforts to comply with any federal procedural requirements which may apply in order to effectuate the designations made by this section. Section 7. Continuing Disclosure. 7.01. No Requirement of Continuing Disclosure. Participating underwriters need not comply with the continuing disclosure requirements of Rule 15c2-12 promulgated by the Securities and Exchange Commission under the Securities Exchange Act of 1934 (the "Rule"), because the offering is in a principal amount less than $1,000,000. Consequently, the City will not enter into any undertaking to provide continuing disclosure of any kind with respect to the Bonds. Section 8. Defeasance. 8.01. Pledges Covenants and Other Rights to Cease. When all Bonds and all interest thereon, have been discharged as provided in this section, all pledges, covenants and other rights granted by this resolution to the holders of the Bonds will cease, except that the pledge of the full faith and credit of the City for the prompt and full payment of the principal of and interest on the Bonds will remain in full force and effect. The City may discharge all Bonds which are due on any date by depositing with the Registrar on or before that date a sum sufficient for the payment thereof in full. Planning Commission members Jim Lindner, Craig Rafferty, and Derek Wippich were present. Also present were Mayor Emeott, Planner Mark Nolan, and new intern Walter Powell. Tommy Ong and family and Patrick O'Phelan and family were present for the start of the meeting. The meeting came to order at approximately 7:OOPM. Ong/O'Phelan possible subdivision Tommy Ong and Patrick O'Phelan introduced to the Planning Commission ideas involving subdividing their lands into smaller parcels. Such subdivision may require rezoning from current R1 to R3. O'Phelan has approached Jim McNulty as a potential buyer of part of any subdivided land. The potential applicants cite too large of yards and high property taxes as possible reasons why subdivision may be appealing to them, though there are many questions to be addressed prior to any possible consideration by the Planning Commission. Accurate surveys will be required, rezoning criteria were explained, sewer capacity issues were raised. Overall there is a need for serious engineering considerations before this process can move ahead. The commission suggested they obtain copies of Ordinances 43 and 58 along with Comprehensive Plan information as a starting point. The potential applicants should also speak with the city zoning administrators for guidance in the process. The commission also suggested they speak with the Ramsey County taxation staff about possible recourse in lowering taxes. Walter Powell Walter Powell introduced himself as the new city intern hired for 200 hours, primarily to help with the 2008 Comprehensive Plan update, but for the proverbial "other duties as assigned" clause as well. We welcomed Walter as the newest member of the Gem Lake team. PUD Ordinance We reviewed Paul's draft of the PUD ordinance. It is intended as a conditional use permit vehicle rather than an overlay. Mark Nolan has held preliminary discussions with new city attorney on Paul's draft. Mark, Paul, and the attorney will meet to discuss clarifications, edits, intent, language, etc. Craig Rafferty asked about section 13.11 (7) (a) regarding time limits, which will be part of the meeting to revise this draft. RMU Ordinance We discussed how the draft RMU ordinance will accompany the PUD ordinance in certain applications. This ordinance will be primarily associated with PUD in a specific zoning district. Craig inquired about the need for an RMU if we have a PUD, and Paul responded that the RMU will provide the densities desired. The PUD is more general while the RMU is more specific relating to mixed uses. Solomon Group As the discussion drifted to Hoffman's Corners, Paul indicated the Solomon Group was selected as the redevelopment agency with Damon Farber as the landscape architect. 1997 Comprehensive Plan Since RMU is not mentioned at all in the 1997 comp plan, and PUD is only suggested, the City will likely need to amend the 1997 comp plan to allow for actual PUD and RMU authorizations. Mark Nolan will review the needed steps to make sure we have all the necessary provisions in our plan. Obviously these will carry over into the 2008 revised comp plan. Recreational Zoning Recreational Zoning is a missing piece to the current talk of PUD, RMU, and possible parks and trails. Having this district include the golf course will alter the ratio of available residential land and Met Council quotas for housing needs. Mark Nolan will meet with the city attorney to come up with wording for this ordinance. Upcoming Public Hearings With all these proposed changes to the zoning ordinance, there will be mandatory public hearings. By our September meeting (a joint Planning Commission/City Council workshop), we should have draft language for all of these ordinances that will then be ready for public review and comment. Actual public hearings will be determined at the September meeting. City Hall Project Craig Rafferty discussed his work thus far on the City hall joint project with White Bear Township. He presented tentative schedules and discussed how this project could unfold, and how it could grow into something bigger than currently envisioned. Clearly this is an exciting time for Gem Lake/ White Bear Township relations. Schwinn Property Paul introduced the topic that Aaron Schwinn may seek to subdivide part of his six acres currently within the Hunter's Run subdivision. There are some nuances with other properties that Paul identified as a rudimentary PUD enacted by the city many years ago. Craig offered we may be able to work with Hartford as they develop the Hansen parcels to get road access to any possible subdivided lots. Hoeschler/Robins resolution Jim Lindner offered a motion (seconded by Rafferty) that the planning commission recommend the City Council find a way to formally thank Jack Hoeschler and Kathy Robins for their years of service on the planning commission. 1 This would serve as a means of repairing some of the sentiments regarding the departure of these two from the planning commission. Motion passed unanimously. Planning Commission Paul introduced to the commission an idea that the Planning Commission be formally limited to three active and two alternate members. A quorum would be two. Alternates would be called to vote in the absence of one or more members. We agreed this was a viable solution to our membership issue. PLANNING COMMISSION. The report of Interim Planning Chair Lindner is attached. The next Planning Commission meeting will be held in concert with the City Council Workshop on 05 September 2006. Mr. Lindner has asked that the following items be added to the September Workshop agenda: a) Review with SEH of (proposed) PUD and RMU sections for the zoning ordinance. 2. ENGINEER/PLANNER CHANGE: Stephan Higgins has left SEH for a position with the City of Coon Rapids and Mark Nolan has left SEH for a position with Olson Planners. Their replacements have already worked on Gem Lake projects and include Justin Gese as City Engineer and Dan Jochum as City Planner. Justin worked on the Scheuneman Road sewer and Dan Jochum was already working with Mark Nolan and maintains connections to the Metropolitan Council. 3. POLICE. The Contract Cities Sheriff's Group met on Thursday, 17 August 2006. Minutes of the July meeting and the August Agenda are attached. Discussion included tools and weaponry currently deployed, computer connectivity for officers in the field, future use of community service officers, budget and administrative offenses. 4. LEGAL. I spoke with Mr. Kelly today regarding historic perspectives of several members of the business community. At Mr. Schillings request, I have prepared and sent Mr. Kelly a package consisting of all ordinances, all rosters and contact points, proposed open space maps, and other relevant information. I suggested an ordinance review to determine that existing ordinances are adequate for what they regulate be first priority followed by a recommendation on ordinances needed with prepared ordinances to be used where possible. I also suggested Mr. Kelly contact Mr. Gale regarding the next generation of annexation proceedings. 5. PUBLIC RELATIONS. I spoke at length with Barry Zevan on 15 August 2006 providing background, history and opinions. 6. CITY HALL. Craig Rafferty and I met at White Bear Township on Friday, 18 August 2006. Discussion of a pro forma of an RFP, JPA and joint meetings. Craig Rafferty has completed a wonderful RPF presentation using what is obviously tremendous expertise. See meeting portion of agenda. 7. JOB DESCRIPTION. I continue to codify my activities of the last 2 years to determine hours spent on definable projects looking to an Administrators Job Description. I have also searched the International Municipal Managers Association for details. 8. PUBLIC WORKS. Contracts have been reviewed by Mr. Kelly, executed and forwarded to SEH and T.A. Schifsky. All streets are marked, trees have been removed from Haven Lane, and work should begin this week or next. Bonds have been sold and funds will be electronically deposited on August 23`a 9. WATER PLAN. The Water Plan as prepared by Jim Norton and his team from SEH will be presented at the October workshop meeting. 10. FINANCE. A proposed budget will be presented for consideration on 21 August 2006. Said budget should represent our best estimate of next years funding. I have completed an audit of the County Road E/Highway 61 project and sent out appropriate invoices to Vadnais Heights and Ramsey County. I have also completed an audit of the 2006 road improvements and will be reimbursing the General Fund from bond proceeds this week. 1 I . SEWER. A problem with Martin Meier's sewer stub has surfaced. His contractor completed his sewer connection and then after closing the ditch notified Mr. Meier that the connection was too high for pure gravity discharge and that an ejector pump would be necessary in his basement. Mr. Mitchell and I are working on a resolution to the matter. 12. SEWER. Dedication of the Hillary Farm sewer and a fully executed Bill of Sale from Mr. McNulty have been completed. The sewer system at Hillary Farm is now officially owned by Gem Lake. New sewer rates have been accepted without any problems. 13. SEWER. City Engineer, Justin Gese, advises he will complete the sewer maintenance plan and have it ready to receive proposals which in turn should provide for implementation and first services provided in October. • CONSENT AGENDA Staff Report 21 August 2006 14. Affidavits for candidacy for city office are available and may be filed between 29 August 2006 and 12 September 2006 and must be accompanied by a $2.00 filing fee. Office for election include Mayor and 2 Council (Watson & Bosak). State Primary Election on 12 September 2006. Public Accuracy tests of voting equipment are scheduled for 1:00 PM at Ramsey County Elections Office. Election Judge training has been scheduled for 09 September 2006 at my home. 15. ELECTION.
