AMENDED <br />JOINT POWERS AGREEMENT <br />CITY OF SHOREVIEW, MINNESOTA <br />CITY OF ROSEVILLE, MINNESOTA <br />ESTABLISHING AND EMPOWERING <br />THE GRASS LAKE WATER MANAGEMENT ORGANIZATION <br />THIS AGREEMENT is made and entered into the _ day of , 2005 <br />by and between THE CITY OF ROSEVILLE, a municipal corporation and political <br />subdivision of the State of Minnesota and THE CITY OF SHOREVIEW, a municipal <br />corporation and political subdivision of the State of Minnesota. <br />WHEREAS, each City has the authority to manage surface waters within its <br />boundaries pursuant to M.S.A. 412.221, Subd. 6; 444.075 and 462.357, Subd. 1; and <br />WHEREAS, each City may jointly exercise common authority by adopting a joint <br />powers agreement pursuant to M.S.A. 471.59; and <br />WHEREAS, by means of a joint powers agreement, the Cities may establish a <br />water management organization pursuant to M.S. 1038.211 and 103B.227- 1038.252, <br />Inclusive; and <br />WHEREAS, a portion of each City lies within the geographical area hereinafter <br />referred to as the "Grass Lake Watershed ". which watershed is illustrated and described <br />on Exhibit A attached hereto; and <br />WHEREAS, each City is desirous of jointly conducting a water management <br />organization that would adopt a watershed management plan for the Grass Lake <br />Watershed which plan would preserve and use natural water storage and retention <br />systems. <br />NOW, THEREFORE, in consideration of the mutual undertakings herein <br />expressed, the City of Roseville and the City of Shoreview agree as follows: <br />
