NOW, THEREFORE, BE IT FURTHER RESOLVED that: <br /> 1. The Roseville City Council finds that the easement vacation has no relationship to <br /> the City's Comprehensive Plan and therefore the Roseville City Council has <br /> dispensed with the requirements of Minnesota Statutes §462.356, Subd. 2; <br /> 2. The vacation applies only to that portion of the public storm sewer easement <br /> legally described above and not: (a) the rights of other existing utilities, if any, as <br /> provided in Minnesota Statutes §161.45, Subd. 3, or(b) any other easements <br /> running to or benefitting the City of Roseville; and <br /> 3. The City Manager is directed to record a notice of completion of these vacation <br /> proceedings pursuant to Minnesota Statutes §412.851. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Council <br /> Member Willmus and upon vote being taken thereon, the following voted in favor: McGehee; <br /> Pust; Johnson; Willmus; and Roe; <br /> and none voted against. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br /> Page 2 of 3 <br />
