Business Items—Presentations/Discussions <br /> a. Discuss Updates to the Erosion and Sedimentation Control Ordinance <br /> City Engineer Debra Bloom noted updates to the City's current Erosion and Se- <br /> dimentation Control Ordinance, adopted in 2008, as detailed in the RCA dated <br /> August 8, 2011. Ms. Bloom advised that some of the additional language was a <br /> result of the recent MPCA audit of the City, as well as from practical application. <br /> Ms. Bloom noted that the Public Works, Environment and Transportation Com- <br /> mission had reviewed the current draft and recommended approval. Ms. Bloom <br /> clarified that tonight's presentation was for discussion only; and no formal City <br /> Council action was requested until a future meeting. <br /> Ms. Bloom reviewed the proposed changes as outlined in the redlined copy of the <br /> ordinance (Attachment A); with fees adjusted to cover staff time from escrow <br /> funds for any additional inspections or lack of compliance found; as well as mov- <br /> ing the ordinance to Section 800 of City Code in the area dealing with storm sew- <br /> ers; rather than in the previous location in the City's Zoning Code, since it was re- <br /> lated more to storm water permitting rather than zoning. <br /> Discussion among Councilmembers included the notification section (page 7, II) <br /> and whether e-mail notification was satisfactory under law, with City Attorney <br /> Gaughan confirming that it was satisfactory; and the need for consistency regard- <br /> ing such notice by the City within 48 hours with Page 6 as well. <br />
