DATE. 11/8/99 <br />ITEM NO. c- <br />Department Approval: Manager reviewed: Agenda Section: <br />C L"t— Consent <br />Item Description: Approval of earnest money contracts for easements needed for <br />City Project. 98 Dale Street/ Ros elawn Avenue Pathway. <br />Background: The City is currently completing plans and specifications for the construction of a 2.4 teeter <br />foot) wide bituminous s trail along Dale Street and Rosclawn Aventie as approved by the City Council <br />following a public hearing in July. Construction of this project is scheduled to begin April 2000. The <br />prpject, as designed, rewires that the pity acquire permanent and temporary right-of-way from 1 properrties. <br />To date, 12 signed easements and earnest money contracts have received Council approval. we have received <br />two additional signed easement and earnest money contrast for Council approval. The location of these <br />properties is shown on the attached map. A table outlining the rcmaining right-of-way needs is also attached. <br />In order to develop this project by the 1999 deadline, all needed right-of- roust be secured by Decemb <br />The rem 4 properties are institutional and we are warping with their boards to secure the rights to <br />construct the pathway. we are not pursuing the acquisition of these final 4 easements by e dom ain. <br />We will faring additional earnest money contracts and easements for Council approval as we receive there. <br />Financial implications: The attached table summarizes the right -of -way needs for this prq j ect. As the <br />negotiations continue this table is updated. At this throe, the total estimatcd right -of -war cost is 86,725.00, <br />and will be financed through pathway funds. <br />Because this project proposes to utilize federal dollars, the project must be developed in accordance with <br />federal &delines. Typically, federal projects take more time and are more costly to develop due to detailed <br />plan requirements and strict right -of -way a.cgmsition procedures. By accelerating this project to 1999, <br />however, we are able to realize an additional $624,000 in federal construction participation beyond the <br />originai grant. <br />Staff recommendation: Council approval of the following earnest money contracts and easements <br />Easement property owner Address Temp.
