REQUEST FOR COUNCIL ACTION <br />DATE: E. 10/25/99 <br />ITEM INTO„ C_ 3 <br />Department Approval: Manager Reviewed: Agenda Section: <br />A C/�� Consent <br />Item w <br />Approval of earnest money contracts for easements needed for <br />City Project 98 -11 Dale Street/ Roselawn Avenue Pathway. <br />Ba ground: The City is currently completing plans and specifications for the construction of a 2.4 meter <br />(8 foot) wide bi trail along Dale Street and loselawn Avenue as approved by the City Council <br />following a public hearing in July. Construction of this project is scheduled to begin April 2000. The <br />project, as designed, requires that the City acquire permanent and temporary right -of way from 18 <br />properties. To date, 11 signed easements and ea money contracts have rece Council approval. we <br />have received one additional signed easement and earnest money contract for Council approval. The <br />location of these properties is shown on the attached map. A table outlining the remaining right way <br />needs is also attached. <br />In order to develop this project by the 19 deadline, all needed right of must be secured by December. <br />This is the final residential easement that the City needs to secure. The remaining 6 properties are <br />institutional and we are working with their boards to secure the rights to construct the pathway. we are not <br />pursuing the acquisition of these final 6 easements by eminent domain. we will bring additional earnest <br />money contracts and easements for Council approval as we receive then. <br />Financial implications: The attached table summarizes the right -of- -way needs for this project. As the <br />negotiations continue this table is updated. At this tine, the total estimated right -of -way cost is <br />86,725 .00, and will be financed through pathway funds. <br />Because this project proposes to utilize federal dollars, the project must be developed in accordance with <br />federal guidelines. 'Ideally, federal projects tape more time and are more costly to develop due to <br />detailed plan requirements and strict right-of-way acquisition procedures. By accelerating this project to <br />1999, however, we are able to realize an additional 624,000 in federal construction participation beyond <br />the original grant. <br />Std recommendation: Council approval of the following earnest money contracts and easements: <br />Easement Property owner Address Temp.
