City to receive, at no cost, up to 10 Ricochet basic service subscriptions for City use. <br /> The value of this item is approximately $4,200 per year. <br /> - City agreement review costs to be reimbursed. <br /> • Most-Favored Municipality Clause <br /> - Agreement will be modified if a better deal is given to any comparable city within the <br /> metro area. <br /> • Nonexclusive Use <br /> - The agreement does not preclude other providers from offering similar services in <br /> Roseville. <br /> This agreement has been thoroughly reviewed by the City Attorney and attorneys from the <br /> League of Minnesota Cities and Suburban Rate Authority. <br /> policy objectives: Utilities within public right-of-ways are governed by the City's Right-of-way <br /> Management Ordinance (Chapter 707 of the City Code) or, as is the case with natural gas, <br /> electric and cable TV, by individual franchise agreements. The proposed Metricom agreement is <br /> not a franchise agreement and does not supercede the requirements of the Right-of-way <br /> Management Ordinance. Rather, it proposes to pay a rate equal to or higher than that required in <br /> the Right-of-way Management Ordinance as compensation for City management costs. <br /> Financial implications: The total anticipated revenue from this agreement is fairly modest. <br /> However, without the agreement, the City would be limited to fees collected through the Right- <br /> of-way Management Ordinance. If the revenue collected through the agreement is less than the <br /> fees that would be collected through the Right-of-way Management Ordinance, the City has the <br /> option to utilize the Right-of-way Management Ordinance. <br /> RECOMMENDED COUNCIL ACTION: <br /> Approval of an agreement with Metricom, Inc. to allow the installation of a wireless <br /> communications network in Roseville and authorizing the Mayor and Manager to sign the <br /> agreement on behalf of the City. <br /> Prepared by: Karl Keel <br />
