REQUEST FOR CITY COUNCIL ACTION <br /> DATE: 8/1 4/00 <br /> ITEM NO: F-2 <br /> QMartrpqnt Approval: Ci anaaer Approval: Agenda Section <br /> Reports <br /> Ite Description: RESOLUTION AUTHORIZING ENTRY UPON PARCEL OF LAND <br /> RELATED TO TWIN LAKES REDEVELOPMENT PROJECT FOR <br /> ENVIRONMENTAL TESTING <br /> 1.0 REQUESTED ACTION <br /> 1.1 To enable the proper planning for the construction of the Twin Lakes Parkway as <br /> part of the Twin Lakes Redevelopment area, staff is requesting the approval of a <br /> resolution authorizing the legal entry onto the Indianhead property for <br /> environmental testing. <br /> 2.0 BACKGROUND <br /> 2.1 Environmental consultants, working with the City Attorney, have been trying to <br /> secure permission from Regor, Inc., owners of the site, and TIP, lessee of the site, <br /> over the past 6 months. Although TIP has given written permission, Regor has not <br /> been cooperative. <br /> 2.2 Despite numerous attempts by the City Attorney's office, Regor refuses to permit <br /> the City's staff and consultants on the project to enter upon the Property for <br /> purposes of environmental testing. <br /> 2.3 The US EPA's $200,000 grant to complete Phase I and Phase II studies in connection <br /> with the Twin Lakes Parkway expires in the fall of 2001. It is essential to keep the <br /> momentum going on the project to meet the grant deadlines and secure the grant <br /> dollars for the project. <br /> 2.4 Phase I studies on all the other affected parcels are complete. The Phase II work <br /> plan is in the process of being review, minus the Indianhead property. <br /> 2.5. The alignment of the officially mapped Twin Lakes Parkway runs along the north <br /> side of the Indianhead property and the taking for the road right of way would <br /> include the back warehouse building on the property. <br /> 3.0 STAFF COMMENT/RECOMMENDATION <br /> 3.1 The Twin Lakes Parkway is critical to the long-term success of the entire Twin Lakes <br /> Redevelopment Area. The Indianhead Parcel is a key component for the <br /> construction of the Twin Lakes Parkway. <br /> RCA Parcel Access (8/14/00)- Page 1 of 2 <br />
