REQUEST FOR COUNCIL ACTION Date: 11/13/00
Item No.: J--1
Department val: Manager Ap roval: Agenda Section:
Ordinances and Resolutions
Item escription: First Reading of Proposed Changes in Roseville Liquor License Requirements
AND Resolution Revising the Schedule of Offenses and Administrative
Penalties.
BACKGROUND
The proposed changes have been discussed at six Council meetings this year. At the September 18,
2000 Council Work Session there was consensus to adopt the following Liquor License Changes: 1)
licensee fine forgiveness for the first violation if the establishment provided approved Optional
Manager and Server Training, 2) receipt requirements for home delivery, 3) increased fines for the
licensee and individual seller. The fines will differentiate for off sale and on sale violations.
Currently, there are no violation options by a licensee for the first offense. They must pay a fine. A
rather small fine compared to neighboring cities. Burnsville suspends for three days for the first
offense, Plymouth imposes a$500 fine and a five day suspension for the first offense, Woodbury
imposes a warning letter for the first offense, a$2,000 fine for the second offense. Falcon Heights,
Little Canada,New Brighton,N.St. Paul, Shoreview and Vadnais Heights use the state statute for a
first offense -up to a 60 day suspension and/or up to a $2000 fine. The Council indicated a desire
to substantially raise the fine for the license holder and individual sellers with a differential for off-
sale sellers who do not earn tips to augment their salary.
The attached Council Resolution relating to the administrative fine structure raises the individual
seller fine from $100 to $250 for an on-sale employee and $150 for an off-sale employee. The fine
for the first violation for a license holder is raised from $150 to $500.
Licensee holders have stated they try their best to comply with the laws regarding legal sales, but
they say they are penalized for their employee actions. Licensee holders are resnonsible for their
employee's actions. This ordinance change allows two violations before a suspension is imposed.
That is an incentive. Responsible beverage service training is something that should be done on a
routine basis, if for no other reason than to reduce the licensee holder's civil liability. This ordinance
supports such training and gives financial incentives to supply such training.
As noted in prior council presentations, our compliance checks are improving. We have not had
100% compliance yet. That is not an unreasonable goal. The proposed ordinance changes are an
effort to build on that success and assist responsible license holders.
