L
REQUEST FOR CITY COUNCIL ACTION
DATE: 04/26/99
ent Approval: Manager Approved: Agenda Section:
/tp O-M,t LAND USE
It oscription: Boaters outlet, Inc., o5 west County Road 2, request for a.Interim Use
Permit. (PF31 11)
1.0 Requested diction
1. Boaters outlet,Inc.,2205 West County Road C.2,has submitted an application for an Interim
Use Permit to allow an owner to buyer lot during the summer month, weekends only, on a
vacant parcel located adjacent 2205 west County Road C.2. The site is zoned Light
Industrial (11).
2.0 Background
1. Section 101 2.09A states: the City Council may authorize an interim use permit of
property. Interim use may not be consistent with the land uses designated on the adopted
Land Use Plan. They may also fail to meet all of the zoning standards established for the
district within which it is located.
2. Section 1012.09E states: the City Council may attach conditions to interim use permits.
In reviewing interim use permit applications, the City will establish a specific date or
event that will terminate the use on the property. The Council will also determine that the
approval of the interim use would not result in adverse effects on the public health, safety
and general welfare, and that it will not impose additional costs on the public if it is
necessary for the public to take the property in the future.
3. Due to its location directly underneath the N P high voltage lines, the 1.92 acre parcel
has a limited use
4. In 1 997 an interim use permit was granted on the subject parcel to allow Burger Transfer
to store true trailers.
5. In association with the inter'rn use permit, the parcel was cleaned, properly filled, graded
for appearance, and fenced to meet City and Rice Creep Watershed specifications.
6. Each year the City Code staff corrects numerous vehicle complaints, many of which
relate to "for sale by owner', vehicles parked on grass or other non-conforming sites. In
1998,there were over 280 vehicle complaints. So far in 1399,there have been 88 similar
complaints. A, sales outlet may assist in reducing some of these vehicle issues,
PF3111 -RCA 04-26-99)Page 1 of 4
