(PF3104). <br /> At the March 22, 1999 meeting, the City Council continued action on this item <br /> until the date specific of April 26, 1999. At the same meeting the City Council <br /> also adopted an Interim Ordinance (moratorium) and modified it on April 12 as <br /> ordinance No 1220, temporarily prohibiting development for certain parcels <br /> within "SC's (shopping center) zoning districts. <br /> 1.0 REQUESTED ACTION <br /> 1.1 Bradley Operating Limiting Partnership is requesting the vacation of certain utility an <br /> drainage easements located southeast of the fonner Homeplace structure within the parking <br /> lot of Har Mar Mall. (legal description attached) <br /> 2.0 BACKGROUND <br /> 2.1 This specific request by Bradley operating Limited Partnership is based on their future Mans <br /> to redevelop the former Homeplace store with a 75,000 + square foot Cub Food grocery <br /> stare. The proposal calls for a new utility easement to be established directly adjacent the <br /> current easement and for the existing utilities to be relocated to the new easement. once <br /> relocated, fte.existing easement area identified on the attachment will no longer be needed. <br /> 2.2 Section 1013.04 outlines the procedure for vacating streets, alleys,and easements. A public <br /> hearing is required. The Planning omniission bolds the hearing and recommends a vacation <br /> action to the City Council. <br /> 3*o STAFF COMMENT <br /> 3.1 Previously, star'had indicated that the proposed easement was adequate to accommodate t ie <br /> reconstruction of the existing utilities and that the Engineering Department would continue <br /> to work with Westwood Professional Services on an acceptable utility design. The recent <br /> enactment of the moratorium affecting this parcel has changed our position. Because it is <br /> uncertain whether the moratorium study and report will impact or affect the proposed Cub <br /> Food.7 staff is of the opinion that the vacation request is premature. <br /> PF3 104-RCA(04-205-99)—Page 1 of 2 <br />
