DRAFT <br /> City of Roseville <br /> Planned Unit Development Agreement <br /> A lEE IE TT, dated March 22, 1 999, between the City of Roseville, a Minnesota mu w'cipal <br /> corporation (herein referred to as "CITY"'), and Cox Insurance Associates, Incorporated, a <br /> Minnesota Corporation(herein referred to as "DEVELOPER"). <br /> 1.0 Effective tive Date of Agreement <br /> This agreement shall be effective upon completion of the following: 1)passage and publication of <br /> ordinance # (Rezoning of Property to PUD); ) publication of the ordinance in the IT 's <br /> official newspaper; ) execution of this agreement by the CITY and the DEVELOPER; and 4) <br /> recording of this agreement with Ramsey County. <br /> 2.0 Request for Planned Unit Development Approval <br /> The DEVELOPER has asked the CITY to approve a Planned Unit Development(PUD) (PF#'.3092) <br /> consisting of a 4,929 s.f office business on the parcel of property currently occupied by a barber <br /> shop,travel agency and rental unit. The subject property is located at 3116 Fairview Avenue, and <br /> xs legally described as follows: <br /> (PID 04 31 0001) <br /> Commencing at the Northwest corner of the Northeast Quarter of Section4, <br /> Township 29, lunge 23; thence east 200.00 feet; thence south 133.00 feet; thence <br /> west 200.00 feet; thence north 133.00 feet to the point of beginning. <br /> 3.0 Planned Unit Development Approval <br /> The CITY hereby grants approval of the final development plan for Cox Insurance Associates, <br /> Incorporated, subject to the DEVELOPER's compliance with the terms and conditions of this <br /> agreement. The CITY agrees to approve applications for building permits,provided that said plans <br /> are consistent with the exhibits which were approved at the concept and final stage of the Planned <br /> Unit Development process (located in Appendix A),the DEVELOPED has not defaulted, and all of <br /> the standards and conditions of this agreement have been satisfied. <br /> For three(3)years from the slate of this Agreement,no amendments to the CITY'S Comprehensive <br /> Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br /> dedication requirements of the land included within the Planned Unit Development unless required <br /> by state or federal law or agreed to in writing by the CITY and the DEVELOPER. -For any <br /> improvements proposed thereafter,notwithstanding anything in this Agreement to the contrary,the <br /> CITY may rewire compliance with any amendments to the City's Comprehensive wide Plan, <br /> official controls,platting or dedication requirements enacted after the date of this Contract. <br /> 1 <br />
