(,o ntract No. SG-98-123 <br /> TWIN CITIES WATER QUALITY INITIATIVE SPECIAL 'PROJECT <br /> GRANT AGREEMENT ENT BETWEEN THE METROPOLITAN COUNCIL <br /> H <br /> THE CITY of ROSEVILLE <br /> TRIS AGREEMENT is made and entered into by and between the Metropolitan Council (the "Council") <br /> and the City of Roseville (the "Grantee"), each acting by and through its duly authorized officers. <br /> WHEREAS,on November 18, 1 993, the Council approved a memorandum of understanding (" ou") <br /> between the Council, the former Metropolitan waste Control Commission, and the Minnesotan Pollution <br /> Control Agency("MP A"); and <br /> WHEREAS, the MOU requires that the Council establish an administrative process and eligibility <br /> criteria for projects that may be funded under a financial assistance program established in the MOU, and <br /> VV EREA , pursuant to this requirement in the MOU, the Council has approved the Twin Cities Water <br /> Quality Initiative ("TCQF') Grant Program to provide financial assistance to reduce. control, and prevent <br /> nonpoint sources of pollution to metropolitan area rivers and streams, with a focus on the Mississippi, <br /> Saint Croix, and Minnesota Rivers; and <br /> MrFIEREA , the TC 1 Grant Program provides for TC 1 Special Project Grants by which grantees use <br /> TC 1 grant funds to implement and evaluate special projects designed to address n onpo int source <br /> pollution problems or control measures; and <br /> WHEREAS, the Grantee is eligible to receive a TI Special Project Grant and has submitted all <br /> application for a TCQ1 Special Project Grant; and <br /> WHEREAS,the Council has reviewed the application and desires to assist the ('1rantee by the award of a <br /> TI Special Project Grant. <br /> NOW,THEREFORE,the Council and the Grantee agree as follows: <br /> GRANTEE PERFORMANCE of GRANT PROJECT <br /> 1.01 Gr.2nt Project Activities. The Grantee agrees to perform and complete i n t satisfactory <br /> and proper manner the grant project as described in the Grantee's application for grant assistance, <br /> incorporated in this agreement by reference, and in accordance with the terms and conditions o f t h i s <br /> agreement. Specifically,the Grantee agrees to perform the work program activities described its Exhibit <br /> A, which is attached to and incorporated in this agreement. After the work Flan described in paragraph <br /> 5.01 has been approved brthe Council, the Grantee agrees to conduct the work program activities in <br /> compliance with the approved work Plan. The Grantee may engage contractors to perform work <br /> program activities with prior approval of the Council, However, the Grantee re tains primary <br /> responsibility to the Council for performance of the grant project. <br /> 1.02 Material Representations. The Grantee agrees that all representations contained i its <br /> application for grant assistance are material representations of fact upon which the Council relied in <br /> awarding this grant and are incorporated in this agreement by reference. <br />
