(Planning Commission - hearing on concept development plan), October 14, 1998 (Planning <br /> Commission - continued hearing concept development plan), October 26, 1998 (City Council — <br /> approval of concept development plan), February 8, 1999 (City Council - action on final <br /> development plan)to consider various aspects of the Planned Unit Development, including rezoning <br /> of the subject property from R-I Single Family Residential to PUD Planned Unit Development. The <br /> CITY agrees to rezone the subject property to PIED, subject to the DEVELOPER's strict compliance <br /> with the approved plans, and the terms and conditions of this agreement. Minor variations from the <br /> approved final development plans, which are consistent with this agreement and the underlying B-1 <br /> zoning district, may be approved by the CITY s Development review Committee, under the <br /> direction of the Commmiky Development Director. Substantial departures from the approved final <br /> development plans will rewire an amendment to the Planned Unit Development in accordance with <br /> Section 1015 of the Roseville Zoning ordinance. where not superseded by more restrictive <br /> requirements of this PUD, the standards of the underlying B-I (Limited Business) zoning district <br /> shall apply, as stated in Chapter 1005 of the Roseville City Code. <br /> 6.0 Development of Property <br /> Failure by the DEVELOPER to commence development activity} in accordance with the final <br /> development plans,within one year following the final approval of this Planned Unit Development, <br /> will necessitate the approval of an extension of the development schedule by the City Council prior <br /> to the expiration of the one year period. If an extension is not applied for,the Council may instruct <br /> the Planning Commission to initiate rezoning to the original -1 zoning district. For purposes of <br /> this provision, development activity shall be defined as obtaining a building permit and beginning <br /> construction on the site. <br /> Development of the property and installation of improvements shall be in accordance with the <br /> development schedule provided by the DEVELOPER and approved by the CITY (Exhibit F). <br /> 7.0 Compliance with Laws and Regulations <br /> The DEVELOPER represents to the CITY that any site improvements pursuant to the proposed <br /> Development will comply with all City,County,regional,Metropolitan, State, and Federal laws an <br /> regulations, including but not limited to the Roseville Subdivision Regulations,the Roseville Zoning <br /> Regulations, and all other applicable environmental regulations. The DEVELOPER agrees to <br /> comply with all such laves and regulations. <br /> 8.0 Site Development Requirements <br /> To ensure that the proposed development meets the CITY'S requirements and standards for site <br /> development, the following provisions shall apply: <br /> 8.1 Final Grading Plan. The final grading plan for the property must be reviewed and approved <br /> by the Director of Public Works prior to any permits being issued for the building addition <br /> on the southern parcel. All grading shall comply with the approved grading plans and shall <br /> be the responsibility of the DEVELOPER. The DEVELOPER'S engineer shall pLovide to <br /> the CITY a letter certifying that the gradin_proj ect as constructed, was completed as <br /> PUD Agreement#�(Charles Cabinet)-Page 3 of 10 <br />
