i Request For City Council Action DATE: 01.25.99 ITEM NO: I�2 artmen Approval: er Approved: Agenda Section: ir LAND USE Ae9w Description: Midas Muffler Renovation,2168 Smelling Avenue North 1.0 Background In 1989 the City Council approved a Conditional Use Permit to allow reconstruction of the shop located at the northeast corner of Snelling Avenue and County load E. A portion of that conditional Use Permit required that the building be constructed of brick and white facia-but not yellow.The signage plans were to be reviewed by staff. 2.0 Midas Request Mr. ,Joe Stranik has requested approval to renovate the existing structure within the constraints of the 1989 CUP. He requested direction regarding trademark color coordination. Midas is changing its franchise color to red instead of yellow. Mr.Stranik is proposing new awnings,signage, and potentially building trim in a red color. 3.0 Staff Comment Planning staff reviewed the proposal and the commercial neighborhood near the Midas shop. Red is a trim color on Target,Famous Dave's*Arby's and some signage in Har Mar. 4.0 Staff Recommendation Staff recommends approval of the Midas renovation within the 1989 CUP as consistent and minor in nature and proposes to issue permits to allow such renovation. The City Attorney has reviewed this proposal,before the proposed color was changed from yellow to red. 5.0 Suggested Council Action Staff prepared this overview to inform the Council regarding this renovation. Unless otherwise directed,the staff proposes to issue permits as necessary. By motion,approve the minor amendment to the 1989 Conditional Use Permit to allow renovation and the use of red color for trim,awnings and signage on the Midas building located at 2168 Snelling Avenue forth.
