JOINT POWERS A RE MIE T <br /> LAKE JOSEPHINE <br /> WATER SPACE USE <br /> 1.0 Parties. This Agreement is made and entered into by and between the City <br /> of Arden Dills, a municipal corporation and political subdivision of the State of Minnesota, <br /> (herein "Arden Hills"), and the City of Roseville, a municipal corporation and political <br /> subdivision of the StAte of Minnesota ("herein "Roseville"). <br /> 2.0, recitals. Lake Josephine is located within the corporation boundaries of <br /> Arden Hills and Roseville and has a large public access for boats. The waters of Lake Josephine <br /> are used ctensively by the public for boating, fishing and other recreational purposes. <br /> Regulation of boating traffic on Lake Josephine is necessary in order to protect the <br /> health, safety and welfare of the residents of Arden)"Tills and Roseville who reside on properties <br /> surrounding Lake Josephine and of those people who use Lake Josephine for recreational <br /> purposes. By means of this Joint Powers Agreement adapted pursuant to Mul ln. Stat. §§ 459.20 <br /> and 471.59, Arden Dills and Roseville will establish guidelines applicable to the adoption of <br /> ordinances by each City restricting the speed and use of motorboats on Lake Josephine. <br /> 3.0. Terms_--and Conditions. In consideration of the mutual undertakings herein <br /> expressed, Arden Hills and Roseville agree as follows: <br /> A. Each City shall adopt an ordinance which incorporates the following guidelines: <br /> 1. Adopts the definitions of Minn. Stat. §86B.005. <br /> 2. Motorboat speed on Lake Josephine shall not exceed forty miles per hour <br /> (40 mph) which speed limit shall be in effect 24 hours per day. <br /> 3. No person shall operate a motorboat or be towed on water skis or a <br /> similar device at greater than a slow-no wake speed within 150 feet of <br /> shore. Launching or landing a skier by the most direct route to open <br /> water shall be exempt from this provision. <br /> 4. Except when operating at slow, no-wake speeds, all motorboats shall <br /> travel and be operated in a counter-clockwise direction around Lake <br /> Josephine. <br /> 5. Persons operating a motorboat, and those being towed on water skis or a <br /> similar device shall, at all tines, maintain an adequate distance <br /> (considering speed and conditions)from other watercraft, swimmers, swim <br /> rafts and docks, so as to avoid an accident. when a swimmer is present, <br /> motorboats or persons being towed on water skis or a similar device, shall <br /> 1 <br />
