P. "Lockout Device" means an optional mechanical or electrical accessory to <br /> a Subscriber's terminal which inhibits the viewing of a certain program, <br /> certain channel, or certain channels provided by way of the Cable <br /> Communication System. <br /> Y11 <br /> q. "'Memorandum emorandum of Understanding 9' or "MOST" means that certain agreement <br /> dated November 3, 1994 regarding PEG access funding, creation of a <br /> "PEG Fee" and certain rate regulatory issues. <br /> r. "North Suburbs Acces5 Colporation" means that certain non-profit <br /> corporation or its lawful successor, designee, or assignee, which is <br /> delegated authority and responsibility for providing certain community <br /> programming functions including public access. <br /> S. "North Suburban tern" means the Cable System located in those <br /> municipalities collectively comprising the North Suburban Cable Service <br /> territory as originally approved by the Minnesota Cable Communications <br /> Board. <br /> t. "Pay elevision" means the delivery over the System of pay-per-channel <br /> or pay-per-program audio-visual signals to Subscribers for a fee or charge, <br /> in addition to the charge for Basic Cable Service or Cable Programming <br /> Services. <br /> U. f'P rson" is any person, firm, partnership, association, corporation, <br /> company, or other legal entity. <br /> V. "Pro l" means the Proposal for Franchise Renewal dated May 13, 1997, <br /> submitted to the North Suburban Cable Communications Commission by <br /> Group w Cable of the North Suburbs, Inc., as amended by the revised <br /> Renewal Proposal submitted under cover letter dated August, 4, 1997, and <br /> related correspondence and prior agreements or resolutions which are <br /> attached hereto as Exhibit A. <br /> W, "Riah -of way" or "l ig ts-of-Way" means the area on, below, or above <br /> any real property in City in which the City has an interest including, but <br /> not limited to any street, road, highway, alley, sidewalk, parkway, park, <br /> skyway, or any other place, area, or real property owned by or under the <br /> control of City, including other dedicated Rights-of-Way for travel <br /> purposes and utility easements. <br /> X. 6& ight-of-Way ordin }}means the ordinance codifying requirements <br /> regarding regulation, management and use of Rights-of-Way in City., <br /> including registration and permitting requirements <br /> 4 <br />
