2.5 Section 10122.09 of the City Code outlines the provisions for interim uses. An interim <br /> use is not required to be consistent with the land use designation identified in the <br /> Comprehensive Plan, nor is it required to meet all of the zoning standards <br /> established for the district in which it is located. I n reviewing a request for an interim <br /> use permit, the City may attach conditions and will establish a specific date or event <br /> that will terminate the use on the property. In granting an 'Interim use permit, the <br /> Cfty Council must also determine that the approval of the interim use permit will not <br /> result in adverse impact on the public health and welfare, that the operation is safe <br /> to the public, and that there are no additional costs added to the site that would <br /> deter a permanent use at a later time. <br /> 0 STAFF COMMENT <br /> 3.1 In reviewing this request, staff made the following findings: <br /> 1. The continued use of the existing temporary building for an additional three <br /> years will not have an adverse impact on the public health and welfare. <br /> 2. The continued use of the existing temporary building for an additional three <br /> years gill not pose a threat to the public safety. <br /> 3. The continued use of the existing temporary building for an additional three <br /> years will not deter a permanent use at a later time. <br /> 4.0 STAFF RECOMMENDATION <br /> 4.1 Based on the findings outlined in section 3.1 of this report, staff recommends <br /> approval of the request for a three-year extension of an interim use permit to allow <br /> pp <br /> the continued use of one 24' x 70' temporary building for office space at 2701 Rice <br /> Street North, with the following conditions: <br /> r The general location and appearance of the temporary building cannot be <br /> changed. If the building is replaced, the appearance of any new building <br /> must be compatible with the permanent structures on the property. A <br /> second temporary building would net be allowed on the site without an <br /> amendment to this interim use permit. <br /> 2. The interim use permit shall be for a period for three years and shall expire <br /> on August 30, 2001. <br /> 5.0 PLANNING COMMISSION ACTION <br /> 5.1 The Planning Commission held a public hearing on this request on Wednesday, July <br /> 8, 1998. Orlando Logelin, Forth Heights Lutheran church, was present to answer <br /> questions and provide additional information.
