JOINT POWERS AGREEMIENT <br /> LAKE JOSEPHINE <br /> WATER SURFACE USE <br /> 1.0 Parties. This Agreement is made and entered into by and between the City <br /> of Arden Hills, a municipal corporation and political subdivision of the State of Minnesota, <br /> (herein "Arden Hills"), and the City of Roseville, a municipal corporation and political <br /> subdivision of the Sta.te of Mimesota ("herein "Roseville")d, <br /> 2.0. recitals. Lake Josephine is located within the corporation boundaries of <br /> Arden Hills and Roseville and has a large public access for boats. The waters of Lake Josephine <br /> are used extensively by the public for boating, fishing and other recreational purposes. <br /> Regulation of boating traffic on Uke Jos,!�phine is necessary in order to protect the <br /> health, safety and welfare of the residents of Arden Hills and Roseville who reside on properties <br /> surrounding Lake Josephine and of those people who use Lake Josephine for recreational <br /> purposes. By means of this Joint Powers Agreement adopted pursuant to Minn. Stat. §§459.20 <br /> and 471. 9, Arden Hills and Roseville will establish guidelines applicable to the adoption of <br /> ordinances by each City restricting the speed and use of motorboats on Lake Josephine. <br /> 3.0. Terns and Conditions. In consideration of the mutual undertakings herein <br /> expressed, Arden Mills-and Roseville agree as follows: <br /> A. Each City shall adopt an ordinance which incorporates the following guidelines: <br /> 1. Adopts the definitions of M inn. Scat. §8613.005. <br /> 2. Motorboat speed on Lake Josephine shall not exceed forty miles per hour. <br /> (4o mph) which speed lit shall be in effect 24 hours per day. <br /> 3.. No person shall operate a motorboat or be toured on water skis.. or a <br /> similar device at greater than a slow-no wake speed within 150 feet of <br /> shore. Launching or landing a skier by the most direct route to opera <br /> water shall be exempt from this provision. <br /> 4. Except when operating at slow, no-wake spas, all motorboats shall <br /> -travel- and be operated in a counter-clockwise direction around Lake <br /> Josep". <br /> -. <br /> 59- .Persons. operating a motorboat, and those being towed on water skis or a <br /> sirnilr deie shall, at all times, maintain an adequate- distance <br /> (considering speed and-conditions)froln other watercraft, swirnmers, swim <br /> rafts end doic1 ,;s6 as to avoid an accident. when a swimmer is present, <br /> motorboats or persons being towed on water skis or a similar device, shall <br />
