REQUEST FOR COUNCIL ACTION <br /> DATE: 7/13/98 <br /> ITEM O.: <br /> Manager Reviewed: Agenda Section: <br /> Ordinances and Resolutions <br /> Item Description: Right-of-Way Management ordinance <br /> Background: over the past few months, the City Council has been considering the adoption of a <br /> new ordinance that would change how the City manages fight-of-ways. The current draft of the <br /> r inance is based on a model ordinance prepared by the League of Minnesota Cities. This <br /> ordinance � F <br /> ordinance was last considered by the City Council at its Jute 8, 1998 meeting, at which time the <br /> Council continued consideration to the July 13, 1998 meeting to allow adoption of this ordinance <br /> to coincide with the Cable TV, NSP Gas and NSP Electric Franchise agreements. <br /> The proposed ordinance w� apply to all utility operations in public right-of-ways including gas, <br /> p P pF <br /> electric, telephone, cable T , municipal sever-and water and private utility contractors. The <br /> proposed ordinance will allow the City to manage the location, construction, repair and <br /> maintenance of utilities to ensure that public interests are protected. In many ways, the proposed <br /> right-of-way management ordinance will allow cities the same control over previously unregulated <br /> right-of-way users that gas and electric franchises have allowed in the past.
