2.3 It is also the policy of the City of Roseville to issue minor variances when there is <br /> a hardship or practical difficulty, provided the property is located in an R-1, Single <br /> Family Residential District, and used for residential purposes. <br /> 2.4 Section 1004.01(A), City Code, indicates that an accessory building cannot occupy <br /> more than 5 of the required rear yard. section 1004.02(D)(4) requires a corner <br /> side yard setback of no less than 30 feet. <br /> 3.0 VARIANCE COMMIT <br /> 3.1 The request for the variance included the required application forma a sketch of the <br /> property, a written statement from the applicant, and written approval from the <br /> adjacent property owner affected by the variance (Agnes Gibson at 2143 Midlothian <br /> Road). <br /> 3.2 The Minor Variance Committee reviewed this request on Monday, June 1 t 1998. <br /> Ms. Dobesh was present to review her proposal and answer questions. The project <br /> was discussed, including the physical hardship created by the property being <br /> located on a corner, the physical hardship created by the mature trees in the rear <br /> yard, and the practical difficulty of moving the garage to another location on the <br /> property. Ms. Dobesh originally proposed a 1 008 square foot garage set back the <br /> same distance as the existing garage (19'). The Minor Variance Committee was not <br /> supportive of the original request; therefore, Nis. Dobesh agreed to modify her <br /> request to reduce the depth of the garage from 8' to 22'. This ' x 36' garage wi I I <br /> provide her with the storage space she needs and will allow the setback from <br /> County Road B to be increased to 25 feet. This reduction in size also reduces the <br /> lot coverage from 5 to 7%. The width of the driveway will not exceed 26 feet <br /> at the property line and the applicant will have adequate turn around space on her <br /> property to access County Road B head on. Alternative locations for the garage <br /> were discussed, with the Minor variance Committee concurring that the <br /> location and size as proposed are the best options from both a functional and <br /> aesthetic standpoint. <br /> 3.3 The Minor variance Committee unanimously recommended approval of a minor <br /> variance to reduce the corner side yards setback to 25 feet and to increase the rear <br /> and lot coverage to 7 for the purpose of replacing a 16' 22.5' non-conforming <br /> y <br /> garage with a ' x 6' garage at 2151 Midlothian Road, based on the following <br /> findings: <br /> 1.
