3,0 AHNO.R- VARI E COMM E
3.1 The request for the variance included the required application form, a sketch of the
property and driveway, a written statement from the applicant, and written approval
from the adjacent property owners affected by the variance (Nick Diana Je risen
at 1964 Fairview Avenue North).
3.2 The Minor Variance Committee reviewed this request on Tuesday, May 19, 1 998,
and unanimously recommended approval of a minor variance to ' reduce
the side yard setback of a driveway to less than one feet to allow the continuance
of a driveway and parking space at 1972 Fairview Avenue North, based on the
following findings:
1. section 70 .o4(B)(9) of the City code requires a residential driveway to be
set back a minimum of five feet from the side property line. The driveway
meets the setback requirement; however, an existing parking space on the
south side of the garage is located less than one foot from the property line.
2. The replacement driveway and parking space were installed in the same
location as the existing ddvewa%l and parking space. Mr. O'Connor recalls
Af
getting permission from the adjacent property owner to install the parking
space next the garage many years ago; however, there is no variance on
record for this property.
3. The proposed valance is in harmony with the general purpose and intent of
the City's comprehensive Plan and Title 10 of the City code (Zoning).
4. The proposed variance, if ranted, will not adversely affect the public health,
g
safety, or general welfare.
E IjgQ cf __ 0LWM ACTS
4.1 By motion, approve Martin O'Connor's request for a mirror variance to increase
reduce the side yard setback of a driveway to less than one foot to allow the
continuance of a driveway and palming space at 197 Fairview Avenue North,
based on the findings of the Minor variance committee outlined in section 3.2 of
this report
Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property;photograph Of property.
60-day Time Limit.Application accepted on April 17, 1 998; Decision deadline is June 1 s, 1998.
Prepared by: K im L.Lee,AICP (490-2236)
M:\RCA\PF301 1.
PF#30 11 -RCA(05126/98)- Page 2 of
