Date: 05/20/02 <br /> Item: V.B. <br /> Report on Proposed Photo Policy <br /> At your April 15, 2002, meeting, by a 5-0 vote the City Council directed <br /> me to study and report back about a proposed photo policy for the City <br /> Council. <br /> Background <br /> Mayor Kysylyczyn has proposed that the City of Roseville adopt a photo <br /> policy similar to that of the Minnesota Senate. Under the Senate's policy, <br /> pictures taken by Senate photographers can be used by state senators <br /> for any purpose, including personal political campaigning. Under the <br /> Senate's policy, senators are required to pay the following fees for copies <br /> of pictures taken by Senate photographers when the senator will use the <br /> photo/s for political campaign purposes: <br /> 4x5 black and white print........$4.00 per print <br /> 5x7 black and white print........$6.00 per print <br /> 8x10 black and white print.. „ ..$8.0 0 per print <br /> Under the Senate's policy, when state senators propose to use photos for <br /> official state business, they need not pay for the photos. <br /> Issue <br /> Can/Should the Roseville City Council Allow Themselves to Use <br /> Photographs Taken by City Employees for Political Purposes Upon <br /> Payment of a Fee, or Can/Should the City Council Prohibit <br /> Councilmembers from Using City Photos for Political Purposes? <br /> Considerations & Principles <br /> A. Legal: Can the City Council regulate the use of city photos? The City <br /> Council must comply with all laws, including the State Data Practices <br /> Act. <br /> B. Enforceability: Would a City Council policy respecting use of city <br /> photos be enforceable? The City Council should enact policies binding <br /> itself and others that stand a reasonable chance of being successfully <br /> enforced. <br /> C. Financial: Are taxpayers being fairly reimbursed for copies of the <br /> pictures? Taxpayers ought not subsidize personal or political use of <br /> pictures taken by city employees. <br /> D. Ethical: Is it ethical for Council Members to use photographs for <br /> political campaign purposes that were taken by city employees to <br /> 1 <br />
