;OR SESSION 'GEND TTEM -B <br /> Rosevifle Right-of-way ana true t Ordinance <br /> Introduction <br /> Changes in Federal and State laws regarding the deregulation of the telecommunications industry <br /> and city right-of-way control have led to Roseville's current consideration of a new Right-of- <br /> way Management ordinance. This new ordinance, based on a model ordinance prepared by the <br /> League of Minnesota Cities, has been heard numerous times by the City Council -- most recently <br /> on March 2 ,, 1998. Final adoption of the ordinance was postponed pr1*1 20, 1998 to allow <br /> further review and discussion with NSP. This type of ordinance is new to Minnesota and is very <br /> much contingent on vales currently being developed by the Public Utilities Commission. while <br /> development of the model ordinance involved the utility industry, there are many points that <br /> have not received industry support. Considering that Roseville will be one of the first Minnesota <br /> cities to adopt a Right-of-way Management Ordinance and the potential industry legal assaults, it <br /> is important that we proceed with caution. <br /> Mal' Pohmey Issues <br /> The proposed ordinance will apply to all utility operations in public right-of-wags including gas, <br /> electric, telephone, cable TV, municipal sewer and water and private utility contractors. The <br /> proposed ordinance will allow the city to manage the location, constructions repair and <br /> maintenance of utilities to insure that public interests are protected. In many ways, the proposed <br /> Right-of-moray Management Ordinance will allow cities the same control over previously <br /> unregulated right-of-way users that gas and electric franchises have allowed in the past.
