5.3 Staff analysis of undue hardship factors is as follows:
A. The property in question cannot be put to a reasonable use if used under
conditions allowed by the official controls: A business should be allowed some
type of signage acknowledging their location. The B-Dale Club has had a pre-
existing non-conforming sign for many years, for which the need to replace the
sign was created by an accident on the site. Requiring strict compliance with the
30 foot required setback would place the sign down the slope at a location
virtually impossible to see. The Community Development Staff has
determined that the property cannot be put to a reasonable use under the
official controls.
B. The plight of the landowner is due to circumstances unique to the property not
created by the landowner: Although the B-Dale Club sign was non-conforming
it directed patrons of both the Club and City ball fields on to the site. Existing
trees and the grade of the parcel hamper placement of a new sign in conformance
with Section 1005.01 A 1. The Community Development Staff has determined
that the plight of the landowner is due to circumstances unique to the
property not created by the landowner.
The variance, if granted, will not alter the essential character of the locality:
The new sign, being placed at the property line, will be outside the public right-
of-way for the first time in many years. The sign is also tastefully designed and
of a residential scale. The Community Development Staff has determined that
this variance, if granted, will not alter the essential character of the locality.
nor adversely affect the public health, safety, or general welfare, of the city
or adjacent properties.
6.0 STAFF RECOMMENDATION:
6.1 Based on the information provided and the findings in Section 5 of this project report, the
Community Development Department recommends approval of the request by the B-
Dale Club in association with the Roseville Park and Recreation Department for a 30 foot
variance to Section 1005.01A1 of the Roseville City Code for property at 2100 Dale
Street, subject to the following conditions:
M The verification of the property line adjacent to Dale Street
b. The sign not encroaching closer that the 29 foot variance or no closer than the one
foot to the property line adjacent Dale Street.
C. The review and approval of a building permit consistent with the approved
variance and pans.
d. The sign meeting all other applicable Codes.
PF3410 - RCA 072902 - Page 3 of4
