EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota., was held on the 29ffi day of July 2002, at 6:30 p.m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO . A RESOLUTION APPROVING A VARIANCE TO SECTION 1005.01A1 (STRUCTURE SETBACKS — FRONT YARD) OF THE ROSEVILLE CITY CODE FOR PROPERTY LOCATED AT 2100 DALE STREET (PF 3410). WHEREAS, the B-Dale Club has requested a variance to Section 1005.01A1 (Front Yard Setbacks) in order to replace apre-existing non-conforming damage sign; and WHEREAS, the B-Dale Club is located at 2100 Dale Street and legally described at as: NEEDS CORRECT LEGAL DESCRIPTION (PID #1 32923220019). WHEREAS, Section 1005.01A1 requires a front yard setback of 30 feet fro all structures in a Business District; and WHEREAS, a pylon sigh is considered a structure and therefore is required to meet the 30 foot setback from property line; and WHEREAS, said former sign was destroyed by a vehicle in April 2002 and was located within the Dale Street right-of-was (approximately nine feet from the curb edge); and WHEREAS, the B-Dale Club seek to replaced the sign in a location as close to the property line as reasonably feasible; and WHEREAS, the Roseville Planning Commission held a public hearing regarding the variance request by the B-Dale Club and recommended (6-O) to approve the request, based on findings outlined in Section 5 and conditions of Section 6 of the project report dated July 10, 2002. NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the B- Dale Club a 29 foot front yard variance to Section 1005.01A1 of the Roseville City Code, based on the findings in Section 5 of the project report dated July 29, 2002, and subject to the following conditions:
