City Council Minutes — 07/29/02 <br /> Page 13 <br /> from the neighbors had been received during the Public <br /> Hearing process. <br /> Mayor Kysylyczyn responded that the City's notices <br /> would not have stipulated that, as staff had not <br /> interpreted the Conditional Use Permit to include that <br /> provision. <br /> Mr. Welsch advised that staff could not have published <br /> notice to that effect, unless zoning text changes were <br /> made to the code. <br /> Mr. Jarnnik concurred that such provision would require <br /> a two-step process requiring another application from <br /> Synergy: a text change to City ordinance, and a change <br /> in the City's zoning map. Mr. Jamnik stated that, <br /> technically the Council could consider an interim use, <br /> but didn't know if this would suffice for the applicant's <br /> intended purposes. <br /> Mayor Kysylyczyn reviewed the two (2) options <br /> available to the City Council and suggested that the <br /> Council take action tonight to approve the permit for <br /> rental and leasing of motor vehicles and resale of those <br /> vehicles. If desired by the applicant, after their further <br /> consideration, they can make application for the City to <br /> consider additional used car sales. <br /> The applicant asked, in order for them to make good <br /> business decision, how inclined Councilmembers would <br /> be to this use at their location. <br /> Councilmembers present expressed their concerns <br /> regarding this use at this location in consideration of the <br /> current zoning and neighborhood. <br /> Community Development Director Welsch advised that, <br /> should the applicant return to the Planning Comrnission <br /> for a change of the City code, the process would take <br /> between sixty (60 ) and ninety (90) days for notification, <br /> as this code revision would affect all properties, not just <br />
