REQUEST FOR COUNUL ACTION <br /> DATE. 3/23/98 <br /> ITEM Igo.. J-1 <br /> Department Approval: Manager reviewed: Agenda Section: <br /> ordinances and <br /> * - Re solutions <br /> Item Description: Right-of-Way Management Ordinance <br /> Background: over the past few months, the City Council has been considering the adoption of a <br /> new ordinance that would change how the city manages fight-of-ways. The current draft of the <br /> ordinance is based on a model ordinance prepared by the League of Minnesota Cities. On March <br /> 101) 1998, the Council continued action on the proposed ordinance to allow additional time to <br /> address concerns raised by Northern States Power(NSP). DT P's primary concern was ordinance <br /> language requiring all new facilities to be placed underground. <br /> Recently, a court ruled against NSP and in favor of the City of Oakdale regarding this very issue+ <br /> While the ruling has not been dilly reviewed, it appears that it may influence the way we view <br /> under grounding requirements. In order to allow adequate time to review this new development <br /> and discuss its ramifications with the City Council at an upcoming worksession, it is <br /> reconnixended that action on the Right-of-Way Management Ordinance be continued to the <br /> April 20, 1998 City Council Meetingâ–  <br /> RECOMMENDED COUNCYL ACTION* <br /> Motion continuing consideration of the proposed bight-of-Way Management Ordinance to <br /> April 20, 1998. <br /> Prepared by Karl P.
