CITY of ROSEViLLE <br /> PLANNED UNIT DEVELOPMENTISUBDIVISION AGREEMENT# <br /> (DRAFT/11) <br /> AGREEMENT, dated , 1998, between the City of Roseville, a Minnesota <br /> municipal corporation (herein referred to as "CITY"), and Bradley Real Estate, Inc., a <br /> Minnesota corpo ration (herein referred to as "DEVELOPER"). <br /> 1.0 Effective Date of Agreement <br /> This agreement shall be effective upon completion of the following: 1) passage and <br /> publication of ordinance ## (Rezoning of Property to PUD); ) execution of this <br /> agreement by the CITY; ) recording of the final plat and this agreement with Ramsey <br /> County; and 4) execution of a financial assistance agreement by the CITY for <br /> improvements on and adjacent to the site. <br /> 2.0 Request for Planned Unit Development and Plat Approval <br /> The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) <br /> (PF#2963) consisting of an existing 76,000 square foot (approximate) multi-tenant retail <br /> venter (Lot ), a free-standing 2,150 square foot (approximate) restaurant on the site <br /> formerly occupied by F1na Petroleum (Lot 1), and a building pad for a future tenant on the <br /> site formerly occupied by Margolis Nursery (Lot ). In conjunction with the PUD, the <br /> DEVELOPER has also asked the CITY to approve the plat for Roseville Center, a three-lot <br /> subdivision of the total 6.35 acres. The subject property is generally located west of <br /> Lexington Avenue and north of Larpenteur Avenge, and is legally desirribed as follows: <br /> The plat of Roseville Center, also legally described as: the Westerly 251.73 <br /> feet of the Easterly 800.46 feet of the southeast Quarter of the Southeast <br /> Quarter of section 15, Township 29 North, Range 23 West, Ramsey County, <br /> Minnesota, except the Northerly 767 feet, and except the Southerly 3619,89 <br /> feet thereof, the Westerly boundary line of said tract being the center line of <br /> Dunlap Street: subject to highway easement over the berth 33 feet thereof. <br /> Also the East 800.46 feet of the South 369.89 feet of the Southeast Quarter <br /> of the southeast Quarter part of Section 15, Township 29 forth, Range <br /> West, Ramsey County, Minnesota; said tract extending from the center line <br /> e <br /> of Lexington Avenue to the center line of Dunlap Street; all according to the <br /> Government Survey thereof, and except for those portions taken by the State <br /> of Minnesota for highway purposes (PINs are 15-29-23-44-0006, 15-29-23- <br /> 44-00079 15-29-23-44-0008, and 15-29-23-44-0057). <br /> 3.0 Planned Unit Development and Plat Approval <br /> The CITY hereby grants approval of the final development plan for Roseville Center <br /> Planned Unit Development, subject to the DEVELOPER's compliance with the terms and <br /> PIE D/Su bd ivis'lo n Agreement#�(Roseville center.) - Page 1 of 11 <br />
